(AP) \u2014 The Missouri Supreme Court has unanimously blocked new congressional districts backed by President Donald Trump from being used in the November election and ordered a statewide vote on whether to uphold or reject the new map. <\/p>\n<p>The decision Thursday marks a rare setback for Republicans in a national <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/redistricting\" rel=\"nofollow noopener\" target=\"_blank\">redistricting<\/a> battle. Republicans had hoped Missouri\u2019s <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/redistricting-gerrymander-trump-missouri-936e8daecadb32556fcfbd2eb9f7457b\" rel=\"nofollow noopener\" target=\"_blank\">new congressional boundaries<\/a> could help them win an additional seat and hold onto their slim House majority in the midterms.<\/p>\n<p>Missouri Attorney General Catherine Hanaway, a Republican, said she would immediately appeal to the U.S. Supreme Court, asserting that the decision \u201chas thrust our state into a full\u2011fledged constitutional crisis.\u201d <\/p>\n<p>Missouri\u2019s new districts were used in <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/missouri-election-2026-primary-5226443026ad3b9a3e9a5979abb910a9\" rel=\"nofollow noopener\" target=\"_blank\">the August primaries<\/a>. But the state Supreme Court said they cannot be used in the November general election \u2014 or ever again, unless voters first uphold the new districts passed by the Republican-led Legislature. <\/p>\n<p>The court ruled that the new districts were effectively placed on hold in December, when opponents submitted over <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/missouri-redistricting-referendum-trump-gerrymandering-utah-14312a112b6e32d15e5ef36b83cdc6a7\" rel=\"nofollow noopener\" target=\"_blank\">300,000 petition signatures<\/a> seeking to put the map to a vote of the people. Republican <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/redistricting-congress-missouri-trump-petition-vote-election-5cfa5294a987388f38e0960e3368d320\" rel=\"nofollow noopener\" target=\"_blank\">Secretary of State Denny Hoskins<\/a> waited until primary election day in August to reject the petition. He asserted that the referendum process cannot be used for congressional redistricting. A <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/redistricting-congress-missouri-trump-gerrymandering-45b51672b78081dc7609e763a0416534\" rel=\"nofollow noopener\" target=\"_blank\">lower court agreed<\/a>, but the Supreme Court overturned Hoskins\u2019 decision. <\/p>\n<p>\u201cThe referendum petition was legal, sufficient, and timely, and the secretary incorrectly concluded otherwise,\u201d the court said in its ruling. The legislation containing the new districts \u201cdid not go into effect and will not go into effect unless and until approved by the voters.\u201d As a result, the congressional map adopted after the 2020 census \u201cremains in full force and effect for the November 2026 general election.\u201d<\/p>\n<p>Hanaway, whose office represented Hoskins, called the ruling an unprecedented violation of federal law.<\/p>\n<p>\u201cNever before in American history has a court overturned a congressional map after a primary and before a general election,\u201d Hanaway said in a statement. <\/p>\n<p>The Missouri Constitution does not specifically say a referendum petition can be used for a congressional redistricting law passed by the Legislature. But the Supreme Court ruled that a constitutional provision allowing a referendum on \u201cany act\u201d of the Legislature encompasses congressional redistricting. It rejected assertions from Hanaway\u2019s office that federal law prohibits referendum petitions on congressional redistricting.<\/p>\n<p>The ruling, which capped a year of political maneuvering and legal wrangling, was one of two to go against Republican officials Thursday. The Supreme Court also ruled that Hoskins had wrongly <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/citizen-initiatives-ballot-measures-missouri-354c3f0c24aece3f12d273267bda48db\" rel=\"nofollow noopener\" target=\"_blank\">rejected a petition<\/a> for a ballot proposal making it difficult for politicians to change measures enacted by voters through <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/ballot-initiatives-sick-leave-minimum-wage-abortion-c4dbda039d63cc121b662f9b7ee7e522\" rel=\"nofollow noopener\" target=\"_blank\">citizen initiatives<\/a>. Mike Kehoe called lawmakers into a special session last year to dramatically reconfigure the 5th Congressional District, held by Democrat Emanuel Cleaver.<\/p>\n<p><a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/redistricting-gerrymander-missouri-trump-e5b75246cbee8eb674dfdb27381cc8ac\" rel=\"nofollow noopener\" target=\"_blank\">Cleaver<\/a>, who was unopposed in the August primary, has carried the Kansas City-based district with at least 60% of the vote in each of the past two elections. <\/p>\n<p>Republican state Sen. Rick Brattin won an August primary in the reshaped 5th Congressional District, which had been stretched eastward to include rural Republican areas. About 59% of the district\u2019s voters were new under the revised map, according to an Associated Press estimate.<\/p>\n<p>Cleaver had not posted campaign signs in many of the new rural areas, explaining that he was waiting for the Missouri Supreme Court\u2019s decision. But he had vowed to continue his reelection campaign regardless of the outcome. <\/p>\n<p>\u201cWe\u2019re going to run, and we\u2019re going to run hard, no matter where we are,\u201d Cleaver said last month at the Missouri State Fairgrounds in Sedalia, which had been added to the revised 5th District. <\/p>\n<p>Brattin, a Marine veteran and founding member of the conservative Missouri Freedom Caucus in the state Legislature, had questioned whether Cleaver could represent a wider district. <\/p>\n<p>\u201cI think his whole campaign strategy was hoping that the courts would do his bidding for him. I don\u2019t think that he represents Missouri values,\u201d Brattin had said at the State Fair. <\/p>\n<p>Redistricting battle spread to over a quarter of states<\/p>\n<p>Congressional districts typically are redrawn at the start of each decade, based on new census data. But Trump\u2019s quest for a midterm election advantage triggered an unusual mid-decade redistricting battle that spread to more than a dozen states \u2014 and triggered a dozen lawsuits in Missouri alone. All told, Republicans had hoped to net as many as 10 additional seats nationally. <\/p>\n<p>The Missouri Supreme Court ruling was one of only a few nationally to go against Republicans\u2019 redistricting plans.<\/p>\n<p>Prior to its latest ruling, Missouri\u2019s top court already had rejected claims that the special session was illegal, <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/redistricting-gerrymandering-congress-missouri-trump-f89090b920ce7047e9da3c1cb9ab9699\" rel=\"nofollow noopener\" target=\"_blank\">mid-decade redistricting<\/a> isn\u2019t allowed and the new <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/redistricting-congress-voting-rights-trump-1ed6f8c68884b372efca79fbb50e343a\" rel=\"nofollow noopener\" target=\"_blank\">districts aren\u2019t compact enough<\/a>.<\/p>\n<p>The group People Not Politicians spearheaded the referendum petition. <\/p>\n<p>A couple hundred people chanted \u201cLet us vote!\u201d while rallying Wednesday outside the state Supreme Court. Grant Christensen, of Jefferson City, said he had signed the referendum petition to put the map to a vote.<\/p>\n<p>\u201cGerrymandering is the same as voter suppression,\u201d Christensen said. \u201cCutting up districts in order to steer them to vote one way or the other is not fair.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"JEFFERSON CITY, Mo.
