Two neighbors\u2019 war over it may not be. \u2013 San Diego Union-Tribune"},"content":{"rendered":"<p>The two-year battle over a controversial backyard apartment in Crown Point escalated to a new level this week, with two visits by San Diego police, accusations of trespassing and new threats of litigation.<\/p>\n<p>The source of the controversy is a <a href=\"https:\/\/www.sandiegouniontribune.com\/2024\/05\/05\/the-coastal-zoning-loophole-pitting-neighbor-against-neighbor\/\" rel=\"nofollow noopener\" target=\"_blank\">zoning loophole<\/a> that has pitted neighbor against neighbor in coastal communities by allowing backyard apartments \u2014 also called accessory dwelling units, or ADUs \u2014 to be built directly along property lines.<\/p>\n<p><img decoding=\"async\" class=\" lazyautosizes lazyload\" alt=\"A worker squeezes between a fence and a wall to finish painting an ADU on Tuesday, July 29, 2025 in San Diego. (Ana Ramirez \/ The San Diego Union-Tribune)<\/p>\n<p>In Crown Point, Heidi Martin and her family have been unable to paint the last wall of their new ADU because it\u2019s right on the property line and neighbor Marc Umemoto has <a href=\"https:\/\/www.sandiegouniontribune.com\/2024\/11\/23\/the-loophole-for-coastal-adus-is-officially-closed-that-hasnt-ended-these-neighbors-war-over-one\/\" rel=\"nofollow noopener\" target=\"_blank\">repeatedly<\/a> refused to let them use his yard to finish it.<\/p>\n<p>Umemoto blames the city for allowing an ADU to be built so close to his property that it walls off his yard, keeping sunlight and breezes out and changing the character of his home just a few blocks from Mission Bay.<\/p>\n<p>And he blames Martin for taking advantage of that rule.<\/p>\n<p>After many months of failed negotiations between the neighbors, the contractor for Martin took the unusual step Monday of trying to paint the final wall from Martin\u2019s property using a long pole with a roller attached.<\/p>\n<p>When the painter lost his balance and stepped onto Umemoto\u2019s property around 10 a.m., Umemoto called the police and accused the contractor of trespassing.<\/p>\n<p>The officers who arrived refused to make an arrest or issue a citation, both neighbors say.<\/p>\n<p>When the painter again lost his balance just after noon, Umemoto again called the police. Different officers arrived, and they too left without arresting or ticketing anyone.<\/p>\n<p>\u201cI had a long discussion with the police, and they won\u2019t do anything unless they witness it themselves,\u201d Umemoto said Tuesday. \u201cAnd it\u2019s not a severe enough trespassing for them to be cited.\u201d<\/p>\n<p>To Umemoto, this policy should be a warning to all San Diego residents that it\u2019s essentially useless to put up \u201cno trespassing\u201d signs or install cameras \u2014 which he did shortly after the Martins began construction of the ADU.<\/p>\n<p>\u201cIt\u2019s kind of a waste of time,\u201d he said.<\/p>\n<p><img decoding=\"async\" class=\" lazyautosizes lazyload\" alt=\"A worker squeezes between a fence and a wall to finish painting an ADU on Tuesday, July 29, 2025 in San Diego. (Ana Ramirez \/ The San Diego Union-Tribune)<\/p>\n<p>But to Martin, this week is yet another regrettable chapter in an unfortunate dispute that she says has unfairly portrayed her as some sort of neighborhood enemy.<\/p>\n<p>She has repeatedly pointed out that her family is building only one ADU \u2014 nothing like the large <a href=\"https:\/\/www.sandiegouniontribune.com\/2025\/07\/18\/affordable-housing-savior-or-neighborhood-destroyer-meet-the-developer-behind-san-diegos-biggest-adu-projects\/\" rel=\"nofollow noopener\" target=\"_blank\">ADU developments<\/a> that have generated so much controversy \u2014 and that they are not investors buying up properties for ADUs.<\/p>\n<p>\u201cThe guys should be done painting by tomorrow, and I hope it\u2019s over after that,\u201d Martin said. \u201cIt\u2019s just been a mess.\u201d<\/p>\n<p>She said the police, quite reasonably, told the painters to be safe and not focus so intently on avoiding Umemoto\u2019s property that they injure themselves.<\/p>\n<p>\u201cWe\u2019re not doing anything wrong \u2014 we just want the wall painted,\u201d she said.<\/p>\n<p>Martin noted that she had to abandon a longtime plan to stucco the final wall because Umemoto wouldn\u2019t allow it. Instead, they are using elastomeric waterproof paint to cover the final wall\u2019s yellow gypsum-based sheathing board.<\/p>\n<p>She said her lawyers made multiple offers to Umemoto to get his permission to use his yard for just one day so they could finish the ADU.<\/p>\n<p><img decoding=\"async\" class=\" lazyautosizes lazyload\" alt=\"A worker finishes painting an ADU on Tuesday, July 29, 2025 in San Diego. (Ana Ramirez \/ The San Diego Union-Tribune)<\/p>\n<p>Umemoto confirms such offers were made but said they got bogged down by liability release forms, other red tape and his frustration with the Martin\u2019s arguments.<\/p>\n<p>\u201cIt may have been a good solution, but their reasoning for it was unacceptable,\u201d he said.<\/p>\n<p>Umemoto said he considered going to court to block the painting but decided it was probably too late. He\u2019s still considering suing for damages.<\/p>\n<p>The City Council outlawed building backyard apartments on property lines in April 2022, but the new rule couldn\u2019t take effect in the city\u2019s coastal neighborhoods without a second approval from the California Coastal Commission.<\/p>\n<p>That approval wasn\u2019t finalized until last September \u2014 nearly two and a half years after the city\u2019s move.
