{"id":70129,"date":"2025-05-03T03:39:08","date_gmt":"2025-05-03T03:39:08","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/70129\/"},"modified":"2025-05-03T03:39:08","modified_gmt":"2025-05-03T03:39:08","slug":"astronomy-ireland-founder-and-solicitor-walk-out-of-wrc-hearing-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/70129\/","title":{"rendered":"Astronomy Ireland founder and solicitor walk out of WRC hearing \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph\">Astronomy Ireland founder David Moore has abandoned a tribunal hearing into claims of workplace rights breaches by a former manager at organisation who has accused him of \u201cpocketing\u201d money meant for it.<\/p>\n<p class=\"c-paragraph paywall\">A Workplace Relations Commission (WRC) adjudicator told Mr Moore his approach to the case \u2013 which has been repeatedly adjourned since last June \u2013 had the appearance of \u201cdelay, delay, delay\u201d so the matter would \u201cnever be heard\u201d.<\/p>\n<p class=\"c-paragraph paywall\">Mr Moore and a solicitor acting for Astronomy Ireland stood up and walked out of a hearing room on Friday when the adjudicator said he intended to press on with hearings despite renewed objections from the respondents.<\/p>\n<p class=\"c-paragraph paywall\">The claimant, Sonya Martin, worked at Astronomy Ireland\u2019s office in Ballycoolin, Dublin 15, from 2021 to July 2023, when she quit her job as manager. She says she was forced to resign as a result of workplace stress and concerns she had about financial arrangements at Astronomy Ireland which she said she raised with Mr Moore in 2023.<\/p>\n<p class=\"c-paragraph paywall\">She has made complaints under the Unfair Dismissals Act 1977, the Organisation of Working Time Act 1997, and the Terms of Employment (Information) Act 1994 against the science organisation. Mr Moore was told he and three other members of Astronomy Ireland\u2019s management committee were being attached personally to the case in January of this year.<\/p>\n<p class=\"c-paragraph paywall\">Ms Martin gave evidence last year that she felt she had no choice  but to resign in the wake of a \u201cheated\u201d meeting when Mr Moore told her the  organisation had no board \u2013  something she believed made her \u201cparty to a fraud on the State\u201d, as she had applied for grants on the basis that it did.<\/p>\n<p class=\"c-paragraph paywall\">She said she was already suffering from workplace stress following months of pressure while she worked two jobs in the wake of the sacking of a junior employee who was alleged to have stolen cash and left \u201cfaecal matter\u201d and \u201cejaculate\u201d behind in a bathroom at Astronomy Ireland\u2019s offices.<\/p>\n<p class=\"c-paragraph paywall\">After pressure from Astronomy Ireland\u2019s management committee about the amount of money in the society\u2019s bank accounts, a junior administrator raised concerns that Mr Moore was in the practice of \u201cpocketing\u201d speaking fees which were meant to be the society\u2019s main revenue stream, Ms Martin said.<\/p>\n<p class=\"c-paragraph paywall\">Mr Moore, who is well known for his press and media appearances on space exploration and astronomy, claimed last year that the society had been \u201clibelled\u201d before the Workplace Relations Commission (WRC), branding accusations of money going astray and financial irregularities as \u201cfalse\u201d. <\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/business\/work\/2025\/01\/30\/founder-of-astronomy-ireland-accused-him-of-pocketing-money-intended-for-organisation-wrc-hears\/\" rel=\"noreferrer noopener\" target=\"_blank\">Founder of Astronomy Ireland accused of \u2018pocketing\u2019 money intended for organisation, WRC hearsOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall\">Solicitor Eugene Smartt, appearing for Astronomy Ireland at Friday\u2019s hearing, said he had a \u201cmajor difficulty\u201d with the case proceeding, arguing the original complaint was against \u201can unincorporated association which has no legal status or existence\u201d and that Ms Martin was too late to make complaints against Mr Moore and the committee members.<\/p>\n<p class=\"c-paragraph paywall\">Daniel O\u2019Connell of Keans Solicitors, for Ms Martin, said that adjudicator Jim Dolan had decided the point already. \u201cI don\u2019t think my client should be punished for the fact that Astronomy Ireland haven\u2019t got their house in order,\u201d he added.<\/p>\n<p class=\"c-paragraph paywall\">Mr Moore and Mr Smartt questioned whether the WRC had correctly served all five parties with notice of the proceedings, as well as the decision to join the other committee members. <\/p>\n<p class=\"c-paragraph paywall\">\u201cIt is my intention to hear this case today,\u201d Mr Dolan said. He said the WRC had written to the parties by email and sent letters to a post office box in Artane, Dublin 5, which had been given by Mr Moore in January as Astronomy Ireland\u2019s correct address. <\/p>\n<p class=\"c-paragraph paywall\">Mr Smartt reiterated his position that any decision against Astronomy Ireland would be against \u201can entity that has no legal existence\u201d and said: \u201cThe best we can do is withdraw.\u201d<\/p>\n<p class=\"c-paragraph paywall\">After further exchanges, Mr Dolan said: \u201cMr Moore is sitting there telling us he doesn\u2019t recognise he\u2019s the respondent in this. He signed the sign-in sheet 20 minutes ago: \u2018David Moore, position: respondent.\u2019\u201d<\/p>\n<p class=\"c-paragraph paywall\">\u201cI\u2019m the respondent for Astronomy Ireland, it\u2019s not for me personally. I told you in January I don\u2019t accept being personally attached,\u201d Mr Moore said, adding: \u201cIt\u2019s very complicated. l\u2019m lost, I\u2019d appreciate an adjournment to take legal advice.\u201d<\/p>\n<p class=\"c-paragraph paywall\">\u201cI\u2019m not adjourning. I don\u2019t want you to think that the object here is delay, delay, delay, and this case will never be heard,\u201d Mr Dolan said.<\/p>\n<p class=\"c-paragraph paywall\">\u201cThat\u2019s not the case,\u201d Mr Moore said.<\/p>\n<p class=\"c-paragraph paywall\">\u201cCan you appreciate that\u2019s the way you\u2019re coming across,\u201d Mr Dolan said.<\/p>\n<p class=\"c-paragraph paywall\">\u201cI accept that,\u201d Mr Moore said.<\/p>\n<p class=\"c-paragraph paywall\">\u201cYou want to leave,\u201d Mr Dolan said. <\/p>\n<p class=\"c-paragraph paywall\">\u201cYes, absolutely,\u201d Mr Smartt said.
