{"id":163537,"date":"2025-08-21T10:21:09","date_gmt":"2025-08-21T10:21:09","guid":{"rendered":"https:\/\/www.europesays.com\/us\/163537\/"},"modified":"2025-08-21T10:21:09","modified_gmt":"2025-08-21T10:21:09","slug":"apple-watchs-restored-blood-oxygen-tracking-attracts-another-lawsuit","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/163537\/","title":{"rendered":"Apple Watch\u2019s restored blood oxygen tracking attracts another lawsuit"},"content":{"rendered":"<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1ymtmqpi _17nnmdy1 _17nnmdy0 _1xwtict1\">Medical tech company Masimo is suing US Customs and Border Protection (CBP) in an attempt to overturn the agency\u2019s decision to allow Apple to restore the blood oxygen tracking feature on Apple Watches.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1ymtmqpi _17nnmdy1 _17nnmdy0 _1xwtict1\">Apple has been embroiled in legal disputes over Masimo\u2019s blood oxygen sensor patent since 2020, disabling the feature on supported US Apple Watch models following an <a href=\"https:\/\/www.theverge.com\/2023\/12\/18\/24006080\/apple-watch-ban-series-9-ultra-2-itc-import\" target=\"_blank\" rel=\"noopener\">ITC import ban<\/a> in December 2023. In <a href=\"https:\/\/www.bloomberglaw.com\/public\/desktop\/document\/MASIMOCORPORATIONvUNITEDSTATESCUSTOMSANDBORDERPROTECTIONetalDocke?doc_id=X7CR5AGJN19VIQVF66HVETLJRF\" target=\"_blank\" rel=\"noopener\">a complaint filed on Wednesday<\/a>, Masimo said that the CBP failed to notify the company of its decision to reverse the International Trade Commission restrictions, leaving Masimo with no opportunity to review or challenge the ruling. Masimo said it only learned that the ban had been reversed after Apple announced its <a href=\"https:\/\/www.theverge.com\/news\/759158\/apple-watch-blood-oxygen-redesign-import-ban-wearables-smartwatch\" target=\"_blank\" rel=\"noopener\">\u201credesigned\u201d pulse oximetry feature<\/a> last week, which now calculates blood oxygen levels on iPhones instead of the Watch.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1ymtmqpi _17nnmdy1 _17nnmdy0 _1xwtict1\">While no direct accusations were made, Masimo called out in the filing that Apple has made \u201ca series of substantial investments in the United States\u201d after its appeals to overturn the ITC ban were denied.
