{"id":925004,"date":"2026-04-28T22:39:51","date_gmt":"2026-04-28T22:39:51","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/925004\/"},"modified":"2026-04-28T22:39:51","modified_gmt":"2026-04-28T22:39:51","slug":"mahmoods-flagship-one-in-one-out-migrant-deal-with-france-put-in-jeopardy-by-high-court-challenge-2","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/925004\/","title":{"rendered":"Mahmood\u2019s flagship one in, one out migrant deal with France put in jeopardy by High Court challenge"},"content":{"rendered":"<p class=\"mb-4 text-lg md:leading-8 break-words\"><a data-yga=\"{\" ylinkelement=\"\" href=\"https:\/\/www.independent.co.uk\/topic\/shabana-mahmood\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"elm:link;elmt:article_link;slk:Shabana Mahmood;itc:0;sec:content-canvas\" class=\"link \">Shabana Mahmood<\/a>\u2019s flagship one in, one out migrant deal with France has been thrown into jeopardy by a High Court challenge claiming some deportations are unlawful.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Six migrants, <a data-yga=\"{\" ylinkelement=\"\" href=\"https:\/\/uk.news.yahoo.com\/labour-efforts-ramp-one-one-175137519.html\" data-ylk=\"elm:link;elmt:article_link;slk:who claim they are victims of human trafficking,;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">who claim they are victims of human trafficking,<\/a> are challenging the lawfulness of how they were treated, with at least three already deported to France under Labour\u2019s flagship scheme.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">If they are successful, it will significantly impact the home secretary\u2019s ability to deport large numbers of people under the deal, which sees migrants deported from the UK in exchange for <a data-yga=\"{\" ylinkelement=\"\" href=\"https:\/\/www.independent.co.uk\/topic\/asylum-seekers-0\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"elm:link;elmt:article_link;slk:asylum seekers;itc:0;sec:content-canvas\" class=\"link \">asylum seekers<\/a> from France.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Ms Mahmood changed the modern slavery guidance last September to speed up <a data-yga=\"{\" ylinkelement=\"\" href=\"https:\/\/uk.news.yahoo.com\/starmer-flagship-one-one-scheme-145202912.html\" data-ylk=\"elm:link;elmt:article_link;slk:deportations under the scheme.;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">deportations under the scheme.<\/a> Under the previous guidance, migrants who have had their trafficking claims rejected by <a data-yga=\"{\" ylinkelement=\"\" href=\"https:\/\/www.independent.co.uk\/topic\/home-office\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"elm:link;elmt:article_link;slk:Home Office;itc:0;sec:content-canvas\" class=\"link \">Home Office<\/a> officials could apply for the decision to be reviewed before deportation. Now, they are effectively unable to ask for a reconsideration from the UK, but must instead apply for help in France.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Sam Grodzinski KC, barrister for the claimants, told the High Court that Ms Mahmood\u2019s decision to block modern slavery appeals was unlawful and breached human rights laws.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">He told Justice Sheldon that a lawful system in the UK is one that \u201cidentifies the paramount importance of identifying victims [of trafficking] correctly\u201d.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Mr Grodzinski said that the new policy amounted to an \u201cinstitutional disregard of potentially relevant evidence\u201d. He said that it was inconsistent with the UK\u2019s obligations under the European Convention on Human Rights (ECHR) and the Council of Europe Convention on Action against Trafficking (ECAT).<\/p>\n<p><img alt=\"Screen grab taken from video issued by the Home Office of the first small boat migrants detained under the UK\u2019s new \u2018one in, one out\u2019 deal, at Western Jet Foil in Dover, Kent (PA)\" loading=\"lazy\" width=\"960\" height=\"540\" decoding=\"async\" data-nimg=\"1\" class=\"rounded-lg\" style=\"color:transparent\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2026\/04\/e8c276d6ac93254c363a5488755541e6.jpeg\"\/><\/p>\n<p>Screen grab taken from video issued by the Home Office of the first small boat migrants detained under the UK\u2019s new \u2018one in, one out\u2019 deal, at Western Jet Foil in Dover, Kent (PA)<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Mr Grodzinski told the court: \u201cIndividuals have a fundamental right under ECAT to have their claims properly investigated.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">He said that government data showed that in 2025, nearly four in five requests for reconsiderations of initial modern slavery decisions were overturned in favour of the claimant.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Mr Grodzinski said that many migrants, who are questioned within hours of arrival on small boats by <a data-yga=\"{\" ylinkelement=\"\" href=\"https:\/\/www.independent.co.uk\/topic\/home-office\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"elm:link;elmt:article_link;slk:Home Office;itc:0;sec:content-canvas\" class=\"link \">Home Office<\/a> officials, don\u2019t disclose their history of trafficking straight away, often out of confusion over what they are being asked. \u201cVictim identification is a process that takes time; it can\u2019t be done speedily, not if it is to be done properly,\u201d he added.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The court heard that all six claimants had arrived in the UK on small boats in 2025, and some were removed to France under the \u201cone in, one out\u201d scheme.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">All six claimants had sought asylum and made trafficking claims.
