{"id":1026279,"date":"2026-08-26T23:41:15","date_gmt":"2026-08-26T23:41:15","guid":{"rendered":"https:\/\/www.europesays.com\/us\/1026279\/"},"modified":"2026-08-26T23:41:15","modified_gmt":"2026-08-26T23:41:15","slug":"judge-rejects-musks-x-lawsuit-over-new-york-hate-speech-law","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/1026279\/","title":{"rendered":"Judge rejects Musk&#8217;s X lawsuit over New York hate speech law"},"content":{"rendered":"<p>A US judge on Wednesday dismissed a lawsuit by <a href=\"https:\/\/www.jpost.com\/business-and-innovation\/tech-and-start-ups\/article-900463\" target=\"_blank\" rel=\"nofollow noopener\">Elon Musk&#8217;s<\/a> X\/Twitter seeking to void a New York state law requiring social media companies to disclose how they monitor hate speech, extremism, harassment, foreign political interference and disinformation.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">US District Judge John Cronan in Manhattan rejected X&#8217;s argument that the Stop Hiding Hate Act violated the US Constitution&#8217;s First Amendment by exposing it to lawsuits and big fines unless it disclosed &#8220;highly sensitive and controversial speech&#8221; that the state found objectionable.<\/p>\n<p>The judge said requiring X to report &#8220;purely factual and uncontroversial information&#8221; about its content moderation policies was reasonably related to New York&#8217;s interest in letting people make informed choices about <a href=\"https:\/\/www.jpost.com\/international\/article-906680\" target=\"_blank\" rel=\"nofollow noopener\">using social media.<\/a><\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">&#8220;Businesses always exercise their discretion, judgment, and opinions when deciding what goods or services to offer,&#8221; Cronan wrote. &#8220;Burger King chooses to generally offer higher-calorie items than, say, Sweetgreen, but the disclosure of calorie information remains purely factual. So too here.&#8221;<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">The dismissal is with prejudice, meaning X cannot amend its complaint.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">X, formerly Twitter, is part of Musk&#8217;s rocket and satellite company SpaceX. Neither lawyers for X nor SpaceX immediately responded to requests for comment.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">The office of New York Attorney General Letitia James defended the law. It did not immediately respond to similar requests for comment.<\/p>\n<p>Signed in December 2024 by <a href=\"https:\/\/www.jpost.com\/diaspora\/antisemitism\/article-906267\" target=\"_blank\" rel=\"nofollow noopener\">Governor Kathy Hochul<\/a>, the New York law required social media companies with at least $100 million of annual revenue to disclose how they eliminate hate on their platforms, and report their progress.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">Civil fines can reach $15,000 per violation per day. The law was written with help from the Anti-Defamation League.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">In seeking a dismissal, James said the law helped consumers understand what to expect from social media, without blocking platforms from speaking out or exercising judgment when moderating content.<\/p>\n<p>Musk scrapped Twitter&#8217;s content moderation policy after he bought that company in 2022.
