No charges for Mesa High admins accused of mandatory reporting failures

PHOENIX (AZFamily) — City prosecutors have chosen not to file charges for two Mesa High School administrators accused of failing to report a gun on campus during a February 2025 incident.

According to the law firm representing Principal Kirk Thomas and Athletic Director David Klecka, the Mesa City Prosecutor’s Office informed them the case was “turned down,” meaning no charges would be sought in the case.

“Although no specific reason was given for the ‘turn down,’ it usually occurs when there is insufficient evidence of unlawful conduct and there is no likelihood of a conviction,” explained criminal defense attorney Robert P. Jarvis, who said Thomas and Klecka were “elated to hear” that nothing illegal was done.

On Jan. 12, the Mesa Public Schools Governing Board voted 4-1 to not renew the contracts of either administrator. However, the action was considered non-disciplinary and not a termination.

Arizona’s Family previously reported that the lawyers representing the administrators said changes to the mandatory reporting law didn’t go into effect until after the fight, and claimed there wasn’t a substantiated threat of a gun on campus.

Eric Beaumont, a former Mesa High School security guard, claimed Klecka told him not to call the police. The next day, Beaumont said he called a fellow security guard, and both contacted the Mesa High School resource officer. He said he lost his job because of it.
