If Hungary\u2019s approach goes unanswered, he warned, others will bypass the courts across the 27-country bloc to protect their political allies.<\/p>\n<p>\u201cThis is a dangerous precedent for the entire European Union,\u201d \u017burek said. \u201cIf the EU accepts this, everyone will start citing it \u2026 justice will become a political tool.\u201d<\/p>\n<p>\u201cAn asylum decision is a political decision \u2014 not a ruling by an independent court,\u201d he added. \u201cThat is what is most worrying, because it circumvents the rules of the European arrest warrant.\u201d<\/p>\n<p>Ziobro fled to Hungary after <a href=\"https:\/\/www.politico.eu\/article\/former-polish-justice-minister-zbigniew-ziobro-stripped-of-immunity-to-face-charges-pis-pegasus\/\" rel=\"nofollow noopener\" target=\"_blank\">losing parliamentary immunity<\/a> in November.<\/p>\n<p>A Polish court is expected to decide in February whether to order Ziobro\u2019s arrest. Under normal EU practice, such a ruling would trigger swift extradition. But in Orb\u00e1n\u2019s Hungary, there is a high risk it will hit a dead end.<\/p>\n<p>A loophole already in use<\/p>\n<p>This is not Poland\u2019s first run-in with this loophole. Ziobro\u2019s case follows that of his former deputy, Marcin Romanowski, who was <a href=\"https:\/\/www.politico.eu\/article\/viktor-orban-infuriate-warsaw-poland-marcin-romanowski-asylum\/\" rel=\"nofollow noopener\" target=\"_blank\">granted asylum by Hungary in 2024<\/a> and remains there despite a valid arrest warrant.
