{"id":162900,"date":"2025-08-21T04:35:11","date_gmt":"2025-08-21T04:35:11","guid":{"rendered":"https:\/\/www.europesays.com\/us\/162900\/"},"modified":"2025-08-21T04:35:11","modified_gmt":"2025-08-21T04:35:11","slug":"ftc-sues-la-fitness-over-gym-cancellation-tactics","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/162900\/","title":{"rendered":"FTC Sues LA Fitness Over Gym Cancellation Tactics"},"content":{"rendered":"<p>Fitness International, the operator of <a class=\"editor-rtfLink\" href=\"https:\/\/www.lafitness.com\/Pages\/Default.aspx\" target=\"_blank\" rel=\"noopener\">LA Fitness<\/a> and other gym chains, said Wednesday (Aug. 20) that it will defend its practices in court after the <a class=\"editor-rtfLink\" href=\"https:\/\/www.ftc.gov\/\" target=\"_blank\" rel=\"noopener\">Federal Trade Commission<\/a> (FTC) sued the company and alleged that it makes it \u201cexceedingly difficult\u201d to cancel memberships.<\/p>\n<p>The FTC said in a Wednesday <a class=\"editor-rtfLink\" href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2025\/08\/ftc-sues-la-fitness-making-it-difficult-consumers-cancel-gym-memberships\" target=\"_blank\" rel=\"noopener\">press release<\/a> that its <a class=\"editor-rtfLink\" href=\"https:\/\/www.ftc.gov\/system\/files\/ftc_gov\/pdf\/LAFitness-Complaint.pdf\" target=\"_blank\" rel=\"noopener\">complaint<\/a> alleges that Fitness International violated the <a class=\"editor-rtfLink\" href=\"https:\/\/www.ftc.gov\/legal-library\/browse\/statutes\/federal-trade-commission-act\" target=\"_blank\" rel=\"noopener\">FTC Act<\/a> and the <a class=\"editor-rtfLink\" href=\"https:\/\/www.ftc.gov\/legal-library\/browse\/statutes\/restore-online-shoppers-confidence-act\" target=\"_blank\" rel=\"noopener\">Restore Online Shoppers\u2019 Confidence Act<\/a> (ROSCA) through a variety of practices that make gym memberships seem \u201cimpossible to cancel.\u201d<\/p>\n<p>The regulator said these practices include requiring consumers who want to cancel a membership to do so in person or by mail, telling consumers who try to cancel in person that they can do so with only one specific employee, restricting cancellation hours to times when consumers are typically at work, failing to tell consumers what information to include in a written request for cancellation, and requiring mailed requests to be sent via certified or registered mail.<\/p>\n<p>In its lawsuit, the FTC seeks a court order prohibiting the allegedly unfair practices and money back for consumers who were harmed by these difficulties, according to the release.<\/p>\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/www.ftc.gov\/about-ftc\/bureaus-offices\/bureau-consumer-protection\" target=\"_blank\" rel=\"noopener\">Bureau of Consumer Protection<\/a> Director <a class=\"editor-rtfLink\" href=\"https:\/\/www.ftc.gov\/about-ftc\/commissioners-staff\/chris-mufarrige\" target=\"_blank\" rel=\"noopener\">Christopher Mufarrige<\/a> said in the release that \u201ctens of thousands of LA Fitness customers reported difficulties.\u201d<\/p>\n<p>\u201cThe FTC will not hesitate to act on behalf of consumers when it believes companies are stifling consumers\u2019 ability to choose which recurring charges they want to keep,\u201d Muffarrige said.<\/p>\n<p>Fitness International responded to the FTC\u2019s complaint with a <a class=\"editor-rtfLink\" href=\"https:\/\/www.prnewswire.com\/news-releases\/fitness-international-llc-responds-to-ftc-complaint-302534979.html\" target=\"_blank\" rel=\"noopener\">statement<\/a> in which its president of club operations, Jill Hill, said that the allegations are \u201cwithout merit\u201d and that ROSCA was designed to address only online transactions and does not require a specific method of cancellation.<\/p>\n<p>Hill also said in the statement that the company offers members the option to cancel not only in person or by mail, but also online.
