SAN ANTONIO – The trial resumes today for three former San Antonio Police officers charged in the shooting death of Melissa Perez.
The incident occurred in June 2023, when officers were called to Perez’ apartment for a reported disturbance. According to court documents, Perez, who suffered from schizophrenia, refused to come out when officers attempted to speak with her.
As police knocked on her door and tried to make contact, she approached holding a hammer. The situation escalated, and several officers opened fire, striking Perez.
Prosecutors said none of the 15 officers on the scene considered obtaining a warrant to enter her home.
“So Miss Perez, she had windows open, screens open, lights on, and yes, eventually she sat on her living room couch and the officers could see her and they engaged,” said prosecutor Daryl Harris.
“Others behind them would have done it too if they were on the front,” said defense attorney Jason Gross. “As she was coming and three officers, with a hammer just like that, they had a right to go home.”
Sgt. Alfred Flores and Officer Eleazor Alejandro are charged with murder. Officer Nathaniel Villalobos faces a charge of aggravated assault with a deadly weapon by a public servant.
All three officers have pleaded not guilty.
