Wolverhampton City Council has refused plans to turn a residential property into a new children’s care home.<\/p>\n

On April 7, the Council received a proposal for a change of use from a residential property into a children’s care home on 1 Harvesters Walk, Wolverhampton<\/a>, with the agent listed as Anjum Mehmood at Anjum Design Ltd.<\/p>\n

As of May 11, a decision has been made, which stipulates the Council has decided to refuse permission<\/a> for the development.<\/p>\n

The decision document states the application would mean the loss of a family property, with the Children’s Services at Wolverhampton City Council stating there is no need for a new children’s care home in the city.<\/p>\n

“The application will involve the loss of a family dwelling house and the Council\u2019s Children\u2019s Services confirm there is not a demonstrable need for new children\u2019s home accommodation in the City of Wolverhampton.<\/p>\n

“As such, the change of use toa small children\u2019s care home would reduce the supply of family housing within the area and therefore, would not maintain the existing residential population which would be typically associated with a dwelling house within the city. The development would conflict with Policy HOU1 of the BCCS.”<\/p>\n

Policy HOU1 of the Black Country Core Strategy focuses on delivering sustainable housing growth. It lays out the goal to deliver at least 63,000 net new homes over the period 2006 to 2026.<\/p>\n

The document adds: “The proposed use of the building would not operate in the same way as the overall residential character of the area, contrary to Policy ENV3 of the BCCS.<\/p>\n

“The proposal would be harmful to the living conditions of neighbouring occupants,contrary to Policies H6 and AM12 of the UDP.<\/p>\n

“The proposed use would be detrimental to highway safety, contrary to Policies AM12,AM15 and B5 of the UDP.”<\/p>\n

The key issues the Council lists in this case are housing supply, character, living conditions and car parking provision and highway safety.<\/p>\n

Housing<\/strong><\/p>\n

In regards to housing, the Council explains Children’s Services do not currently have a need for anymore private homes in the area.<\/p>\n

It states: “There are over 30 private homes already in the city, most of these have children from other loca lauthorities, not Wolverhampton young people.<\/p>\n

“Also, the Council\u2019s Children\u2019s Services are opening two local authority homes in the city.<\/p>\n

“There is enough childcare provision within this area to meet the city\u2019s demand.<\/p>\n

“As such, the change of use to a small children\u2019s care home would reduce the supply of family housing within the area and therefore would not maintain the existing residential population which would be typically associated with a dwellinghouse within the city.”<\/p>\n

Character<\/strong><\/p>\n

The Council refers to the shift patterns proposed for staff in the plans for the children’s care facility – referring to the “regular changeover” of staff.<\/p>\n

It adds: “As such, this would create an increase in the comings and goings from the property, by a number of different people.<\/p>\n

“This would be noticeably different from the comings and goings of a regular family in its existing use.<\/p>\n

“This level of activity, where there would be several different people coming and going from the property on a regular basis, would be unlike that which could reasonably be expected with a single-family unit.<\/p>\n

“Therefore, the proposed use of the building would not operate in the same way to the overall residential character of the area.”<\/p>\n

Living conditions<\/strong><\/p>\n

The document refer once more to the “staff rota” mentioned in the plans for the start and end time of the staff at the site.<\/p>\n

It reads: “The appellant has set out the staff rota above which includes the start and finish times of employees.<\/p>\n

“These timings include late night finishes. The handover between staff members would occur at unsociable hours.<\/p>\n

“Therefore, the comings and goings of the proposal would be harmful to the living conditions of neighbouring occupants due to the time of day they are likely to be undertaken.<\/p>\n

“There would be a transient level of activity, by a number of different people, which would cause undue noise and disturbance.”<\/p>\n

Car parking provision and highway safety<\/strong><\/p>\n

The proposal included reference to a presence of regular staff and individuals who would visit the site if it was to be a children’s home.<\/p>\n

In the decision document, it speaks of the parking demand – and how during times such as changeover the demand for parking could be an issue.<\/p>\n

It reads: “As part of the proposed use, there would be a presence of regular staff and individuals whowould visit the site on a more irregular and infrequent basis.<\/p>\n

“These include a manager, social and healthcare workers. Parking is afforded to the rear of the property with access through a shared driveway.<\/p>\n

“As such, the demand for car parking spaces would outstrip its supply, particularly during the change over time when there could be up to four staff at the property at one time.<\/p>\n

“Where vehicle users cannot park within the boundary of the appeal site, this will lead to the parking of vehicles on street or elsewhere in the shard rear driveway area.<\/p>\n

“The rear parking area would therefore be a cause for concern and would result in causing an obstruction.<\/p>\n
