Gavin Newsom are set to face off Monday to determine whether the president violated a 147-year-old law when he <a href=\"https:\/\/www.cnn.com\/2025\/06\/10\/us\/who-are-los-angeles-protesters?cid=external-feeds_iluminar_yahoo\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:deployed the National Guard;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">deployed the National Guard<\/a> to quell protests over immigration raids in Los Angeles \u2013 against the wishes of the Democratic governor.<\/p>\n<p>In June, as hundreds of people gathered in Los Angeles to <a href=\"https:\/\/www.cnn.com\/2025\/07\/11\/us\/california-immigration-raids-la-wwk?cid=external-feeds_iluminar_yahoo\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:protest a string of immigration raids;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">protest a string of immigration raids<\/a> that targeted workplaces and left dozens of people detained or deported, the president federalized and deployed 4,000 National Guard members over the objection of Newsom and local officials, who said the deployment would only cause further chaos. Trump invoked <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/10\/12406\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:a rarely used law;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">a rarely used law<\/a> that allows the president to federalize the National Guard during times of actual or threatened rebellion or invasion, or when regular forces can\u2019t enforce US laws.<\/p>\n<p>The president\u2019s lawyers said in a court filing that the duties of the National Guard troops and a handful of Marines also dispatched were narrowly circumscribed: They were dispatched only to protect federal property and personnel, and they didn\u2019t engage in any law enforcement activities.<\/p>\n<p>Newsom filed a lawsuit June 9 against Trump and Defense Secretary Pete Hegseth, saying they violated <a href=\"https:\/\/www.cnn.com\/2025\/06\/10\/politics\/national-guard-los-angeles-trump-hegseth-newsom?cid=external-feeds_iluminar_yahoo\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:the Posse Comitatus Act;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">the Posse Comitatus Act<\/a> and the 10th Amendment. Trump\u2019s lawyers say the act, which prevents the use of the military for enforcing laws, doesn\u2019t provide a mechanism for a civil lawsuit.<\/p>\n<p><img decoding=\"async\" class=\"caas-img caas-lazy has-preview\" alt=\"President Donald Trump, followed by first lady Melania Trump, shakes hands with California Gov. Gavin Newsom after arriving at Los Angeles International Airport in Los Angeles on January 24 to visit the region devastated by the Palisades and Eaton fires. &#8211; Mandel Ngan\/AFP\/Getty Images<\/p>\n<p>But Newsom\u2019s lawyers have argued the president illegally made an \u201cunprecedented power grab\u201d \u2013 and even violated the Constitution \u2013 by overruling local authorities to send in the military.<\/p>\n<p>The president and Hegseth \u201chave overstepped the bounds of law and are intent on going as far as they can to use the military in unprecedented, unlawful ways,\u201d Newsom\u2019s lawyers say in a complaint.<\/p>\n<p>The trial represents a crucial moment for determining how much power a US president can lawfully exercise over the military on domestic soil. During his first term, Trump had often <a href=\"https:\/\/www.cnn.com\/2025\/06\/08\/politics\/trump-national-guard-decision?cid=external-feeds_iluminar_yahoo\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:speculated openly;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">speculated openly<\/a> about the possibility of deploying the military on American soil, whether to suppress protests or combat crime. Now he\u2019s talking about deploying the National Guard to the nation\u2019s capital over recent high-profile crimes.<\/p>\n<p>The trial also represents an escalation of the feud between Trump and Newsom, which saw the president <a href=\"https:\/\/www.cnn.com\/us\/live-news\/la-protests-ice-raids-trump-06-09-25#cmbpak4ad001f3b6ot88vwhr9?cid=external-feeds_iluminar_yahoo\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:threaten to have the Democratic governor;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">threaten to have the Democratic governor<\/a> arrested during the Los Angeles protests. Newsom described the comment as \u201can unmistakable step toward authoritarianism.\u201d<\/p>\n<p>The judge set to preside over the bench trial, Charles R. Breyer, previously granted a temporary restraining order against the Trump administration, <a href=\"https:\/\/www.cnn.com\/2025\/06\/12\/politics\/trump-national-guard-california-breyer?cid=external-feeds_iluminar_yahoo\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:ruling that the president unlawfully federalized;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">ruling that the president unlawfully federalized<\/a> the National Guard and that the protests didn\u2019t amount to an insurrection. But just hours later, an appeals court paused his ruling, allowing the deployment to continue.<\/p>\n<p>Here\u2019s more on what to know about the upcoming trial \u2013 and the three laws Newsom\u2019s team says Trump and Hegseth violated. The trial is taking place in San Francisco, presided over by Breyer, who sits on the US District Court for the Northern District of California, with proceedings scheduled from Monday to Wednesday.<\/p>\n<p>The Posse Comitatus Act<\/p>\n<p>At the center of the legal proceedings is the Posse Comitatus Act, which largely prevents the president from using the military as a domestic police force, <a href=\"https:\/\/www.brennancenter.org\/our-work\/research-reports\/posse-comitatus-act-explained\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:according to the Brennan Center for Justice;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">according to the Brennan Center for Justice<\/a>, an independent law and policy organization.<\/p>\n<p>\u201cPosse Comitatus\u201d is a Latin term used in American and British law to describe \u201ca group of people who are mobilized by the sheriff to suppress lawlessness in the county,\u201d according to the Brennan Center.<\/p>\n<p>The act, signed into law by President Rutherford B. Hayes in 1878, consists of <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/1385\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:just one sentence;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">just one sentence<\/a>: \u201cWhoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.\u201d<\/p>\n<p><img decoding=\"async\" class=\"caas-img caas-lazy has-preview\" alt=\"A man waves a Mexican flag as smoke and flames rise from a burning vehicle during a protest against federal immigration sweeps in downtown Los Angeles on June 8. - David Swanson\/Reuters\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/08\/354c5247818f8179f50c1279e4226c59.jpeg\"\/><\/p>\n<p>A man waves a Mexican flag as smoke and flames rise from a burning vehicle during a protest against federal immigration sweeps in downtown Los Angeles on June 8. &#8211; David Swanson\/Reuters<\/p>\n<p>Newsom\u2019s lawyers say the deployment of the National Guard to Los Angeles was a violation of the act since it bars \u201cthe military from engaging in civil law enforcement unless explicitly authorized by law,\u201d according to the complaint.<\/p>\n<p>But Trump\u2019s lawyers insist the National Guard and Marines didn\u2019t engage in any civil law enforcement \u2013 and therefore didn\u2019t violate the act<strong>.<\/strong><\/p>\n<p>Moreover, they say the act itself doesn\u2019t provide any mechanisms for its enforcement in a private civil lawsuit.<\/p>\n<p>The 10th Amendment<\/p>\n<p>Newsom\u2019s lawyers also argue that by overriding California officials, Trump violated the 10th Amendment of the Constitution, which governs the sharing of power between the federal government and the 50 states. The <a href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-10\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:amendment says;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">amendment says<\/a> \u201cthe powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.\u201d<\/p>\n<p>Trump and Hegseth\u2019s move to call up the National Guard against the governor\u2019s wishes \u201cinfringes on Governor Newsom\u2019s role as Commander-in-Chief of the California National Guard and violates the State\u2019s sovereign right to control and have available its National Guard in the absence of a lawful invocation of federal power,\u201d Newsom\u2019s complaint says.<\/p>\n<p>Policing and crime control are some of the most crucial uses of state power, Newsom\u2019s lawyers say.<\/p>\n<p>The Administrative Procedure Act<\/p>\n<p>Additionally, Newsom\u2019s lawyers argue Trump and Hegseth violated the Administrative Procedure Act, which says a court must \u201chold unlawful and set aside agency action\u201d that is \u201carbitrary, capricious, an abuse of discretion, or otherwise not in accordance with the law,\u201d that is \u201ccontrary to constitutional right (or) power,\u201d or that is \u201cin excess of statutory jurisdiction, authority, or limitations, or short of statutory right.\u201d<\/p>\n<p>Hegseth and the Department of Defense \u201clack authority to federalize members of the California National Guard without issuing such orders through Governor Newsom, who has not consented to their actions or been afforded the opportunity to consult on any deployment. Such agency actions are unauthorized, unprecedented, and not entitled to deference by this Court,\u201d reads the complaint.<\/p>\n<p>The obscure law Trump\u2019s lawyers cite<\/p>\n<p>Trump\u2019s lawyers, meanwhile, have focused in their filing on a little-used law they cited to federalize the National Guard.<\/p>\n<p><a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/10\/12406\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Section 12406(3);elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Section 12406(3)<\/a> of the US Code says the president can federalize the National Guard of any state in three circumstances: if the US is being invaded or faces danger of invasion; if there is a rebellion or danger of rebellion; or if the president is unable \u201cwith the regular forces to execute the laws of the United States.\u201d<\/p>\n<p>The law, however, stipulates the orders should be issued \u201cthrough the governors.\u201d Newsom\u2019s lawyers say Trump didn\u2019t consult with the governor before issuing the order. Breyer previously pointed out Trump\u2019s memo directed Hegseth to consult the governor before federalizing the National Guard \u2013 but that he didn\u2019t.<\/p>\n<p><img decoding=\"async\" class=\"caas-img caas-lazy has-preview\" alt=\"President Lyndon B. The first was when President Richard Nixon called on the National Guard to deliver the mail during the 1970 Postal Service strike.<\/p>\n<p>And it\u2019s the second time since 1965, when <a href=\"https:\/\/www.cnn.com\/2025\/06\/08\/us\/national-guard-trump-history-los-angeles?cid=external-feeds_iluminar_yahoo\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:President Lyndon B. Johnson;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">President Lyndon B. Johnson<\/a> sent troops to Alabama to protect civil rights demonstrators, that a president activated a state\u2019s national guard without a request from the governor \u2013 though he used a different law to do so.<\/p>\n<p>Trump\u2019s lawyers say the president was unable to enforce federal immigration law \u201cas well as laws forbidding interference with federal functions or assaults on federal officers and property\u201d with \u201cthe regular forces\u201d \u2013 so the deployment falls within the limits of Section 12406(3).<\/p>\n<p>What do Newsom\u2019s lawyers want?<\/p>\n<p>With <a href=\"https:\/\/www.gov.ca.gov\/2025\/07\/31\/nearly-all-national-guard-soldiers-in-los-angeles-are-demobilizing-governor-newsom-demands-those-remaining-be-released\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:only 300 National Guard troops;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">only 300 National Guard troops<\/a> still deployed in Los Angeles, Newsom\u2019s lawyers are looking mostly for symbolic relief: a declaration the memorandum used to federalize the National Guard and Hegseth\u2019s orders were unauthorized and illegal. The remaining troops are stationed at Joint Forces Training Base \u2013 Los Alamitos, Newsom says, \u201cwithout a clear mission, direction, or a timeline for returning to their communities.\u201d<\/p>\n<p>Newsom\u2019s team is also asking for \u201cinjunctive relief\u201d prohibiting Hegseth and the Department of Defense from federalizing and deploying the California National Guard and military without meeting legal requirements, including the cooperation of the governor.<\/p>\n<p>Finally, they ask to recoup the state of California\u2019s costs and attorneys\u2019 fees and \u201csuch additional relief as the court deems proper and the interests of justice may require.\u201d<\/p>\n<p>What witnesses will appear?<\/p>\n<p>Trump\u2019s lawyers indicated in a court filing they plan to call as a witness Maj. Gen. Scott M. Sherman, deputy commanding general of the National Guard. Sherman is expected to discuss the National Guard\u2019s deployment to Los Angeles and their compliance with the Posse Comitatus Act.<\/p>\n<p>Newsom\u2019s lawyers also plan to call Sherman, as well as US Army official William B. Harrington to testify about the activities of Task Force 51, the command post activated to coordinate deployment of National Guard troops and Marines to Los Angeles.
