{"id":1003059,"date":"2026-08-15T20:33:34","date_gmt":"2026-08-15T20:33:34","guid":{"rendered":"https:\/\/www.europesays.com\/us\/1003059\/"},"modified":"2026-08-15T20:33:34","modified_gmt":"2026-08-15T20:33:34","slug":"1-rubber-ring-in-breathalyzer-could-put-thousands-of-florida-dui-cases-in-jeopardy-2","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/1003059\/","title":{"rendered":"$1 rubber ring in breathalyzer could put thousands of Florida DUI cases in jeopardy"},"content":{"rendered":"<p class=\"c-paragraph\">JACKSONVILLE, Fla. \u2014 A $1 piece of rubber could potentially unravel thousands of DUI cases across Florida and hundreds in Jacksonville.<\/p>\n<p class=\"c-paragraph\">Action News Jax\u2019s Ben Becker has learned a landmark legal battle in Duval County this week may have handed one driver a major victory and put the integrity of breathalyzer testing in Florida under scrutiny.<\/p>\n<p><a href=\"https:\/\/www.actionnewsjax.com\/live-breaking\/\" rel=\"nofollow noopener\" title=\"https:\/\/www.actionnewsjax.com\/live-breaking\/\" target=\"_blank\"><b>&gt;&gt;&gt; STREAM ACTION NEWS JAX LIVE &lt;&lt;&lt;<\/b><\/a><b>DUI arrest leads to legal challenge<\/b><\/p>\n<p class=\"c-paragraph\">In 2025, Sergio Rosario Cruz Lopez was arrested for DUI on Beach Boulevard and failed a breathalyzer test.<\/p>\n<p class=\"c-paragraph\">Jacksonville Attorney David Robbins\u2019 law firm represents Cruz Lopez.<\/p>\n<p class=\"c-paragraph\">\u201cThis is not a blank check for people to drink too much and drive,\u201d Robbins said. \u201cThis technology goes back to when Apple [iPhone] 5 was introduced in this country, it\u2019s way outdated.\u201d<\/p>\n<p><b>The O-Ring at the center of the case<\/b><\/p>\n<p class=\"c-paragraph\">Inside the breathalyzer machine called the Intoxilyzer 8000 that is used by law enforcement agencies throughout Florida and the country, sits a small component: a basic rubber O-ring, <\/p>\n<p class=\"c-paragraph\">According to testimony in court, the Florida Department of Law Enforcement admitted that it only replaces four out of the five O-rings when it performs what it considers annual maintenance &#8211; one inside and four outside. <\/p>\n<p class=\"c-paragraph\"><b>[SIGN UP: <\/b><a href=\"https:\/\/membercenter.actionnewsjax.com\/newsletters\/\" target=\"_blank\" title=\"\" rel=\"nofollow noopener\"><b>Action News Jax Daily Headlines Newsletter<\/b><\/a><b>] <\/b><\/p>\n<p class=\"c-paragraph\">Also, the Jacksonville Sheriff\u2019s Office conceded it replaced O-rings, but never kept records when O-rings were replaced and disclosed it could impact the machine\u2019s accuracy.<\/p>\n<p class=\"c-paragraph\">The state acknowledged that neither FDLE nor JSO were authorized repair facilities. <\/p>\n<p class=\"c-paragraph\">Robbins successfully argued to a three-judge panel that replacing the O-rings is considered a repair and it constituted an unauthorized fix under state guidelines, which require repairs to go to authorized third-party facilities.<\/p>\n<p style=\"margin: 12px auto 6px auto; font-family: Helvetica,Arial,Sans-serif; font-size: 14px; line-height: normal; display: block;\"> <a title=\"View Order Granting MTS &amp; Amended MTS on Scribd\" href=\"https:\/\/www.scribd.com\/document\/1073609106\/Order-Granting-MTS-Amended-MTS#from_embed\" style=\"color: #098642; text-decoration: underline;\" rel=\"nofollow noopener\" target=\"_blank\"> Order Granting MTS &amp; Amended MTS <\/a> by <a title=\"View ActionNewsJax&#039;s profile on Scribd\" href=\"https:\/\/www.scribd.com\/user\/493303259\/ActionNewsJax#from_embed\" style=\"color: #098642; text-decoration: underline;\" rel=\"nofollow noopener\" target=\"_blank\"> ActionNewsJax <\/a> <\/p>\n<p class=\"c-paragraph\"><b>[DOWNLOAD: <\/b><a href=\"https:\/\/www.actionnewsjax.com\/mobile-apps\/\" target=\"_blank\" title=\"\" rel=\"nofollow noopener\"><b>Free Action News Jax app for alerts as news breaks<\/b><\/a><b>]<\/b><\/p>\n<p class=\"c-paragraph\">\u201cDoes anyone have their oil replaced in their car and only replaces 80%? No, it doesn\u2019t work that way,\u201d he said.<\/p>\n<p class=\"c-paragraph\">The legal argument could have implications far beyond Lopez\u2019s case since this case covers all the machines in Florida versus previous Intoxilyzer 8000 lawsuits that only pertained to individual machines.<\/p>\n<p class=\"c-paragraph\">According to the Ticket Clinic, Florida averages nearly 45,000 DUI arrests per year. The state said there are more than 400 alcohol-related deaths annually.<\/p>\n<p><b>What happens to DUI cases?<\/b><\/p>\n<p class=\"c-paragraph\">Action News Jax reached out to FDLE, JSO, and the State Attorney\u2019s Office regarding the ruling and its potential impact but have not heard back.<\/p>\n<p class=\"c-paragraph\">For Robbins, the issue goes beyond one DUI case.<\/p>\n<p class=\"c-paragraph\">\u201cThe hard part about this is that people\u2019s lives are changed based on the accuracy of breath machines,\u201d Robbins said. \u201cProsecutors, judges, and police rely on these to put people in jail.
