Nexus executive to undergo mental health treatment, delaying trial

HARRISONBURG, Va. (WHSV) – Former Nexus executive Richard Moore appeared in the Western District of Virginia federal courthouse on Monday for a sentencing hearing.

Prior to the hearing, the defense made a motion to continue, or postpone, the sentencing for 90 days while Moore seeks treatment at a mental health facility.

This motion was denied by Judge Elizabeth Dillon, stating that there were concerns with the motion coming last minute and that there was no evidence provided from a physician or health care professional to affirm he is unable to attend the sentencing. Dillon also stated that Moore had time to seek treatment since the last scheduled sentencing date in May.

Another motion was made to order a hearing to determine the mental competency of the defendant. In the courtroom, Moore took the stand to discuss his struggles with mental health and how he had tried to seek treatment, but insurance issues made it difficult.

Judge Dillon granted the motion for competency and amended the conditions of release. The sentencing hearing was continued generally. Judge Dillon said Moore will remain at the mental health facility to finish the program or report to a federal facility.

In the agreement, Moore and his counsel must also provide weekly updates regarding the anticipated discharge. If Moore is discharged before reporting to the designated federal facility, the court will hold a hearing regarding any needed modifications to his release conditions.
