The union representing New York City public school paraprofessionals is stepping into a high-profile legal battle<\/a> to defend a City Council bill authorizing one-time, $10,000 \u201cworkforce stabilization\u201d payments to the aides who assist high-need students, according to new court filings.<\/p>\n

The United Federation of Teachers (UFT)<\/a>, the powerful labor union representing nearly 200,000 of New York City\u2019s educators, filed a motion on Aug. 25 to intervene in a lawsuit that Mayor Zohran Mamdani filed last week<\/a> asking a judge to block the legislation, known as the RESPECT Check Act.<\/p>\n

\u201cThe UFT seeks to intervene in this action so that it can present arguments in defense of the RESPECT Check Act and thereby protect the interests of the paraprofessionals who stand to benefit from the workforce stabilization payment,\u201d the UFT\u2019s motion said.<\/p>\n

Mayor Mamdani\u2019s administration sued the Council over the freshly enacted bill a few hours after it lapsed into law last week without the mayor\u2019s signature. The administration argued in its suit that the legislation violated a preexisting state law governing public sector collective bargaining agreements, known as the Taylor Law.<\/p>\n

\u201cIndeed, the bill ignores nearly 60 years of well-established collective bargaining process under the Taylor Law \u2014 which requires that public employers and unions negotiate in good faith on mandatory subjects of bargaining, such as compensation,\u201d the administration\u2019s complaint said.<\/p>\n

City Hall did not immediately respond to a request for comment on this story. Union officials told amNewYork they could not comment on ongoing lawsuits or negotiations.\n<\/p>\n

The City Council had passed the bill with an overwhelming majority of 49-0, with two members absent, back in July<\/a>. Mamdani could have exercised mayoral veto power over the RESPECT Check Act, but the Council would have likely been overridden anyway. Instead, the mayor neither signed nor vetoed the bill, which under the city charter automatically became law 30 days after its passage.\u00a0<\/p>\n

Under the current collective bargaining agreement, an entry-level paraprofessional at a NYC Public School has a starting salary of around $33,000 in 2026, according to UFT figures. City Council members, educators and union leaders say the pay is far too low, and has led to droves of qualified paraprofessionals leaving the workforce for better-paying jobs.<\/p>\n

The end result, they argue, has been high paraprofessional vacancy rates within the DOE and systemic failures to provide legally mandated services to students with Individualized Education Programs (IEP).\u00a0<\/p>\n

Mamdani has said that while he supports higher pay for paraprofessionals, the collective bargaining process must be respected. But in July, City Council Speaker Julie Menin cast doubt on the mayor\u2019s willingness to act in good faith, saying that he had been a less-than-willing partner in solving the crisis through either the budget process or the collective bargaining process.\u00a0<\/p>\n
