Now, just as he\u2019s about to enact a new round of tariffs, a federal appeals court could render them void.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqevx3500013b6nrt62kuq8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Oral arguments are scheduled Thursday for an appeal in a case alleging Trump overstepped his legal authority to impose many of his sweeping tariffs. Five small business owners and 12 Democratic states are arguing that Trump can\u2019t use a law known as the International Emergency Economic Powers Act of 1977 to enact those import duties.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqia3ea000c356nze8gjqph@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The US Court of International Trade <a href=\"https:\/\/www.cnn.com\/2025\/05\/28\/business\/us-court-blocks-trumps-tariffs\" rel=\"nofollow noopener\" target=\"_blank\">sided with those states and businesses in May<\/a> but the United States Court of Appeals for the Federal Circuit, which is taking on the case, allowed Trump\u2019s tariffs in question to <a href=\"https:\/\/www.cnn.com\/2025\/05\/29\/business\/appeals-court-pauses-trump-tariff-ruling\" rel=\"nofollow noopener\" target=\"_blank\">remain in place<\/a> while the case is being challenged.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqeo3gn00003b6nbj8146vp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It could take them weeks, or even months, to reach a decision. And the appeal could eventually make it to the Supreme Court as well.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqfnlyo000a3b6new2mvop9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But the federal appeals court\u2019s decision could still significantly reshape Trump\u2019s trade strategy \u2013 even as it won\u2019t stop Trump from imposing higher tariffs altogether.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqf6lun00053b6n96wyvwon@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump has cited IEEPA to impose country-specific tariffs. That includes the 10% universal tariffs that have been applied to most countries\u2019 exports to the United States since April as well as tariffs on China, Mexico and Canada aimed at curbing the flow of fentanyl and illegal immigrants to the United States.\n    <\/p>\n<p>       <img decoding=\"async\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/07\/gettyimages-2226853469.jpg\" alt=\"Containers are seen at the port in Qingdao, in China. President Donald Trump imposed tariffs as high as 145% in recent months on goods coming from China to the United States.\" class=\"image_large__dam-img image_large__dam-img--loading\" onload=\"this.classList.remove('image_large__dam-img--loading')\" onerror=\"imageLoadError(this)\" height=\"1333\" width=\"2000\" loading=\"lazy\"\/><\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqf3d9400033b6ni5knkabi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On Wednesday, he cited the law again to increase tariffs <a href=\"https:\/\/www.cnn.com\/2025\/07\/30\/politics\/brazil-tariff-trump-executive-order\" rel=\"nofollow noopener\" target=\"_blank\">on most Brazilian exports to the US by 40 percentage points to 50%<\/a>, and he\u2019s expected to do so again on Friday, the self-imposed deadline he set for trading partners to make trade agreements or face higher tariffs.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqfa0ew00083b6n1u331s21@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Even trading partners that reached trade agreements with Trump, including the European Union and Japan, are set to face higher tariffs compared to rates since April. The new rates they face are also being backed by Trump\u2019s use of IEEPA, which means if the court rules against him, the trade agreements he announced could face an uncertain fate.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqgzdds000x3b6n3pmtactd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Trump administration likely believes they can find other legal avenues to back those trade agreements, even if they lose the IEEPA fight in court, said Patrick Childress, international trade and disputes attorney at Holland &amp; Knight and former US Trade Representative attorney.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqg8ki2000f3b6n3x26bhsk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            And starting over on trade talks carries risks as well, said Brent Skorup, a legal fellow at the Cato Institute, a libertarian-leaning think tank that filed an amicus brief siding with the plaintiffs. \u201cI suspect most nations will not want to provoke the administration by reopening negotiations,\u201d he added.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqgivel000u3b6nfy6v8lss@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Economists at JPMorgan aren\u2019t as convinced.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqh5pxs00183b6nmtu3fmjk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIf the IEEPA is deemed inadmissible, the legal status of the trade deals themselves could come into question,\u201d they said in a note earlier this week.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqh4zdg00153b6n60npufal@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trump has made tariffs a centerpiece of his entire economic policy; don\u2019t expect that to stop any time soon.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqhhc4g001i3b6nprfhw78t@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But Trump hasn\u2019t just been using IEEPA to levy tariffs. All the sectoral tariffs Trump has imposed during his second term, most recently a <a href=\"https:\/\/www.cnn.com\/2025\/07\/30\/politics\/brazil-tariff-trump-executive-order\" rel=\"nofollow noopener\" target=\"_blank\">50% copper tariff<\/a>, have used Section 232 of the Trade Expansion Act of 1962.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqh5z33001b3b6ns30fmded@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            This gives the president the authority to impose higher tariffs on national security grounds. It can only be used to target specific sectors and requires an investigation to be launched before tariffs can be imposed.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmdqhgwqn001g3b6n9z066eyq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            There\u2019s also Section 301 of the Trade Act of 1974, which allows the US Trade Representative to investigate countries potentially violating other nations\u2019 trade agreements or practices in a way that is \u201cunjustifiable\u201d and \u201cburdens or restricts\u201d US business.
