{"id":693205,"date":"2026-01-13T13:21:12","date_gmt":"2026-01-13T13:21:12","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/693205\/"},"modified":"2026-01-13T13:21:12","modified_gmt":"2026-01-13T13:21:12","slug":"how-the-us-supreme-court-case-on-trans-athletes-could-unravel-lgbtq-rights-us-supreme-court","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/693205\/","title":{"rendered":"How the US supreme court case on trans athletes could unravel LGBTQ+ rights | US supreme court"},"content":{"rendered":"<p class=\"dcr-130mj7b\">The <a href=\"https:\/\/www.theguardian.com\/us-news\/us-supreme-court\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">US supreme court<\/a> will consider state bans on <a href=\"https:\/\/www.theguardian.com\/society\/transgender\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">transgender<\/a> athletes on Tuesday in a major <a href=\"https:\/\/www.theguardian.com\/world\/lgbt-rights\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">LGBTQ+ rights<\/a> legal battle that could have far-reaching consequences beyond youth sports.<\/p>\n<p class=\"dcr-130mj7b\">The court is hearing oral arguments in two cases brought by trans students who challenged Republican-backed laws in <a href=\"https:\/\/www.aclu.org\/cases\/bpj-v-west-virginia-state-board-education\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">West Virginia<\/a> and <a href=\"https:\/\/www.aclu.org\/cases\/hecox-v-little\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Idaho<\/a> prohibiting trans girls from participating in girls\u2019 athletic programs.<\/p>\n<p class=\"dcr-130mj7b\">Those bans were both previously <a href=\"https:\/\/www.aclu.org\/press-releases\/federal-court-blocks-west-virginia-law-banning-trans-students-school-sports\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">blocked<\/a> by federal <a href=\"https:\/\/www.aclu.org\/press-releases\/judge-blocks-first-law-targeting-transgender-athletes-case-continues\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">courts<\/a>, but the states appealed to the supreme court, which is hearing a case on trans people\u2019s access to sports for the first time. If the court\u2019s conservative supermajority sides with the states and upholds the bans, the rulings could have significant ripple effects, paving the way for the enforcement of a range of anti-LGBTQ+ policies.<\/p>\n<p class=\"dcr-130mj7b\">If the rulings are broad, civil rights advocates warn, the supreme court could make it easier for lawmakers and school officials to ban trans students\u2019 <a href=\"https:\/\/www.theguardian.com\/world\/ng-interactive\/2024\/oct\/12\/gavin-grimm-trans-youth-rights\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">access to appropriate bathrooms<\/a> and facilities, restrict LGBTQ+ youth\u2019s ability to use chosen names and <a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/apr\/11\/florida-pronouns-teacher\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">pronouns<\/a>, enforce strict <a href=\"https:\/\/www.theguardian.com\/us-news\/2023\/may\/21\/trans-girl-mississippi-high-school-graduation\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">dress codes<\/a>, limit protections against anti-LGBTQ+ <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/dec\/16\/student-civil-rights-doj-discrimination\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">harassment<\/a>, and further deny <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/oct\/18\/airlines-passports-x-sex-marker\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">access to accurate identification documents<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">\u201cIt\u2019s really scary. The supreme court is poised to tell us whether dislike and moral disapproval of a specific group can be a real basis to make law,\u201d said Cathryn Oakley, senior director of legal policy for the Human Rights Campaign, an LGBTQ+ rights group.<\/p>\n<p>\u2018This isn\u2019t just about me\u2019<\/p>\n<p class=\"dcr-130mj7b\">In Little v Hecox, Lindsay Hecox, a trans college student, challenged Idaho\u2019s first-in-the-nation law categorically banning trans women and girls from women\u2019s sports teams, which passed in 2020, <a href=\"https:\/\/www.aclu.org\/cases\/hecox-v-little?document=Lindsay-Hecox-Declaration\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">blocking<\/a> her from <a href=\"https:\/\/www.aclu.org\/cases\/hecox-v-little?document=Complaint\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">track<\/a> at age 19. She has since sought to have the case dismissed, arguing she is no longer pursuing sports and doesn\u2019t want to be <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-38\/373555\/20250903153854015_Hecox%20Suggestion%20of%20Mootnes%20Appendix.pdf\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">subjected to ongoing harassment<\/a>. But the court decided to hear the case, anyway.<\/p>\n<p class=\"dcr-130mj7b\">In the second case, West Virginia v BPJ, 15-year-old Becky Pepper-Jackson has challenged her state\u2019s law banning her track participation, saying in a recent <a href=\"https:\/\/www.aclu.org\/press-releases\/transgender-west-virginia-teen-challenges-athletic-ban-at-supreme-court\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">statement<\/a>: \u201cThis case isn\u2019t just about me, or even just about sports. It\u2019s just one part of a plan to push transgender people like me out of public life entirely.\u201d<\/p>\n<p class=\"dcr-130mj7b\">In the last five years, <a href=\"https:\/\/williamsinstitute.law.ucla.edu\/publications\/impact-trans-sports-ban-eo\/\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">27 states<\/a> have <a href=\"https:\/\/www.theguardian.com\/us-news\/2021\/mar\/23\/anti-trans-bills-us-transgender-youth-sports\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">restricted trans children and teens<\/a>\u2019 access to school <a href=\"https:\/\/www.lgbtmap.org\/equality-maps\/youth\/sports_participation_bans\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">sports<\/a> \u2013 most targeting trans girls, but <a href=\"https:\/\/williamsinstitute.law.ucla.edu\/wp-content\/uploads\/Comment-Title-IX-Sports-May-2023.pdf\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">some<\/a> applying to all trans youth.<\/p>\n<p>People protest against anti-transgender legislation in Boise, Idaho, on 13 March 2024. Photograph: Darin Oswald\/Idaho Statesman via Getty Images<\/p>\n<p class=\"dcr-130mj7b\">The anti-LGBTQ+ legal movement <a href=\"https:\/\/www.theguardian.com\/us-news\/2021\/mar\/23\/anti-trans-bills-us-transgender-youth-sports\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">shifted its focus to trans athletes<\/a> after the supreme court legalized marriage equality in 2015. Supporters of bans on trans athletes, including the Alliance Defending Freedom (ADF), the <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/oct\/06\/alliance-defending-freedom-supreme-court-conversion-therapy\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">major Christian legal group<\/a> defending the state laws this week, argue they are promoting fairness and safety in women\u2019s sports.<\/p>\n<p class=\"dcr-130mj7b\">LGBTQ+ rights advocates counter there is <a href=\"https:\/\/www.instagram.com\/reels\/DTJS_cYkjPu\/\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">no credible evidence<\/a> that inclusive sports policies have endangered cis girls and women, and the controversy is manufactured by anti-trans activists; one conservative group, for example, <a href=\"https:\/\/www.nytimes.com\/2019\/11\/03\/us\/politics\/kentucky-transgender-school-sports.html?\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">acknowledged<\/a> in 2019 that its polling suggested people could be swayed to support Republicans with ads raising fears about trans girls in sports.<\/p>\n<p class=\"dcr-130mj7b\">The GOP\u2019s escalating campaign against trans youth athletes is directed at a minuscule fraction of the population. The National Collegiate Athletic Association president testified in 2024 he was aware of <a href=\"https:\/\/thehill.com\/homenews\/lgbtq\/5046662-ncaa-president-transgender-athletes-college-sports\/\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">fewer<\/a> than 10 trans college athletes, and Republican legislators have at times <a href=\"https:\/\/apnews.com\/article\/lawmakers-unable-to-cite-local-trans-girls-sports-914a982545e943ecc1e265e8c41042e7\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">struggled<\/a> to identify any trans girls playing sports in their states.<\/p>\n<p class=\"dcr-130mj7b\">Meanwhile, states such as California have long <a href=\"https:\/\/www.nytimes.com\/2025\/05\/30\/us\/transgender-girls-athletes-california.html\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">allowed<\/a> trans youth to play on teams that match their gender with little pushback \u2013 until the issue <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/jun\/05\/california-ab-hernandez-trump-attacks\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">became subject to national debate<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">While there are few out trans youth on sports teams at all levels, advocates note the bans have been <a href=\"https:\/\/www.instagram.com\/reels\/DSaoWshAbgI\/\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">devastating<\/a> for those directly affected and LGBTQ+ youth who may be avoiding athletics due to the climate.<\/p>\n<p>Potential outcomes<\/p>\n<p class=\"dcr-130mj7b\">Lawyers for Hecox and Pepper-Jackson argue the bans violate the equal protection clause of the constitution, and in the West Virginia case, attorneys also argue the ban violates <a href=\"https:\/\/www.theguardian.com\/sport\/2022\/jun\/23\/50-years-of-title-ix-the-us-law-that-attempted-to-make-sports-equal\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Title IX<\/a>, the federal law prohibiting sex discrimination in schools.<\/p>\n<p class=\"dcr-130mj7b\">One crucial question the court will consider is whether the laws are discriminatory against trans people and merit what\u2019s known as \u201c<a href=\"https:\/\/www.nytimes.com\/2024\/12\/04\/us\/supreme-court-transgender-heightened-scrutiny.html\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">heightened scrutiny<\/a>\u201d \u2013 a more rigorous review, meaning the government has a higher burden to justify the bans. The court has <a href=\"https:\/\/www.nytimes.com\/2025\/06\/18\/us\/politics\/supreme-court-trans-children.html?smid=url-share\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">never<\/a> issued a ruling addressing whether it considers trans people a class that deserves this protection.<\/p>\n<p class=\"dcr-130mj7b\">If the court were to use the sports cases to rule that laws targeting trans people do not warrant heightened scrutiny, then \u201cany type of law discriminating against trans people is going to be presumptively constitutional\u201d, said Joshua Block, senior counsel for the LGBTQ and HIV projects at the ACLU, which is representing both students.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThese laws were passed to establish a legal principle that transgender girls and women shouldn\u2019t be treated like other girls and women, and then to use that principle as a jumping-off point for rolling back protections for transgender people more generally,\u201d said Block, who is presenting oral arguments.<\/p>\n<p class=\"dcr-130mj7b\">At least one prominent campaigner for trans sports bans has <a href=\"https:\/\/bsky.app\/profile\/gbbranstetter.bsky.social\/post\/3m62zpbl3ls2g\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">made this point<\/a> explicitly, <a href=\"https:\/\/www.nytimes.com\/2025\/08\/27\/us\/riley-gaines-trans-athletes.html\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">saying last year<\/a>: \u201cThe gender ideology movement is a house of cards, and I believe it\u2019s lying on that sports issue. Photograph: Kayla Bartkowski\/Getty Images<\/p>\n<p class=\"dcr-130mj7b\">Scott Skinner-Thompson, a Colorado law school professor, said he feared the ruling could leave trans people with \u201cminimal constitutional protections\u201d from laws explicitly targeting them: \u201cThat would further<strong> <\/strong>embolden legislators to continue to pass laws that exclude transgender people from public life.\u201d<\/p>\n<p class=\"dcr-130mj7b\">In addition to bolstering laws banning trans people from bathrooms, that outcome could also make it even harder for <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/dec\/05\/doj-prison-lgbtq-sexual-abuse-protections\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">incarcerated trans people<\/a> to access critical healthcare and safe housing, said Skinner-Thompson, who signed an <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-43\/384866\/20251117175749449_24-38%20%2024-43%20Brief%20of%20Constitutional%20Law%20Professors.pdf\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">amicus brief<\/a> arguing the bans should remain blocked.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThe broad question in these cases is: are we a society that\u2019s interested in recognizing people\u2019s common humanity, or are we more interested in excluding people for the purpose of a particular version of what counts as \u2018fair\u2019?\u201d<\/p>\n<p class=\"dcr-130mj7b\">The ruling could also establish that trans people are not protected under Title IX, which could be catastrophic, said Block. A school could deny admission to or expel a student on the basis of them being trans and it wouldn\u2019t be considered a Title IX violation, he said.<\/p>\n<p class=\"dcr-130mj7b\">In one particularly damaging outcome, which he hoped was unlikely, Block said the court could support the Trump administration\u2019s assertions that Title IX requires that schools ban trans girls from sports. That would potentially invalidate policies in Democratic-run states that allow or mandate trans inclusion in youth athletics.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWest Virginia\u2019s law is not discriminatory \u2013 it treats all students equally and represents a common-sense approach to a complex issue,\u201d a spokesperson for the state\u2019s attorney general said in an email. \u201cIt advances Title IX\u2019s core mission to ensure that women and girls have access to athletic and academic opportunities that were long reserved for men.\u201d The law, the spokesperson continued, \u201cdoes not ban anyone from playing sports based on gender identity\u201d and addresses \u201clegitimate questions about competitive fairness and safety\u201d.<\/p>\n<p class=\"dcr-130mj7b\">A spokesperson for Idaho\u2019s attorney general did not respond to an inquiry.<\/p>\n<p class=\"dcr-130mj7b\">An ADF spokesperson said in an email: \u201cMen and women are different, and those differences matter in sports. When you let males into women\u2019s sports, it harms women \u2026 causing women to lose their dignity, privacy, and equal opportunities.\u201d The spokesperson said the harm was \u201cundeniable\u201d and it was \u201cvital to make sure our laws can acknowledge reality and protect women\u201d.<\/p>\n<p>\u2018The bans endanger all girls\u2019<\/p>\n<p class=\"dcr-130mj7b\">Advocates are not optimistic the court will block the sports bans, but hope the decision will be narrow. Last year, the court upheld <a href=\"https:\/\/www.theguardian.com\/society\/2025\/jun\/18\/tennessee-supreme-court-gender-affirming-care-skrmetti\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Tennessee\u2019s ban on gender-affirming care<\/a> for trans minors. The ruling was a devastating blow for access to vital medical treatments, but was limited to healthcare and did not, as <a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/dec\/04\/supreme-court-trans-youth-civil-rights\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">some had feared<\/a>, establish a broader precedent supporting anti-trans legislation.<\/p>\n<p class=\"dcr-130mj7b\">\u201cBPJ is about a 15-year-old kid that the entire state of West Virginia has brought to the supreme court to continue to fight to exclude her from the track-and-field team,\u201d said Karen Loewy, interim deputy legal director for litigation at Lambda Legal, a rights group also representing Pepper-Jackson. \u201cThe question before the court is narrow \u2026 and there are ways to answer that question narrowly.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Shayna Medley, senior staff attorney at Advocates for Trans Equality, noted that sports bans have a record of harming both trans and cisgender girls. To enforce restrictions, some states allow <a href=\"https:\/\/www.sltrib.com\/news\/education\/2023\/10\/04\/parents-criticize-completely\/\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">invasive forms<\/a> of <a href=\"https:\/\/www.hrw.org\/news\/2023\/03\/31\/sex-testing-rules-harm-women-athletes\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">sex testing<\/a>, which invite community members to scrutinize individual girls if they have any suspicions about their identities.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThese bans endanger all girls by empowering adults, parents, politicians, coaches to investigate anyone who they suspect to be trans on the basis of how they look and subject them to invasive sex-testing procedures,\u201d they said. \u201cWe\u2019ve seen cis girls with short hair be accused of being trans and asked to turn over medical records. It really creates a climate of gender policing of anyone who doesn\u2019t conform to stereotypes.
