{"id":1035608,"date":"2026-08-31T20:57:17","date_gmt":"2026-08-31T20:57:17","guid":{"rendered":"https:\/\/www.europesays.com\/us\/1035608\/"},"modified":"2026-08-31T20:57:17","modified_gmt":"2026-08-31T20:57:17","slug":"la-county-sues-state-farm-alleging-mishandling-of-wildfire-survivor-claims","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/1035608\/","title":{"rendered":"LA County Sues State Farm, Alleging Mishandling of Wildfire Survivor Claims"},"content":{"rendered":"<p>Following similar action by the state, Los Angeles County filed a lawsuit Monday against State Farm insurance company, alleging widespread mishandling of claims by policyholders in the Eaton and Palisades fire burn zones.<\/p>\n<p>\u201cWildfire survivors have spent far too long fighting to receive the benefits they paid for and counted on,\u201d county Supervisor Kathryn Barger said at a downtown news conference announcing the legal action. \u201c\u2026 Survivors have reported deep delays in processing claims and payments, repeated changes in adjustments, sometimes up to 10 to 15, underpayments and partial payments, inconsistent handling of additional living expenses and serious problems with smoke damage claims.<\/p>\n<p>\u201cThis is unacceptable,\u201d she said.<\/p>\n<p>The Los Angeles Superior Court lawsuit specifically alleges that State Farm violated California\u2019s unfair competition and false advertising laws in the handling of Eaton and Palisades fire survivors, according to County Counsel Dawyn Harrison.<\/p>\n<p>\u201cThe lawsuit alleges that State Farm engaged in unfair, unlawful and deceptive business practices that harm their policyholders,\u201d Harrison said. \u201cThe lawsuit seeks injunctive relief to stop State Farm from these unfair and unlawful practices and fulfill their promises to their policyholders. The lawsuit also seeks restitution for policyholders, civil penalties and abatement for alleged ongoing health hazards associated with inadequate testing and remediation.\u201d<\/p>\n<p>State Farm officials did not immediately respond to a request for comment. In May, when the insurer was sued by the state Department of Insurance over similar allegations, the company denied any wrongdoing.<\/p>\n<p>\u201cWe reject any suggestion that State Farm engaged in a general practice of mishandling or intentionally underpaying wildfire claims, and we will respond through the process \u2026,\u201d according to a statement from State Farm at the time. \u201cWildfire survivors deserve real solutions \u2014 not a distorted picture of State Farm\u2019s response.\u201d<\/p>\n<p>The state lawsuit could potentially lead to State Farm temporarily losing its license to operate in California.<\/p>\n<p>\u201cThe threat to suspend State Farm General\u2019s ability to serve customers over primarily administrative and procedural errors is a reckless, politically motivated attack that could ultimately cripple California\u2019s homeowners insurance market,\u201d State Farm said in its statement responding to the state lawsuit.<\/p>\n<p>The state\u2019s lawsuit seeks millions of dollars in penalties against State Farm. The county lawsuit, meanwhile, more specifically seeks financial restitution for fire victims.<\/p>\n<p>County Supervisor Lindsey Horvath said fire survivors \u201cshould not have to fight the insurance company to rebuild their lives.\u201d<\/p>\n<p>\u201cThese families did their part,\u201d she said. \u201cThey paid their premiums month and month, year after year. They trusted that if the worst happened, the protection they paid for would be there. And then the worst happened. Instead of certainty, too many survivors have been left waiting for an answer, for an adjuster, for a fair payment, for the resources they need to rebuild.\u201d<\/p>\n<p>According to State Farm\u2019s website, the company has handled 13,700 claims from the Los Angeles wildfires, and made more than $6 billion in payments.
