What have you done in particular with these two factories?<\/p>\n<p>\u201cWe\u2019re saying, if you say you\u2019re doing audits, and let us see the audits that you\u2019ve done on these companies &#8230; [Kmart has] not provided us with any of those documents. And so that\u2019s why we\u2019ve gone to court.\u201d<\/p>\n<p>Kmart\u2019s spokesperson said it was the first Australian retailer to provide a <a href=\"https:\/\/www.kmart.com.au\/factory-list\/\" rel=\"nofollow noopener\" target=\"_blank\">list of factories<\/a> it sourced from. The two contentious factories are Jiangsu Guotai Guosheng Co Ltd (Guotai) and Jiangsu Lianfa Textile Co Ltd (Lianfa), listed in Kmart\u2019s 2025 and 2024 factory lists respectively.<\/p>\n<p><img decoding=\"async\" alt=\"Kmart says suppliers in its ethical sourcing program is regularly monitored.\" loading=\"lazy\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/08\/89717cd5896bc7e2d638cb95099af956d8cc5f70.jpeg\" height=\"390\" width=\"584\" \/><\/p>\n<p>Kmart says suppliers in its ethical sourcing program is regularly monitored.Credit: iStock<\/p>\n<p>Kanis pointed to three main sources, including a <a href=\"https:\/\/acrobat.adobe.com\/id\/urn:aaid:sc:EU:5762d68e-92ab-4695-9c61-19b6050fc0eb\" rel=\"nofollow noopener\" target=\"_blank\">2021 paper<\/a> from Sheffield Hallam University, a March <a href=\"https:\/\/news.un.org\/en\/story\/2021\/03\/1088612\" rel=\"nofollow noopener\" target=\"_blank\">2021 letter<\/a> from a UN special rapporteur issued to Guotai, and a <a href=\"https:\/\/www.aspi.org.au\/report\/uyghurs-sale\/\" rel=\"nofollow noopener\" target=\"_blank\">2020 report<\/a> by the Australian Strategic Policy Institute that implicated the two companies in using forced labourers in the Uyghur region subjected to serious human rights abuses, such as arbitrary arrests and detention, mass surveillance, religious persecution and more.<\/p>\n<p>Loading<\/p>\n<p>\u201cWe\u2019re asking for any third-party audits, any audits, any reports of any non-compliance with their ethical sourcing code, any reports or documents saying that they may have suspended or terminated or taken any other remedial action against those producers, and then any information on factory visits or complaints,\u201d said Kanis.<\/p>\n<p>Supply chains can be convoluted, with one company selling to another and then to another, Kanis said, adding that there could be more than two implicated factories.<\/p>\n<p>\u201cOther countries have much stronger regulations in relation to forced labour, like the US and Canada,\u201d said Kanis. The law firm was open to settling the matter outside court if satisfactory documentation was provided, she said.<\/p>\n<p>\u201cIt shouldn\u2019t be left to our clients to take on companies like Kmart.
