A man whose San Ysidro home flooded with nearly three dozen animals inside — most of which have since been adopted into other homes — was banned by a judge Monday from owning animals for 10 years.
The Aug. 27, 2024, flooding of a Shooting Star Drive residence prompted the rescues of 30 dogs, one cat and two chickens, according to the San Diego Humane Society. The homeowner, Gary Marks, was later arrested, at which point another dog was taken into the Humane Society’s care.
Eight of the dogs that were recovered “were in such poor condition that they had to be humanely euthanized to prevent further suffering,” while some of the other animals also received emergency veterinary care, according to the Humane Society.
Animal-cruelty charges were filed against Marks, and Monday’s restrictions comprised his sentence.
Along with the prohibitions against animal ownership, Marks must allow law enforcement to search his home without a warrant and he will receive mandatory mental health treatment.
“This case is heartbreaking — and no animal should ever endure such living conditions,” San Diego Humane Society Chief of Humane Law Enforcement Jace Huggins said in a statement. “Neglect has consequences, and we are committed to ensuring every animal in our community is safe, cared for and given the chance to live a healthy life.”
