He\u2019s been in jail in Tennessee since he was <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abrego-garcia-justice-department-el-salvador-a547f3a228c92d4e69be799354037c7f\" rel=\"nofollow noopener\" target=\"_blank\">returned to the U.S.<\/a> on June 7 to face federal charges of <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/kilmar-abrego-garcia-human-smuggling-deportation-tennessee-f8ded5881c1cedd10c725e7b1cca79bc\" rel=\"nofollow noopener\" target=\"_blank\">human smuggling<\/a>.<\/p>\n<p>U.S. Magistrate Judge Barbara Holmes in Nashville has ruled that Abrego Garcia has a right to be released while awaiting trial. But <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/kilmar-abrego-garcia-deportation-smuggling-27c3a6f7a1a0700d9a33209e852c06a6\" rel=\"nofollow noopener\" target=\"_blank\">she decided Wednesday<\/a> to keep him in custody for at least a few more days over concerns that U.S. immigration officials would swiftly try to deport him again. <\/p>\n<p>Abrego Garcia\u2019s attorneys in Maryland, where <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/kilmar-abrego-garcia-contempt-fines-trump-3a8511d876f3989cac29da93f8f86f1f\" rel=\"nofollow noopener\" target=\"_blank\">his wife is suing<\/a> Trump\u2019s Republican administration over his March deportation, have offered up a possible solution. They\u2019ve asked the federal judge overseeing the lawsuit to direct the government to bring take to Maryland while he awaits trial in Tennessee. <\/p>\n<p>\u201cIf this Court does not act swiftly, then the Government is likely to whisk Abrego Garcia away to some place far from Maryland,\u201d Abrego Garcia\u2019s attorneys wrote in their request to U.S. District Judge Paula Xinis in Greenbelt, Maryland. <\/p>\n<p>Abrego Garcia lived in Maryland, just outside Washington, with his American wife and children for more than a decade. His deportation violated a U.S. immigration judge\u2019s order in 2019 that barred his expulsion to his native country. The judge had found that Abrego Garcia faced a credible threat from gangs who had terrorized him and his family. <\/p>\n<p>The Trump administration described its violation of the immigration judge\u2019s 2019 order as <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/el-salvador-deportation-maryland-man-trump-error-818a0fa1218de714448edcb5be1f7347\" rel=\"nofollow noopener\" target=\"_blank\">an administrative error<\/a>. Trump and other officials doubled down on claims Abrego Garcia was in the MS-13 gang, an accusation that Abrego Garcia denies. <\/p>\n<p>Abrego Garcia <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/abrego-garcia-deportation-error-2bf259d9de88334bbdfb6d565b36e633\" rel=\"nofollow noopener\" target=\"_blank\">pleaded not guilty<\/a> on June 13 to smuggling charges that his attorneys have characterized as an attempt to justify his mistaken expulsion to <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/el-salvador-trump-prison-immigrants-4ab3fc3c0474efb308084604b61f8a37\" rel=\"nofollow noopener\" target=\"_blank\">a notorious prison in El Salvador<\/a>. <\/p>\n<p>Those charges stem from a 2022 traffic stop for speeding in Tennessee, during which Abrego Garcia was driving a vehicle with nine passengers without luggage. <\/p>\n<p>Holmes, the magistrate judge in Tennessee, wrote in a ruling on Sunday that federal prosecutors failed to show that Abrego Garcia was a flight risk or a danger to the community. <\/p>\n<p>During a court hearing on Wednesday, Holmes set specific conditions for his release that included Abrego Garcia living with his brother, a U.S. citizen, in Maryland. But she held off on releasing him over concerns that prosecutors can\u2019t prevent U.S. Immigration and Customs Enforcement from deporting him. <\/p>\n<p>Holmes expressed doubts about her own power to require anything more than prosecutors using their best efforts to secure the cooperation of ICE.<\/p>\n<p>\u201cI have no reservations about my ability to direct the local U.S. Attorney\u2019s office,\u201d the judge said. \u201cI don\u2019t think I have any authority over ICE.\u201d <\/p>\n<p>Acting U.S. Attorney Rob McGuire told the judge he would do \u201cthe best I can\u201d to secure the cooperation of ICE. But the prosecutor noted, \u201cThat\u2019s a separate agency with separate leadership and separate directions.
