NEW YORK (TNND) — Harvey Weinstein’s rape retrial in New York ended in a mistrial on Friday after jurors were unable to reach a unanimous verdict following deliberations.

The deadlock leaves the disgraced former Hollywood producer facing continued uncertainty on the rape charge, despite already being convicted in separate sex crimes cases.
The Manhattan jury had been considering allegations that Weinstein raped Jessica Mann, a hairstylist and aspiring actor, in a Manhattan hotel room in 2013.

In a statement, Mann said the mistrial “doesn’t in any way detract from the truth I told.”
“I deserve justice, which is why I stand up and face unbearable public scrutiny in the name of a greater good,” she said.

Prosecutors argued Weinstein used his power and influence in the entertainment industry to manipulate and sexually assault women, while Weinstein’s attorneys maintained the encounter with Mann was consensual and part of a complicated personal relationship.
His defense team argued that communications and continued contact between Mann and Weinstein after the alleged assault undermined the prosecution’s case.
Weinstein, 74, appeared in court in a wheelchair during much of the retrial due to ongoing health issues. He remains incarcerated due to his previous convictions.
The retrial came after New York’s highest court overturned Weinstein’s landmark 2020 rape conviction in April 2024. The court ruled that the original trial judge improperly allowed testimony from women whose allegations were not directly tied to the criminal charges Weinstein faced, determining the testimony unfairly prejudiced the jury.
Weinstein has denied all allegations of nonconsensual sex. He has said he was unfaithful to his then-wife and “acted wrongly, but I never assaulted anyone.”
A hearing was set for June 24 to learn whether prosecutors will choose to go to a fourth trial.
