SALT LAKE CITY \u2014 Utah\u2019s NHL team is going on the offensive, suing a hockey bag company in hopes of having the courts step in and resolve a trademark dispute.<\/p>\n
The Utah Mammoth hockey team filed the lawsuit this month against Mammoth Hockey LLC, sellers of \u201chigh-end hockey bags.\u201d<\/p>\n
According to the lawsuit filed in U.S. District Court, the hockey bag company supported the NHL team adopting the Mammoth name \u2014 which it did after gathering public input over the course of last season \u2014 \u201cand even approached [the team] about a possible collaboration.\u201d But in June, the bag company \u201creversed course,\u201d the lawsuit alleges, and claimed the NHL team\u2019s name violated trademark rights.<\/p>\n
The bag company has since threatened litigation in \u201csome unknown forum, at some unknown time,\u201d the lawsuit states.<\/p>\n
\u201cThe uncertainty created by [the bag company\u2019s] actions, which has persisted for months, with no action as of yet, has become intolerable,\u201d lawyers for the Utah Mammoth wrote in the lawsuit.<\/p>\n
The Mammoth and its owners, SEG Hockey, have asked the courts to settle the trademark issue under the U.S. Declaratory Judgement Act.<\/p>\n
