BANGOR, Maine (WKRC) – Police arrested a 50-year-old man who allegedly broke into an apartment, unwrapped Christmas presents and then fell asleep on the couch.

Jose Harvey allegedly refused to leave after the tenant woke up Sunday, Nov. 23, and found him sleeping on their couch, according to PEOPLE. The tenant called the police around 8:40 a.m.

When officers arrived, Harvey was unable to provide a logical explanation for why he was in the apartment, according to PEOPLE. The tenant told police the doors had been locked but the bathroom window was open.

Harvey was arrested and charged with aggravated criminal trespass.
