The 13-year-old was released into his grandmother’s custody on Tuesday. His next court appearance is scheduled for August 25.<\/p>\n

SAN ANTONIO \u2014 A 13-year-old boy charged in connection to the fatal shooting of his younger brother<\/a> in July, was released on Tuesday under conditions laid out by the judge\u2014according to court officials.<\/p>\n

San Antonio police said the brothers and other children were playing with a gun while left without adult supervision at a home on the 3500 block of Bob Billa Street on the southeast side.<\/p>\n

Officials said the gun went off and the teen shot his 8-year-old brother, Daniel Casares, in the neck. He was rushed to the hospital in critical condition where he was pronounced dead.<\/p>\n

The 13-year-old, charged with manslaughter, appeared in juvenile court<\/a> on July 28 where the boy’s grieving father pleaded for the release of his son.<\/p>\n

Last week, Judge William Cruz Shaw outlined guidelines for the family for the\u00a0teen’s potential release<\/a>, saying that as soon as they met his conditions, he would consider sending him home.<\/p>\n

A court coordinator confirmed that the Judge Shaw released the 13-year-old to his grandmother’s custody on Tuesday as he awaits further proceedings. Under the conditions of his release, the teen must attend counseling and avoid contact with guns.<\/p>\n
