Albany, NY (WRGB) — On January 21st, Judge Jeffrey Pearlman ruled New York’s 11th Congressional District unconstitutional, ordering the State’s Independent Redistricting Commission to reconvene to draw a new map, with a deadline set on February 6th, 2026.

But, with hours left until the map is due, the Independent Redistricting Commission says they have no meeting scheduled this week.

Following the Pearlman decision, Republican Rep. Nicole Malliotakis (NY-11) filed an emergency appeal in two New York appellate courts, so the IRC says they are under stay, pending that appeal.

Malliotakis is the only Republican to represent New York City in the House of Representatives.

CBS6 spoke with Jeff Wice, Professor at New York Law School, after the initial decision, and he says it’s unclear what will happen if the IRC doesn’t produce a map by the deadline, and that the ruling prevented the current map from being used.

Petitioning for potential Congressional candidates is scheduled to begin on February 24th.
