{"id":102699,"date":"2025-07-29T18:10:13","date_gmt":"2025-07-29T18:10:13","guid":{"rendered":"https:\/\/www.europesays.com\/us\/102699\/"},"modified":"2025-07-29T18:10:13","modified_gmt":"2025-07-29T18:10:13","slug":"epa-moves-to-repeal-landmark-finding-that-allows-climate-regulation","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/102699\/","title":{"rendered":"EPA moves to repeal landmark finding that allows climate regulation"},"content":{"rendered":"<p class=\"EkqkG IGXmU nlgHS yuUao MvWXB TjIXL aGjvy ebVHC \">WASHINGTON &#8212; President Donald Trump&#8217;s administration on Tuesday proposed revoking a scientific finding that has long been the central basis for U.S. action to regulate greenhouse gas emissions and fight <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/climate-and-environment\" target=\"_blank\" rel=\"noopener\">climate change<\/a>.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The proposed <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/hub\/us-environmental-protection-agency\" target=\"_blank\" rel=\"noopener\">Environmental Protection Agency<\/a> rule rescinds a 2009 declaration that determined that carbon dioxide and other greenhouse gases endanger public health and welfare.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The \u201cendangerment finding\u201d is the legal underpinning of a host of climate regulations under the Clean Air Act for motor vehicles, power plants and other pollution sources that are heating the planet.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \"><a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/trump-cabinet-zeldin-epa-climate-change-9f0def092a907deb5209c2b9ac14a81d\" target=\"_blank\" rel=\"noopener\">EPA Administrator Lee Zeldin<\/a> called for a rewrite of the endangerment finding in March as part of <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/trump-epa-climate-zeldin-power-plants-feb184286a7a9419aefddce293362e6b\" target=\"_blank\" rel=\"noopener\">a series of environmental rollbacks<\/a> announced at the same time in what Zeldin said was &#8220;the greatest day of deregulation in American history.&#8221; A total of <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/epa-zeldin-deregulation-plans-list-actions-5fb7fc1d24f54f193d585643c8fba79f\" target=\"_blank\" rel=\"noopener\">31 key environmental rules<\/a> on topics from clean air to clean water and climate change would be rolled back or repealed under Zeldin&#8217;s plan.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">He singled out the endangerment finding as \u201cthe Holy Grail of the climate change religion\u201d and said he was thrilled to end it \u201cas the EPA does its part to usher in the Golden Age of American success.&#8221;<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The EPA also called for rescinding limits on tailpipe emissions that were designed to encourage automakers to build and sell more <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/hub\/electric-vehicles\" target=\"_blank\" rel=\"noopener\">electric vehicles<\/a>. The transportation sector is the largest source of greenhouse gas emissions in the United States.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Three former EPA leaders have criticized Zeldin, saying his March proposal would endanger the lives of millions of Americans and abandon the agency\u2019s dual mission to protect the environment and human health.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cIf there\u2019s an endangerment finding to be found anywhere, it should be found on this administration because what they\u2019re doing is so contrary to what the Environmental Protection Agency is about,\u201d Christine Todd Whitman, who led EPA under Republican President George W. Bush, said after Zeldin&#8217;s plan was made public. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The EPA proposal follows <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/unleashing-american-energy\/\" target=\"_blank\" rel=\"noopener\">an executive order<\/a> from Trump that directed the agency to submit a report \u201con the legality and continuing applicability\u201d of the endangerment finding.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Conservatives and some congressional Republicans hailed the initial plan, calling it a way to undo economically damaging rules to regulate greenhouse gases.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">But environmental groups, legal experts and Democrats said any attempt to repeal or roll back the endangerment finding would be an uphill task with slim chance of success. The finding came two years after a 2007 Supreme Court ruling holding that the EPA has authority to regulate greenhouse gases as air pollutants under the Clean Air Act.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">David Doniger, a climate expert at the Natural Resources Defense Council, an environmental group, said it was virtually \u201cimpossible to think that the EPA could develop a contradictory finding (to the 2009 standard) that would stand up in court.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Doniger and other critics accused Trump&#8217;s Republican administration of using potential repeal of the endangerment finding as a \u201ckill shot\u2019\u2019 that would allow him to make all climate regulations invalid.
