{"id":107290,"date":"2025-07-31T10:21:12","date_gmt":"2025-07-31T10:21:12","guid":{"rendered":"https:\/\/www.europesays.com\/us\/107290\/"},"modified":"2025-07-31T10:21:12","modified_gmt":"2025-07-31T10:21:12","slug":"this-is-the-court-case-that-could-kneecap-most-trump-tariffs","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/107290\/","title":{"rendered":"This is the court case that could kneecap most Trump tariffs"},"content":{"rendered":"<p dir=\"ltr\">Most of the tariffs that U.S. President Donald Trump has imposed on countries around the world face a crucial legal test on Thursday.\u00a0<\/p>\n<p dir=\"ltr\">The hearing before the U.S. Court of Appeal for the Federal Circuit\u00a0involves a pair of lawsuits challenging the 25 per cent tariff Trump <a href=\"https:\/\/www.cbc.ca\/news\/politics\/trump-tariff-march-4-1.7469928\" rel=\"nofollow noopener\" target=\"_blank\">levied on imports from Canada and Mexico<\/a> in March\u00a0and what Trump called his &#8220;Liberation Day&#8221; tariffs, <a href=\"https:\/\/www.cbc.ca\/news\/politics\/trump-tariffs-canada-1.7500316\" rel=\"nofollow noopener\" target=\"_blank\">imposed on nearly every other country<\/a> in April.\u00a0<\/p>\n<p dir=\"ltr\">At issue is whether Trump&#8217;s justifications for the tariffs hold any legal water, given the president has limited powers to levy duties on foreign countries.\u00a0<\/p>\n<p dir=\"ltr\">Canada is watching the case closely because of its implications for the tariffs Trump imposed ostensibly to combat cross-border fentanyl trafficking \u2014\u00a0tariffs that he&#8217;s <a href=\"https:\/\/www.cbc.ca\/news\/politics\/carney-trade-negotiations-intense-1.7595401\" rel=\"nofollow noopener\" target=\"_blank\">threatening to raise<\/a> to 35 per cent on Friday.\u00a0<\/p>\n<p dir=\"ltr\">Todd Tucker, director of industrial policy and trade at the Roosevelt Institute, a Washington think-tank, says the legal challenge to Trump&#8217;s tariffs has global economic implications.\u00a0<\/p>\n<p dir=\"ltr\">&#8220;Trump is disrupting global trade relations in a way that we haven&#8217;t seen since the 1930s,&#8221; Tucker said in an interview with CBC News.<\/p>\n<p><strong>WATCH | Carney on European Union&#8217;s trade deal with U.S.:<\/strong><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/07\/1753957270_755_default.jpg\"  alt=\"\" class=\"thumbnail\" loading=\"lazy\"\/><\/p>\n<p class=\"video-item-title\">Carney says Canada is \u2018in a different position\u2019 than EU on trade deal with U.S.<\/p>\n<p>When asked by a reporter if Canada could see a similar trade deal with the United States as the European Union&#8217;s, which includes a 15 per cent tariff, Prime Minister Mark Carney said Europe and Canada have different relationships with the U.S., particularly because the U.S. needs Canadian energy.<\/p>\n<p dir=\"ltr\">&#8220;Some kind of favourable, even partial victory for the plaintiffs in these cases will sort of put the global economy back on a more secure footing,&#8221; he\u00a0said.\u00a0\u00a0<\/p>\n<p dir=\"ltr\">The case, which has moved further through the courts than any other legal challenge of Trump&#8217;s tariffs, brings together two related lawsuits:<\/p>\n<p dir=\"ltr\">Both sets of plaintiffs <a href=\"https:\/\/www.cbc.ca\/news\/world\/trump-tariffs-trade-court-1.7546547\" rel=\"nofollow noopener\" target=\"_blank\">won their case<\/a>\u00a0at the U.S. Court of International Trade in late May.<\/p>\n<p dir=\"ltr\">That ruling found the president overstepped his authority under the International Emergency Economic Powers Act (IEEPA), the statute Trump used to impose both sets of tariffs.\u00a0<\/p>\n<p dir=\"ltr\">Oral arguments take place Thursday in the Trump administration&#8217;s appeal of that ruling\u00a0\u00a0<\/p>\n<p dir=\"ltr\">Jeffrey Schwab, senior counsel at Liberty Justice Center, a non-profit public interest litigation firm representing the five small businesses, says the case aims to rein in what he describes as presidential overreach.\u00a0<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" alt=\"Fentanyl that was seized last week is displayed before a news conference at RCMP headquarters, in Surrey, B.C., on Thursday, October 31, 2024. The RCMP says they have dismantled &quot;the largest and most sophisticated fentanyl and methamphetamine drug superlab in Canada,&quot; after an operation was conducted in Falkland, B.C., and Surrey beginning last Friday. \"   src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/07\/rcmp-bust-20241031.JPG\" style=\"aspect-ratio:1.4694894146948942\" data-cy=\"image-img\"\/>Trump imposed tariffs on Canada on the basis that the flow of fentanyl into the U.S. across the country&#8217;s northern border constitutes an &#8216;unusual and extraordinary threat.&#8217;  (Darryl Dyck\/The Canadian Press)<\/p>\n<p dir=\"ltr\">&#8220;The case is about whether the president has the power to unilaterally impose tariffs on any country he wants, at any rate he wants, at any time he wants, for any reason he wants,&#8221; said Schwab in an interview with CBC News.\u00a0<\/p>\n<p dir=\"ltr\">&#8220;Congress ultimately has that power under our constitution, and although Congress can delegate that power to the president, they have not done so.&#8221;<\/p>\n<p>Do tariffs &#8216;deal with&#8217; fentanyl crisis?<\/p>\n<p>The IEEPA gives the president the authority to use emergency economic measures to &#8220;deal with any unusual and extraordinary threat \u2026 to the national security, foreign policy, or economy of the United States.&#8221;<\/p>\n<p dir=\"ltr\">The Trump administration&#8217;s argument \u2014\u00a0both in his <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/imposing-duties-to-address-the-flow-of-illicit-drugs-across-our-national-border\/\" target=\"_blank\" rel=\"nofollow noopener\">executive order<\/a> levying the tariffs on Canada and in its <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cafc.23105\/gov.uscourts.cafc.23105.61.0.pdf\" target=\"_blank\" rel=\"nofollow noopener\">legal brief<\/a> filed for the appeal \u2014\u00a0is that the flow of fentanyl across the country&#8217;s northern border constitutes that &#8220;unusual and extraordinary threat.&#8221;<\/p>\n<p dir=\"ltr\">The administration claimed the tariffs &#8220;deal with&#8221; the fentanyl threat by giving the U.S. leverage to pressure Canada to address the issue.\u00a0<\/p>\n<p dir=\"ltr\">Trump&#8217;s justification for the <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/imposing-duties-to-address-the-situation-at-our-southern-border\/\" target=\"_blank\" rel=\"nofollow noopener\">tariffs on Mexico<\/a> is similar: that drug trafficking and illegal immigration across the southern border constitute an emergency, and that tariffs provide leverage to force the Mexican government to take action.\u00a0<\/p>\n<p dir=\"ltr\">But the Court of International Trade didn&#8217;t buy those arguments.\u00a0<\/p>\n<p><strong>WATCH |<\/strong>\u00a0<strong>Canada might not get deal on tariffs by deadline, says Trump:<\/strong><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/07\/1753957271_254_default.jpg\"  alt=\"\" class=\"thumbnail\" loading=\"lazy\"\/><\/p>\n<p class=\"video-item-title\">Trump says U.S. \u2018hasn\u2019t had a lot of luck with Canada\u2019 in trade talks<\/p>\n<p>As the Aug. 1 deadline for a trade deal between the U.S. and Canada draws near, U.S. President Donald Trump said Friday he may just impose tariffs rather than reach a deal.\u00a0&#8216;Pretty major national significance&#8217;<\/p>\n<p dir=\"ltr\">The court\u00a0<a href=\"https:\/\/www.cit.uscourts.gov\/sites\/cit\/files\/25-66.pdf\" target=\"_blank\" rel=\"nofollow noopener\">ruled<\/a> that the tariffs on Canada and Mexico do not actually deal with the specific threats Trump cited. It also ruled that the &#8220;Liberation Day&#8221; tariffs were applied too broadly across the globe to be truly addressing an emergency.<\/p>\n<p dir=\"ltr\">That ruling struck down both sets of tariffs, but almost immediately, the Trump administration <a href=\"https:\/\/www.cbc.ca\/news\/world\/trump-tariffs-appeal-court-ruling-1.7547404\" rel=\"nofollow noopener\" target=\"_blank\">requested and obtained a stay<\/a>, which meant the tariffs have continued to apply.<\/p>\n<p dir=\"ltr\">Molly Nixon, a Washington-based attorney at Pacific Legal Foundation, a national\u00a0public interest firm,\u00a0says whichever side wins the appeal, it&#8217;s very likely headed to the U.S. Supreme Court.<\/p>\n<p dir=\"ltr\">&#8220;This is a question of pretty major national significance,&#8221; Nixon\u00a0told CBC News.\u00a0&#8220;I would be very surprised if the Supreme Court didn&#8217;t review the case.&#8221;<\/p>\n<p dir=\"ltr\">No president before Trump has used the\u00a0IEEPA to impose tariffs.<\/p>\n<p dir=\"ltr\">His predecessors have used its powers to levy sanctions on enemy regimes, to ban transactions with groups that are\u00a0deemed terrorist organizations or to freeze the assets of designated transnational criminal organizations.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" alt=\"A man holds a gadget with wires\"   src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/07\/david-levi.jpg\" style=\"aspect-ratio:1.7404129793510323\" data-cy=\"image-img\"\/>Electrical engineer David Levi is the owner of MicroKits, a small business in Charlottesville, Va., that designs and sells make-them-yourself gadget kits and musical instruments. (CBC News)Small business owner &#8216;deeply invested&#8217; in case<\/p>\n<p dir=\"ltr\">While Canadians are predominantly interested in the case for its impact on the fentanyl tariffs, David Levi, an electrical engineer in Charlottesville, Va., is deeply invested in the &#8220;Liberation Day&#8221; side of the case.\u00a0<\/p>\n<p dir=\"ltr\">Levi\u00a0owns MicroKits, a small business that designs and sells make-them-yourself gadget kits and musical instruments.
