But after a year of protests by farmers, Labour announced a surprise <a href=\"https:\/\/www.cityam.com\/lawyers-warn-farmers-labours-u-turn-on-iht-threshold-not-an-all-clear\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">partial U-turn in December<\/a>, raising the threshold to \u00a32.5m from \u00a31m, effective from April 2026.<\/p>\n<p>The Treasury now <a href=\"https:\/\/www.cityam.com\/labours-inheritance-tax-reforms-face-legal-test-as-farmers-argue-unlawful-consultation\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">faces a legal challenge<\/a> over the procedure it undertook before making these changes, as a judicial review argues that it acted unlawfully by failing to follow its 2011 \u2018Tax Consultation Framework\u2019.<\/p>\n<p>The claimants are farmers Thomas Martin and George Martin of the campaign group Farmers and Businesses for Fair Tax Relief, and the professional services firm Alvarez &amp; Marsal.<\/p>\n<p>Barrister Aparna Nathan KC told the court on Tuesday that the framework requires at least one public consultation, but stated that none was carried out. Instead, it was argued, rather than consulting on the totality of the changes to APR\/BPR, the Chancellor published a consultation document on trusts, which made up \u201conly a limited aspect\u201d of the proposed changes. <\/p>\n<p>Nathan KC told the two judges that \u201cthe defendants [government] broke that promise\u201d for a public consultation. <\/p>\n<p>Questions raised over parliamentary privilege<\/p>\n<p>However, another argument in the case concerns whether the court has\u00a0jurisdiction to review executive actions that lead to legislation.<\/p>\n<p>\t\t\t\t\tRead more<\/p>\n<p>\t\t\t<a class=\"read-more__link\" href=\"https:\/\/www.cityam.com\/labours-inheritance-tax-reforms-face-legal-test-as-farmers-argue-unlawful-consultation\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Labour\u2019s inheritance tax reforms face legal test as farmers argue unlawful consultation<\/a><\/p>\n<p>Lindsay Hoyle, the Speaker of the House of Commons, was granted permission to intervene in the case due to constitutional issues at stake, and is expected to have arguments presented to the court on Wednesday.<\/p>\n<p>According to court documents, the Speaker takes issue with the claim on the basis that it infringes Parliamentary privilege, as the <a href=\"https:\/\/bills.parliament.uk\/bills\/4042\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Finance Bill<\/a> is currently being read at the House of Lords.<\/p>\n<p>In the Speaker\u2019s opinion, \u201cthe claim now appears to be academic, given that the Finance Bill has been introduced with the relevant provisions, and is currently before Parliament\u201d, and that the court would be engaging in a \u201cconfrontation\u201d with Parliament.<\/p>\n<p>In court on Tuesday, the two judges, Lady Justice Whipple and Mr Justice Fordham, challenged the \u201cseparation of powers\u201d to the claimant\u2019s barrister.  <\/p>\n<p>The Devereux Chambers silk argued that the claimants are challenging a decision made by the Chancellor in her executive capacity (as a Minister), not as an MP, and that this decision occurred outside Parliament. <\/p>\n<p>The court is being asked to issue a formal declaration that the Treasury acted unlawfully by failing to conduct a public consultation on changes to IHT reliefs. <\/p>\n<p>The hearing will conclude on Wednesday, following the Treasury and the Speaker\u2019s arguments, with a judgment in the coming months. <\/p>\n<p>\t\t\t\t\tRead more<\/p>\n<p>\t\t\t<a class=\"read-more__link\" href=\"https:\/\/www.cityam.com\/legal-battle-over-labours-inheritance-tax-reliefs-set-for-march-hearing\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Legal battle over Labour\u2019s inheritance tax reliefs set for March hearing<\/a><\/p>\n<p>\t\tSimilarly tagged content: <\/p>\n<p>\t\t\tSections\t\t<\/p>\n<p>\t\t\tCategories\t\t<\/p>\n<p>\t\t\tPeople &amp;
