The Los Angeles County District Attorney’s Office declined Tuesday to file a case involving the stabbing death of a man during an argument in Griffith Park over the weekend.

The District Attorney’s Office cited “insufficient evidence” against Royce Rainey.

Officers responded about 2:30 a.m. Saturday to a report of a possible stabbing near the 3200 block of Riverside Drive, where they found 48-year-old Richard Ware with stab wounds, according to the Los Angeles Police Department.

Los Angeles Fire Department paramedics pronounced Ware dead at the scene, police said.

“After gathering witness statements, officers detained 36-year-old Royce Rainey while conducting a search of the nearby area,” according to an LAPD statement.

Homicide detectives believe Rainey and Ware got into an argument that escalated into a fight, resulting in Ware being stabbed, police said.

He had remained behind bars since his arrest about 7 a.m. Saturday. There was no immediate word on whether he had been released.
