{"id":1044415,"date":"2026-09-05T06:31:35","date_gmt":"2026-09-05T06:31:35","guid":{"rendered":"https:\/\/www.europesays.com\/us\/1044415\/"},"modified":"2026-09-05T06:31:35","modified_gmt":"2026-09-05T06:31:35","slug":"judge-wont-block-pentagon-from-firing-stars-and-stripes-staffers","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/1044415\/","title":{"rendered":"Judge won&#8217;t block Pentagon from firing Stars and Stripes staffers"},"content":{"rendered":"<p>WASHINGTON (AP) \u2014 A federal judge <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.295983\/gov.uscourts.dcd.295983.22.0_1.pdf\" target=\"_blank\" rel=\"noopener nofollow\">refused Friday<\/a> to block the Pentagon from firing three Stars and Stripes staff members who claim they were illegally disciplined for speaking out about the military news outlet\u2019s need to maintain its editorial independence.<\/p>\n<p>U.S. District Judge Trevor McFadden, who was nominated to the bench by Republican President Donald Trump. ruled that the journalists are unlikely to successfully prove that the Pentagon violated their First Amendment free speech rights. He said Stars and Stripes\u2019 editorial independence \u201cis not at stake here.\u201d<\/p>\n<p>\u201cPlaintiffs argue that their termination will chill the protected expression of themselves and others at Stripes,\u201d McFadden wrote. \u201cPlaintiffs have failed to demonstrate a chill here.\u201d<\/p>\n<p>Stars and Stripes publisher Max Lederer, editor-in-chief Erik Slavin and Middle East reporter Lara Korte <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.295983\/gov.uscourts.dcd.295983.1.0_1.pdf\" target=\"_blank\" rel=\"noopener nofollow\">sued last Thursday<\/a> in Washington, D.C., to challenge their firings by the Pentagon, which partially funds the news outlet.<\/p>\n<p>Slavin says he was dismissed for insubordination after giving an interview to CBS News in which he objected to potential censorship by the U.S. military. Korte participated in the same interview. Their lawsuit says they were punished in retaliation for publishing a report on deteriorating conditions aboard the <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/thailand-us-aircraft-carrier-lincoln-port-visit-3f144724cdd0661561fe1f93447aef42\" rel=\"nofollow noopener\" target=\"_blank\">U.S.S. Abraham Lincoln<\/a>.<\/p>\n<p>McFadden, however, concluded that Slavin and Korte gave the interviews as part of their official duties as public employees and not as private citizens.<\/p>\n<p>\u201cThey are being fired for giving pre-approved interviews on their paper\u2019s behalf in which they largely toed the company line. Whatever else such a scheme may violate, it does not clearly offend the First Amendment,\u201d the judge wrote.<\/p>\n<p>Lederer was dismissed shortly after announcing his impending retirement. He said the Pentagon had installed a new deputy publisher \u2014 an active-duty service member \u2014 under him at the newspaper without his knowledge.<\/p>\n<p>    <a class=\"AnchorLink\" id=\"html-embed-module-0b0000\"\/><\/p>\n<p>\n    <strong>Sign up for the Ground Game Newsletter:<\/strong><br \/>\n    Your guide to the biggest stories in politics, policy and U.S. elections.\n  <\/p>\n<p>The Defense Department and Defense Secretary Pete Hegseth are among the lawsuit\u2019s named defendants.<\/p>\n<p>The suit\u2019s plaintiffs are represented by attorneys from Democracy Defenders Fund, Lawyers for Good Government, Government Accountability Project and a Yale Law School clinic.<\/p>\n<p>Democracy Defenders Fund attorney Taryn Wilgus Null said the judge\u2019s decision emphasizes the \u201chigh burden\u201d that plaintiffs have in seeking preliminary injunction, as the plaintiffs did in this case. She noted that the ruling wasn\u2019t the final word in the litigation.<\/p>\n<p>\u201cWhile we are disappointed in the decision, we fully expect to prevail after we have an opportunity to take discovery and all the facts are revealed,\u201d Null said in a statement.<\/p>\n<p>McFadden also has presided over <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-ap-media-court-white-house-events-access-f346a0efe87c1dec4d6f90e6041abd09\" rel=\"nofollow noopener\" target=\"_blank\">The Associated Press\u2019 lawsuit<\/a> accusing the Trump administration of retaliating against the AP for its decision not to follow the president\u2019s <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-gulf-of-mexico-bc438f4feca1234475a1adef99344da7\" rel=\"nofollow noopener\" target=\"_blank\">executive order to rename the Gulf of Mexico.<\/a> McFadden last year ordered the White House to restore the AP\u2019s full access to cover presidential events, affirming on First Amendment grounds that the government cannot punish the news organization for the content of its speech.
