Investigators said Marx was spotted near the Washington Monument, near the intersection of 15th Street and Madison Drive NW, on Monday with what appeared to be a gun concealed on his person.

At the same time, the Vice President’s motorcade was also passing through the area of 15th Street and Independence Avenue SW.

According to the release, uniformed Secret Service officers approached Marx as he was near the path of the motorcade. Officers said they told Marx to stop, but he ran along Independence Avenue.

Eventually, investigators said Marx pulled out a Sig Sauer P365 handgun and opened fire on the Secret Service officers, hitting a bystander, a juvenile, behind the officers in the leg.

The Secret Service returned fire, hitting Marx in the hand, left arm and body, according to the release.

“We will prove this defendant carried an illegal firearm into the heart of Washington, D.C., opened fire at Secret Service officers near a crowded intersection, and shot an innocent bystander who was simply crossing the street with his family,” Pirro said in a statement.

Marx was identified by his driver’s license, according to investigators. As he was being taken to the hospital, Marx was heard saying “(expletive) the White House” and “Kill me,” according to the news release.

Marx is facing charges of assaulting federal officers with a dangerous weapon, using and discharging a firearm during a crime of violence and unlawful possession of a firearm by a convicted felon.
