We cannot do what we do without your support.<\/p>\n<\/p>\n<p>Poland\u2019s government has filed a complaint to the Court of Justice of the European Union (CJEU) against the free-trade deal between the EU and the South American Mercosur bloc that recently went into provisional force. It wants the agreement to be suspended until the court issues a ruling.<\/p>\n<p>Warsaw has long been critical of the agreement, in particular over the potential negative impact that imports of agriculture products from Mercosur, which includes Argentina, Brazil, Paraguay and Uruguay,\u00a0could have on Polish farmers.<\/p>\n<p>After Poland was outvoted in January when the trade agreement was <a href=\"https:\/\/notesfrompoland.com\/2026\/01\/09\/poland-fails-in-bid-block-eus-mercosor-trade-deal-as-farmers-protest-in-warsaw\/\" target=\"_blank\" rel=\"noopener\">approved by a majority of EU member states<\/a>, the government pledged that it would launch a legal challenge.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"pl\" dir=\"ltr\">Obiecali\u015bmy i zrobili\u015bmy to. We\u2019re fighting for equal trade rules and the highest standards. The Polish countryside can count on us!\u201d<\/p>\n<p>Speaking later to the Polish Press Agency (PAP), deputy foreign minister Marcin Bosacki confirmed that Poland had filed its challenge to the Luxembourg court on Sunday evening. He added that Warsaw wants \u201cimplementation and execution of this agreement to be suspended\u201d while the case is considered.<\/p>\n<p>\u00a0<\/p>\n<p>In January, 21 of the EU\u2019s 27 member states voted to approve the Mercosur agreement. Poland was opposed, alongside Austria, France, Hungary and Ireland, while Belgium abstained.<\/p>\n<p>Later that month, the European Parliament <a href=\"https:\/\/www.europarl.europa.eu\/news\/en\/press-room\/20260116IPR32450\/eu-mercosur-meps-demand-a-legal-opinion-on-its-conformity-with-the-eu-treaties\" target=\"_blank\" rel=\"noopener\">submitted a request<\/a> to the CJEU to assess whether the free-trade deal conforms to the EU treaties. In February, it also approved tougher safeguards that will trigger intervention if the prices of agricultural products drop by more than 5%.<\/p>\n<p>Even though the trade deal has not yet received final ratification \u2013 still requiring approval from the European Parliament and national parliaments \u2013 it nevertheless went into provisional force on 1 May. It greatly reduces tariffs on industrial and agricultural goods traded between the EU and Mercosur.<\/p>\n<p>Farmers from Poland and some other member states have <a href=\"https:\/\/notesfrompoland.com\/2025\/12\/30\/polish-farmers-stage-nationwide-protest-against-eus-planned-mercosur-free-trade-deal\/\" target=\"_blank\" rel=\"noopener\">protested against the deal<\/a>, arguing that the influx of South American produce will not only undercut European producers but also harm consumers, because Mercosur countries have lower environmental and safety standards.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The EU-Mercosur free-trade deal took provisional effect in May and is expected to boost EU exports to the Mercosur region by 39% by 2040, but how do the benefits compare with growing criticism?<a href=\"https:\/\/twitter.com\/hashtag\/EuropeInMotion?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">#EuropeInMotion<\/a> explains. <a href=\"https:\/\/t.co\/CTmnTtiIra\">pic.twitter.com\/CTmnTtiIra<\/a><\/p>\n<p>\u2014 euronews (@euronews) <a href=\"https:\/\/twitter.com\/euronews\/status\/2053814515196657945?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">May 11, 2026<\/a><\/p>\n<\/blockquote>\n<p>News website Gazeta.pl reports that Poland\u2019s complaint to the CJEU is partly procedural \u2013 concerning the fact that the agreement went into provisional force despite lacking ratification \u2013 but also substantive: it argues that Mercosur farmers will not face the same standards as EU ones, giving them an unfair advantage.<\/p>\n<p>\u201cWe are fighting to prevent food from reaching Poland from South America that does not meet EU standards,\u201d said Krajewski earlier this month. \u201cWe care about the health of consumers and the competitiveness of Polish farms.\u201d<\/p>\n<p>Broadcaster Polskie Radio notes that there are still two weeks remaining for other countries to file complaints against the Mercosur agreement to the CJEU, but that none have indicated an intention to do so.<\/p>\n<p>Any decision by the European court would take a year or more to be made, it adds.
