{"id":126659,"date":"2025-08-07T15:28:14","date_gmt":"2025-08-07T15:28:14","guid":{"rendered":"https:\/\/www.europesays.com\/us\/126659\/"},"modified":"2025-08-07T15:28:14","modified_gmt":"2025-08-07T15:28:14","slug":"toggenburg-ski-resort-ny-sale-in-progress-as-judge-pushes-for-reopening","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/126659\/","title":{"rendered":"Toggenburg Ski Resort, NY, Sale in Progress as Judge Pushes for Reopening"},"content":{"rendered":"<p>\t\t<img fetchpriority=\"high\" decoding=\"async\" class=\"size-full wp-image-41345 lazyload\" alt=\"Toggenburg Mountain, NY on January 26th, 2015. photo: toggenburg\" width=\"960\" height=\"505\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/08\/988467_870933576291460_1894750770377110051_n.jpg\"  data- data-eio-rwidth=\"960\" data-eio-rheight=\"505\"\/>The sale of Toggenburg Mountain is currently actualizing, with plans for the New York ski area to eventually reopen. \u00a0| Photo: toggenburg<\/p>\n<p data-start=\"239\" data-end=\"433\"><strong data-start=\"239\" data-end=\"433\">A deal is in the works to sell and potentially reopen the long-shuttered <a href=\"https:\/\/snowbrains.com\/toggenburg-ski-resort-ny-closes-after-nearly-70-years-of-operatoin2\/\" rel=\"nofollow noopener\" target=\"_blank\">Toggenburg Mountain ski resort<\/a> in Fabius, New York, after years of legal wrangling over its closure. <\/strong>According to reporting from <a href=\"https:\/\/www.syracuse.com\/business\/2025\/08\/deal-in-the-works-to-try-to-sell-reopen-toggenburg-ski-resort.html\" rel=\"nofollow noopener\" target=\"_blank\">Syracuse.com<\/a>, Intermountain Management (also known as SkiCNY.com) recently offered to sell the 100-acre ski area to local businessman Douglas Wheeler for $1.75 million, down from its original $1.995 million asking price.<\/p>\n<p data-start=\"685\" data-end=\"1181\"><strong>The development comes as New York State Supreme Court Justice Robert Antonacci II considers potential remedies following his April ruling that Intermountain violated the state\u2019s <a href=\"https:\/\/snowbrains.com\/judge-rules-central-new-york-ski-resort-owner-broke-antitrust-laws-by-shutting-down-rival\/\" rel=\"nofollow noopener\" target=\"_blank\">Donnelly Act<\/a> by purchasing Toggenburg in 2021 and then immediately closing it.<\/strong> The New York Attorney General\u2019s Office argued that the move gave Intermountain a monopoly on local season ski passes, pushing more skiers to its nearby resorts, Song and Labrador Mountains, and creating higher prices and longer lift lines.<\/p>\n<p data-start=\"1183\" data-end=\"1559\"><strong>While Intermountain is appealing the decision, Antonacci has signaled his strong preference for a swift sale and reopening of the ski area.<\/strong> \u201cI want Mr. Harris to try to settle this case by divesting,\u201d Antonacci said during a hearing on Wednesday, referring to Intermountain president Peter Harris. \u201cThe quicker that can be resolved, the better it\u2019s going to be for everybody.\u201d<\/p>\n<p data-start=\"1561\" data-end=\"1989\"><strong>Wheeler, a Fabius resident whose great-grandfather once owned the land where Toggenburg sits, has made several previous attempts to buy the mountain.<\/strong> During a trial earlier this summer, he testified that he plans to reopen the resort and relocate his other businesses\u2014such as sign manufacturing and auto repair\u2014to the site. However, he acknowledged that a reopening this winter would be unlikely due to logistical and financial hurdles.<\/p>\n<p data-start=\"1991\" data-end=\"2234\"><strong>His attorney, John Petosa, cautioned in court that several months and at least $2 million in investment would be required before the lifts could turn again, making it virtually impossible to reopen this coming winter.<\/strong> Justice Antonacci has not issued a formal order for the sale but indicated he will weigh Harris\u2019s cooperation in potential financial penalties.
