“No decision has been made as of yet to file charges or not file charges,” Tooson said. “In terms of what charges they’re considering or not considering, they indicated they’re looking at anything and everything.”<\/p>\n
Family members said they have received some information about the investigation but remain frustrated by what they view as a lack of clarity surrounding the case.<\/p>\n
“We are getting bits and pieces,” Porter’s relative, Emanuel Armstrong, said. “And we feel like, regarding the timeline, we are not getting what we’d like to have.”<\/p>\n
The shooting occurred<\/a>\u00a0in the 17000 block of Roscoe Boulevard in Northridge around 10:30 p.m. on Dec. 31, the Los Angeles Police Department said. A department spokesperson told KTLA at the time that the report which came into dispatch was that a man was firing rifle rounds into the air.\u00a0When officers arrived at the apartment complex where the call came from, they discovered a Porter suffering from gunshot wounds. He was pronounced dead at the scene.<\/p>\n According to the Department of Homeland Security, Palacios heard celebratory gunfire near his apartment and went outside to investigate.<\/p>\n DHS said Palacios encountered Porter holding a rifle and ordered him to put the weapon down. When Porter allegedly failed to comply, Palacios fired his service weapon in self-defense, killing him.<\/p>\n Former DHS Assistant Secretary Tricia McLaughlin released a statement shortly after the incident, characterizing the shooting as an “active shooter situation” at the federal officer’s apartment complex.<\/p>\n “In order to protect his life and that of others, he was forced to defensively use his weapon and exchange gunfire with the shooter,” McLaughlin said at the time. “Fortunately, our brave officer was not injured while protecting his community.”<\/p>\n Off-duty federal agent involved in fatal L.A. Keith was shot three times,” Tooson said. “What that tells us is there were no additional shots fired. So the only three shots were from the shooter himself. We don’t believe this narrative of self-defense.”<\/p>\n The family said Hochman told them his office is continuing to investigate the shooting and is seeking additional witnesses.<\/p>\n<\/a><\/p>\n
