{"id":113886,"date":"2025-08-02T20:46:10","date_gmt":"2025-08-02T20:46:10","guid":{"rendered":"https:\/\/www.europesays.com\/us\/113886\/"},"modified":"2025-08-02T20:46:10","modified_gmt":"2025-08-02T20:46:10","slug":"nycs-garden-of-hate-takes-case-to-federal-court-rips-judge-scurrilous-ny-post-coverage","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/113886\/","title":{"rendered":"NYC&#8217;s &#8216;Garden of Hate&#8217; takes case to federal court, rips judge, &#8216;scurrilous&#8217; NY Post coverage"},"content":{"rendered":"<p>The fight over a community garden in Queens is getting thornier.<\/p>\n<p>The attorney for the anti-Israel leaders of Sunset Community Garden in Ridgewood withdrew their state lawsuit against the city and the Parks Department \u2014 to make a federal case out of the issue.<\/p>\n<p>Since last fall, Jewish Ridgewood residents <a href=\"https:\/\/nypost.com\/2024\/09\/21\/us-news\/some-nyc-residents-feel-unwelcome-by-pro-palestinian-events-staged-at-community-garden\/\" target=\"_blank\" rel=\"noopener\">haven\u2019t felt welcome<\/a> at Sunset Community Garden, thanks to the garden group\u2019s pro-Palestinian rhetoric, which included a special section labeled \u201cPoppies for Palestine.\u201d<\/p>\n<p>Some local residents said they do not feel welcome in the community garden, whose leaders asked incoming members to pledge \u201csolidarity\u201d with the people of Palestine. Instagram @sunsetgardenridgewood<\/p>\n<p>Incoming members are also made to <a href=\"https:\/\/nypost.com\/2024\/09\/21\/us-news\/some-nyc-residents-feel-unwelcome-by-pro-palestinian-events-staged-at-community-garden\/\" target=\"_blank\" rel=\"noopener\">pledge \u201csolidarity with the oppressed and marginalized people\u201d of Palestine\u201d<\/a> by the garden\u2019s management. <\/p>\n<p>The Parks Department <a href=\"https:\/\/nypost.com\/2025\/05\/24\/us-news\/nyc-yanks-license-for-radical-queens-community-garden-that-forced-members-to-side-with-marginalized-palestinians\/\" target=\"_blank\" rel=\"noopener\">wanted the group out<\/a>\u00a0by June 6 for \u201cviolat[ing] the terms of their license\u201d with the \u201cunconstitutional wording\u201d of their \u201cideological litmus test\u201d for membership, according to court documents.<\/p>\n<p>The group responded with a state lawsuit in early June to block the eviction, and The Post was in the courtroom when attorneys for both sides <a href=\"https:\/\/nypost.com\/2025\/07\/19\/us-news\/resolution-to-sunset-community-garden-fight-in-works-irking-opponents\/\" target=\"_blank\" rel=\"noopener\">met in court this month<\/a>.<\/p>\n<p>But Jonathan Wallace, the garden leaders\u2019 attorney, withdrew the state lawsuit Monday, and told the city he plans to refile the case in federal court, a source said.<\/p>\n<p>In a letter this week, the lawyer accused Judge Hasa\u00a0Kingo of allowing the \u201cscurrilous\u201d New York Post\u2019s coverage to guide his rulings in court.<\/p>\n<p>\u201cThe plaintiffs in this case are a community group composed largely of trans people of color, many of whom are immigrants, and who share a powerfully-rooted moral opposition to the horrifying violence committed by a political entity, the nation-state Israel, against the people of Gaza,\u201d the letter read. <\/p>\n<p>Attorney Jonathan Wallace objected to coverage from The Post.  Michael Nagle<\/p>\n<p>The garden\u2019s leaders are fighting the city\u2019s efforts to oust them. Helayne Seidman<\/p>\n<p>\u201cWe could not be further from the ideals and goals stated by <a href=\"https:\/\/scholarship.law.vanderbilt.edu\/vlr\/vol10\/iss2\/6\/\" target=\"_blank\" rel=\"noopener\">Justices Holmes and Brandeis<\/a> when the Post appears to be influencing outcomes in judicial proceedings,\u201d he added.<\/p>\n<p>\u201cAs an old white, proudly Jewish attorney (something that in a 43-year career I never thought until now I would need to mention) I like and am content to be associated with\u201d the garden leaders, Wallace concluded in his letter to Kingo.<\/p>\n<p>Members planting in the garden in June 2024. Instagram @sunsetgardenridgewood<\/p>\n<p>Christina Wilkinson \u2014 a Ridgewood resident who worked to secure funding for the green space, but is now one of its most vocal critics \u2014 said the switch to federal court a \u201cstall tactic,\u201d and believes \u201cParks must now remove the violators and find a community partner that will make Sunset Garden an open and inclusive place for all.\u201d<\/p>\n<p>She added, \u201cYou have to love the irony of an attorney arguing that the City violated his clients\u2019 First Amendment rights, then turning around and complaining about [a Post reporter] being present in the courtroom.\u201d<\/p>\n<p>Wallace did not respond to multiple requests for comment.<\/p>\n<p>The Parks Department refused to respond to requests for comment.<\/p>\n","protected":false},"excerpt":{"rendered":"The fight over a community garden in Queens is getting thornier.
