GALESBURG, Ill. (KWQC) -The Mary Davis Home will have to go back to the drawing board with their mental health plan. On Tuesday, a federal judge ruled their revised mental health plan didn’t address the concerns brought forward by the ACLU of Illinois.
The ACLU brought the lawsuit in 2024 over what they called illegal solitary confinement and a lack of mental health treatment that even included kids being denied care when they were suicide watch according to testimony.
A preliminary injunction required the facility to end its confinement practices and draft a new mental health plan. While the facility submitted a plan, the ACLU called it out for being a near copy of old policies with minimal change.
The Mary Davis Home claimed it adjusted policy and had logs which proved any confinement they had over the last few months was legal, but a judge didn’t think their policy changes went far enough.
The Mary Davis Home will three weeks to submit a new mental health plan. The two sides will meet for a decision on the new policy draft on February 25.
