{"id":14822,"date":"2025-06-25T23:59:09","date_gmt":"2025-06-25T23:59:09","guid":{"rendered":"https:\/\/www.europesays.com\/us\/14822\/"},"modified":"2025-06-25T23:59:09","modified_gmt":"2025-06-25T23:59:09","slug":"trump-sues-maryland-federal-judges-over-order-blocking-migrant-removal","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/14822\/","title":{"rendered":"Trump sues Maryland federal judges over order blocking migrant removal"},"content":{"rendered":"<p>The Trump administration on Tuesday filed <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.584990\/gov.uscourts.mdd.584990.1.0.pdf\" target=\"_blank\" rel=\"noopener nofollow\">a lawsuit against all 15 federal judges in Maryland<\/a> over an order blocking the immediate deportation of migrants challenging their removals, ratcheting up a fight with the federal judiciary over President Donald Trump\u2019s executive powers. <\/p>\n<p>The remarkable action lays bare the administration\u2019s determination to exert its will over immigration enforcement as well as a growing exasperation with federal judges who have time and again turned aside executive branch actions they see as lawless and without legal merit.<\/p>\n<p>\u201cIt\u2019s extraordinary,\u201d Laurie Levenson, a professor at Loyola Law School, said of the Justice Department\u2019s lawsuit. \u201cAnd it\u2019s escalating DOJ\u2019s effort to challenge federal judges.\u201d <\/p>\n<p>At issue is an order signed by Chief Judge George L. Russell III and filed in May blocking the administration from immediately removing from the U.S. any immigrants who file paperwork with the Maryland district court seeking a review of their detention. The order blocks the removal until 4 p.m. on the second business day after the habeas corpus petition is filed.<\/p>\n<p>The administration says the automatic pause on removals violates a Supreme Court ruling and impedes the president\u2019s authority to enforce immigration laws.<\/p>\n<p>The Republican administration has been locked for weeks in a growing showdown with the federal judiciary amid a barrage of legal challenges to the president\u2019s efforts to carry out key priorities around immigration and other matters. The Justice Department has grown increasingly frustrated by rulings blocking the president\u2019s agenda, accusing judges of improperly impeding the president\u2019s powers. <\/p>\n<p>\u201cPresident Trump\u2019s executive authority has been undermined since the first hours of his presidency by an endless barrage of injunctions designed to halt his agenda,\u201d Attorney General Pamela Bondi said in a statement Wednesday. \u201cThe American people elected President Trump to carry out his policy agenda: this pattern of judicial overreach undermines the democratic process and cannot be allowed to stand.\u201d<\/p>\n<p>A spokesman for the Maryland district court declined to comment. <\/p>\n<p>Trump has railed against unfavorable judicial rulings, and in one case called for the impeachment of a federal judge in Washington who ordered <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/el-salvador-trump-tren-de-aragua-venezuela-dde4259e5dcd502101b7b8fbd3c03659\" rel=\"nofollow noopener\" target=\"_blank\">planeloads of deported immigrants<\/a> to be turned around. That led to an extraordinary statement from Supreme Court Chief Justice <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/donald-trump-federal-judges-impeachment-29da1153a9f82106748098a6606fec39\" rel=\"nofollow noopener\" target=\"_blank\">John Roberts<\/a>, who said \u201cimpeachment is not an appropriate response to disagreement concerning a judicial decision.\u201d <\/p>\n<p>Among the judges named in the lawsuit is Paula Xinis, who has called the administration\u2019s deportation of <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/kilmar-abrego-garcia-deportation-smuggling-27c3a6f7a1a0700d9a33209e852c06a6\" rel=\"nofollow noopener\" target=\"_blank\">Kilmar Abrego Garcia<\/a> to El Salvador illegal. Attorneys for Abrego Garcia <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/kilmar-abrego-garcia-contempt-fines-trump-3a8511d876f3989cac29da93f8f86f1f\" rel=\"nofollow noopener\" target=\"_blank\">have asked Xinis<\/a> to impose fines against the administration for contempt, arguing that it ignored <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/el-salvador-deportation-maryland-man-trump-617bfac0e54b241fa2f54783bdf08628\" rel=\"nofollow noopener\" target=\"_blank\">court orders<\/a> for weeks to return him to the U.S. <\/p>\n<p>The order signed by Russell says it aims to maintain existing conditions and the potential jurisdiction of the court, ensure immigrant petitioners are able to participate in court proceedings and access attorneys and give the government \u201cfulsome opportunity to brief and present arguments in its defense.\u201d<\/p>\n<p>In an amended order, Russell said the court had received an influx of habeas petitions after hours that \u201cresulted in hurried and frustrating hearings in that obtaining clear and concrete information about the location and status of the petitioners is elusive.\u201d<\/p>\n<p>The Trump administration has asked the Maryland judges to recuse themselves from the case. It wants a clerk to have a federal judge from another state hear it.<\/p>\n<p>James Sample, a constitutional law professor at Hofstra University, described the lawsuit as further part of the erosion of legal norms by the administration. Normally when parties are on the losing side of an injunction, they appeal the order \u2014 not sue the court or judges, he said.<\/p>\n<p>On one hand, he said, the Justice Department has a point that injunctions should be considered extraordinary relief; it\u2019s unusual for them to be granted automatically in an entire class of cases.
