(Gary Rivett: ABC News)<\/p>\n<p class=\"paragraph_paragraph___QITb\"><a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2025-12-05\/adult-time-for-violent-crime-prison-children-bill-parliament\/106101956\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/106101956\" rel=\"nofollow noopener\" target=\"_blank\">The controversial laws, passed in response to rising youth crime, force children charged with serious offences such as aggravated carjacking to face adult courts<\/a> which can impose the same penalties as for offenders aged 18 and over.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The tougher regime has been backed by some victims&#8217; advocates, but was criticised by legal groups and the Victorian Equal Opportunity and Human Rights Commission.<\/p>\n<p>Teen walks free due to &#8216;exceptional circumstances&#8217;<\/p>\n<p class=\"paragraph_paragraph___QITb\">For adults, the minimum sentence for aggravated carjacking is three years&#8217; jail.<\/p>\n<p class=\"paragraph_paragraph___QITb\">On Wednesday, County Court judge Scott Johns used his discretion to sentence the girl to an 18-month youth supervision order, letting her walk free.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;You haven&#8217;t had a lot of opportunities in your young life. This is one,&#8221; Judge Johns told the girl.<\/p>\n<blockquote class=\"EmphasisedText_quote__TE6kn\"><p>&#8220;I hope I don&#8217;t see you back here. If you don&#8217;t abide by the conditions of the order then I will, and I will have to look at significant consequences.&#8221;<\/p><\/blockquote>\n<p class=\"paragraph_paragraph___QITb\">Conditions of the order include drug counselling, mental health treatment, attending school, TAFE or work, offender behaviour programs, community work and a curfew.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Judge Johns described the carjacking as &#8220;very serious&#8221; and the victim as a &#8220;vulnerable, unsuspecting target&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">He acknowledged parliament&#8217;s intent for youth aggravated carjackings to be dealt with more severely than under the rules of the Children&#8217;s Court, where the maximum penalty is three years in detention.<\/p>\n<p class=\"paragraph_paragraph___QITb\">However, he said, the law also allowed him to consider if &#8220;exceptional circumstances&#8221; applied and whether youth sentencing legislation could be used.<\/p>\n<p><img decoding=\"async\" alt=\"The outside of the County Court of Victoria building.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2026\/08\/579182d06a4661c13e42cb6917b250bb.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Judge Johns said a range of factors, including the incident being a first-time offence and a lack of family stability contributed to his ruling.
