{"id":17344,"date":"2025-06-26T21:42:09","date_gmt":"2025-06-26T21:42:09","guid":{"rendered":"https:\/\/www.europesays.com\/us\/17344\/"},"modified":"2025-06-26T21:42:09","modified_gmt":"2025-06-26T21:42:09","slug":"councilman-requests-states-ethics-committee-to-review-hiring-of-general-counsels-father-in-law","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/17344\/","title":{"rendered":"Councilman requests state\u2019s ethics committee to review hiring of general counsel\u2019s father-in-law"},"content":{"rendered":"<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\"><strong>JACKSONVILLE, Fla. <\/strong> \u2013 This week, <a href=\"https:\/\/www.jacksonville.gov\/city-council\/city-council-members\/d02\" target=\"_blank\" rel=\"noopener\" title=\"https:\/\/www.jacksonville.gov\/city-council\/city-council-members\/d02\">Jacksonville City Council member Mike Gay<\/a> introduced a resolution to formally request a review by the Florida Commission on Ethics of the decision by General Counsel Michael Fackler to hire the Bedell law firm for representation in the city\u2019s criminal gun registry case. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\"><b>RELATED: <\/b><a href=\"https:\/\/www.news4jax.com\/news\/local\/2025\/06\/24\/city-council-considers-3m-for-affordable-housing-as-part-of-downtown-jacksonville-development-proposal\/\" target=\"_blank\" rel=\"noopener\" title=\"https:\/\/www.news4jax.com\/news\/local\/2025\/06\/24\/city-council-considers-3m-for-affordable-housing-as-part-of-downtown-jacksonville-development-proposal\/\">City Council considers $3M for Affordable Housing as part of Downtown Jacksonville development proposal<\/a><\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Fackler\u2019s father-in-law, <a href=\"https:\/\/www.bedellfirm.com\/attorney\/henry-m-coxe-iii\/\" target=\"_blank\" rel=\"noopener\" title=\"https:\/\/www.bedellfirm.com\/attorney\/henry-m-coxe-iii\/\">Hank Coxe<\/a>, has been a partner of the Bedell firm for many years. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Fackler publicly announced in May that the city had hired the firm, as members of the city council\u2019s Rules Committee grilled him on the gun registry matter. Fackler explained the timeline, saying the city first became aware of the issue on April 21, and the Bedell firm was hired to begin handling the legal aspects. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The familial connection, however, has raised some questions, prompting Gay\u2019s desire to see a written legal opinion.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cIn the city, there are many firms that can specialize in criminal law,\u201d Gay said. \u201cI feel that this will bring clarity and transparency, and we don\u2019t want to be a government that operates trying to maneuver and skirt through small, tiny loopholes.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The city maintains that no ethics violations occurred. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">A statement from a city spokesperson was given to News4JAX, saying in part: <\/p>\n<blockquote class=\"dist__Box-sc-1fnzlkn-0 dist__StackBase-sc-1fnzlkn-7 bqJyUE iQviKm block-quote\">\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 ewwUYq\">The Office of General Counsel \u2013 in their independent role as the judicial branch of Consolidated Government \u2013 has hired Bedell in this matter. OGC did run the Bedell hire by the local and state Ethics offices and was advised that there is no violation of statute.<\/p>\n<p>Spokesperson for City of Jacksonville<\/p><\/blockquote>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The spokesperson also supplied an email exchange between Fackler and Kirby Oberdorfer, the director of the city\u2019s Office of Ethics, Compliance, and Oversight. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">In the email exchange, Oberdorfer included what he said were the most relevant opinions regarding the state\u2019s anti-nepotism law, writing the following: <\/p>\n<blockquote class=\"dist__Box-sc-1fnzlkn-0 dist__StackBase-sc-1fnzlkn-7 bqJyUE iQviKm block-quote\">\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 ewwUYq\">In these opinions, the State Ethics Commission and Attorney General consistently determine that the anti-nepotism law applies only to employment\/appointment to or within a government agency and does not apply to independent contractors who are hired to provide services, including professional services.<\/p>\n<p>Kirby Oberdorfer in an email exchange with Michael Fackler<\/p><\/blockquote>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Earlier this week, Mayor Donna Deegan was asked about this matter during a news conference on a separate issue. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cWe ran it by everybody as far as I know,\u201d Deegan said. \u201cI don\u2019t have any problem with anybody ever asking for an ethics ruling on anything. That\u2019s something we do on the daily here, so that\u2019s fine.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The proposed resolution is now in committee and is set to go through the regular council cycle.
