SAN ANTONIO – A 13-year-old boy charged with manslaughter in the shooting death of of his 8-year-old brother has been released into his grandmother’s custody under strict conditions, a judge ruled on Tuesday.
The deadly shooting happened around 4:30 p.m. on July 25 at a home near the intersection of Bob Billa Street and Wales Avenue.

The boy, whose name has not been released because he is a minor, was arrested after police said he accidentally fired a gun that killed Daniel Casares.
Casares was struck in the neck and later pronounced dead.

Investigators believe the 13-year-old was handling the firearm when it discharged. He was taken into custody and charged with manslaughter.
Under the court’s order, the boy will remain with his grandmother while awaiting further proceedings. Conditions of his release include mandatory counseling, random drug testing, and a home-and-school curfew, meaning he must be either at school or at home at all times.
He is also barred from having any access to guns or ammunition, prohibited from contacting witnesses to the shooting except his siblings, and must maintain consistent school attendance without unexcused absences.
