According to documents obtained by Action News Jax Ben Becker, DCPS notified the OGC of the issue in June, and the OGC acknowledged the mistake. The Duval County School Board is scheduled to vote Tuesday on a pivotal resolution that would allow the district to hire its own in-house legal counsel &#8211; setting the stage to end a long-standing arrangement with the city\u2019s OGC.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">If the School Board approves the measure, it will move to City Council for consideration. The proposed change requires an amendment to the city charter, which would also need approval by the Florida Legislature &#8211; a process that could take up to a year.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">A source close to the situation tells Becker the change could potentially also be politically motivated, as General Counsel Fackler\u2019s office\u2019s interpretation of the law could be considered too progressive and not constitutionally focused.<\/p>\n<p><b>Background: What is the Office of General Counsel?<\/b><\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">The OGC is a powerful entity with 46 attorneys serving all branches of Jacksonville\u2019s consolidated government. Their clients include:<\/p>\n<ul>\n<li>The Mayor and 10 executive branch departments<\/li>\n<li>19 City Council members<\/li>\n<li>Duval County Public Schools (over 125,000 students)<\/li>\n<li>Five constitutional officers (including the Sheriff and Supervisor of Elections)<\/li>\n<li>Independent authorities such as JEA, the Aviation Authority, and the Port Authority<\/li>\n<li>Over 30 boards and commissions<\/li>\n<\/ul>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">The School Board, however, is the only public school system in the state of Florida that does not select its own legal counsel &#8211; a point that is driving momentum for change.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\"><b>[DOWNLOAD: <\/b><a href=\"https:\/\/www.actionnewsjax.com\/mobile-apps\/\" target=\"_blank\" title=\"\" rel=\"noopener\"><b>Free Action News Jax app for alerts as news breaks<\/b><\/a><b>]<\/b><\/p>\n<p><b>\u201cA Clear Message from DCPS\u201d<\/b><\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">City Council President Kevin Carrico weighed in on the development, calling it \u201ca clear message\u201d from the School Board and its supporters.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">\u201cI wouldn\u2019t go as far as saying that this dismantles the premise of the OGC\u2019s position in consolidated government. The unique characteristic of the school board is that the city council doesn\u2019t approve their budget.
