While most commercial spaces have air conditioning, several residential buildings do not. But that is about to change.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Now, every landlord is required to provide and maintain working air conditioning in every unit.<\/p>\n<p><img loading=\"lazy\" data-recalc-dims=\"1\" decoding=\"async\" width=\"233\" height=\"263\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2026\/09\/Alejandra-Salinas-2.jpg\" alt=\"\" class=\"wp-image-206259\" style=\"width:320px;height:auto\"  \/><\/p>\n<p class=\"wp-block-paragraph\">The decision came after Council Member Alejandra Salinas proposed a Right to Air Conditioning ordinance. She framed the measure as a basic health-and-safety fix.<\/p>\n<p class=\"wp-block-paragraph\">\u201cHouston made clear that no renter should be left to endure dangerous indoor heat without reliable cooling,\u201d Salinas said. \u201cThis is a commonsense health and safety habitability standard that will protect seniors, children, people with disabilities, and working families across our city.\u201d<\/p>\n<p class=\"wp-block-paragraph\">While <a href=\"https:\/\/statutes.capitol.texas.gov\/?tab=1&amp;code=PR&amp;chapter=PR.92&amp;artSec=92.052\" rel=\"nofollow noopener\" target=\"_blank\">the Texas Penal Code requires<\/a> landlords to repair damaged air conditioning units that affect tenants\u2019 health, it does not require landlords to provide ACs if they did not have them previously. In addition to mandating cooling, the ordinance closes a loophole that previously allowed property owners to avoid installing ACs entirely if the unit had a window screen.<\/p>\n<p class=\"wp-block-paragraph\">The code includes units in which landlords have agreed to provide heating or cooling in the lease, the equipment in the unit produces \u201cinadequate\u201d heat or cooled air, and they have been informed that the lack of heating or cooling impacts the \u201chealth or safety\u201d of a tenant.<\/p>\n<p><strong>What does the ordinance change?<\/strong><\/p>\n<p class=\"wp-block-paragraph\" id=\"h-the-new-language-in-the-ordinance-strikes-the-exemption-that-only-requires-landlords-to-provide-functional-acs-and-maintain-them-at-an-indoor-temperature-20-f-below-the-outside-temperature-or-no-higher-than-80-f\">The new language in the ordinance strikes the exemption that only requires landlords to provide functional ACs and maintain them at an indoor temperature 20\u00b0F below the outside temperature, or no higher than 80\u00b0F.<\/p>\n<p class=\"wp-block-paragraph\" id=\"h-under-the-new-rule-landlords-will-have-120-days-to-comply-up-from-the-originally-proposed-90-days-and-will-be-required-to-make-reasonable-and-continuous-progress-toward-providing-and-maintaining-refrigerated-air-equipment-nbsp\">Under the new rule, landlords will have 120 days to comply, up from the originally proposed 90 days, and will be required to make \u201creasonable and continuous progress toward providing and maintaining refrigerated air equipment.\u201d\u00a0<\/p>\n<p class=\"wp-block-paragraph\" id=\"h-per-city-documents-retrofitting-older-buildings-with-central-air-conditioning-will-not-be-required-window-units-and-portable-units-will-satisfy-the-standards-in-the-ordinance\">Per city documents, retrofitting older buildings with central air conditioning will not be required. Window units and portable units will satisfy the standards in the ordinance.<\/p>\n<p><strong>How many people are impacted?<\/strong><\/p>\n<p class=\"wp-block-paragraph\">Per U.S. Census data, 22,485 households in Harris County have no air conditioning.<\/p>\n<p class=\"wp-block-paragraph\">In 2023, Houston experienced multiple days of record-breaking heat, including the highest temperature of 109\u00b0F. Approximately <a href=\"https:\/\/www.census.gov\/programs-surveys\/ahs\/data\/interactive\/ahstablecreator.html?s_areas=26420&amp;s_year=2023&amp;s_tablename=TABLE3&amp;s_bygroup1=1&amp;s_bygroup2=1&amp;s_filtergroup1=3&amp;s_filtergroup2=1&amp;s_show=SO&amp;tablename=TABLE3&amp;areas=26420&amp;filtergroup1=02\" rel=\"nofollow noopener\" target=\"_blank\">20,400 households<\/a> in Houston lack air conditioning, according to 2023 Census Bureau data.<\/p>\n<p class=\"wp-block-paragraph\">According to the ordinance, landlords would be required to provide a window screen or an interior temperature of 89\u00b0F if air conditioning is required.<\/p>\n<p class=\"wp-block-paragraph\">Since April 1, 2026, there have been <a href=\"https:\/\/www.houstonhealth.org\/data-dashboards\/houston-summer-surveillance-heat-related-illness-hri-heat-exacerbated-health-monitoring\" rel=\"nofollow noopener\" target=\"_blank\">2,745 heat-related illness<\/a> emergency visits in the Harris, Fort Bend, and Montgomery County region. Between 2019 and 2023, more than 7,600 such cases have been reported. The item material also notes at least 279 heat-related deaths statewide in 2022.<\/p>\n<p class=\"wp-block-paragraph\">Out of them, <a href=\"https:\/\/www.houstonhealth.org\/data-dashboards\/houston-summer-surveillance-heat-related-illness-hri-heat-exacerbated-health-monitoring\" rel=\"nofollow noopener\" target=\"_blank\">714 are Black people<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">\u201cExtreme heat and limited access to air conditioning disproportionately impact Black and Latino<\/p>\n<p class=\"wp-block-paragraph\">neighborhoods, where residents are more likely to face higher heat exposure, fewer cooling<\/p>\n<p class=\"wp-block-paragraph\">resources, and greater health risks when rental housing lacks adequate cooling,\u201d the ordinance states.<\/p>\n<p class=\"wp-block-paragraph\">Salinas, whose office is also giving away free ACs this summer, told the Defender that the largest number of applications have come from Black and brown communities, particularly.<\/p>\n<p class=\"wp-block-paragraph\">Regarding affordability, the ordinance\u2019s backup material notes that \u201can affordability review conducted by the Austin Housing Department determined that its air conditioning requirement would have a neutral impact on affordable housing.\u201d And that Dallas, Denton, and Austin have adopted similar requirements with \u201cno documented rent increases tied to the adoption of these air conditioning requirements.\u201d<\/p>\n<p><strong>Dissent on the dais<\/strong><\/p>\n<p class=\"wp-block-paragraph\">Not every member was convinced.<\/p>\n<p class=\"wp-block-paragraph\">Council member Fred Flickinger argued the ordinance addresses \u201ca symptom of a problem rather than the actual problem,\u201d pointing to a specific property he\u2019d visited, an $800-a-month complex without air conditioning near another charging $1,379 with it, and predicted that \u201crents will absolutely increase\u201d as landlords upgrade to compete, potentially pushing some owners to sell to developers instead.<\/p>\n<p class=\"wp-block-paragraph\">\u201cPeople are gonna end up homeless,\u201d Flickinger said.<\/p>\n<p><img loading=\"lazy\" data-recalc-dims=\"1\" decoding=\"async\" width=\"150\" height=\"150\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2026\/09\/carter150.jpg\" alt=\"\" class=\"wp-image-206258\" style=\"width:252px;height:auto\"  \/><\/p>\n<p class=\"wp-block-paragraph\">Speaking from personal experience of housing instability, council member Twila Carter warned that \u201cthis is an unfunded mandate\u2026 with no meaningful guardrails for the tenants,\u201d and that pass-through utility costs would fall hardest on the very families the ordinance wants to help.<\/p>\n<p class=\"wp-block-paragraph\">\u201cA policy designed to help working families shouldn\u2019t unintentionally make housing costs less affordable, make housing less affordable cost higher, and place financial burdens on already burdened citizens, the very people that we are intending to protect,\u201d Carter said. \u201cThey pay with their hard-earned dollars.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Salinas countered that no landlords or trade groups had shown up to oppose the measure.<\/p>\n<p class=\"wp-block-paragraph\">The AC measure passed with two recorded no votes from Carter and Flickinger.
