Right now, the media is focused on new immigration detention centers opening in states like <a href=\"https:\/\/apnews.com\/article\/florida-alligator-alcatraz-immigration-detention-trump-desantis-cc060aa6528acbd91a87ec1922578146\" target=\"_blank\" rel=\"nofollow noopener\">Florida<\/a>, <a href=\"https:\/\/apnews.com\/article\/immigration-detention-indiana-prison-immigrants-f4af2d5ad5ece8481b0750dad53fb743\" target=\"_blank\" rel=\"nofollow noopener\">Indiana<\/a>, <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/aug\/07\/fort-bliss-ice-immigration-trump\" target=\"_blank\" rel=\"nofollow noopener\">Texas<\/a>, and <a href=\"https:\/\/nebraskaexaminer.com\/briefs\/will-nebraska-be-home-to-the-next-alligator-alcatraz\/\" target=\"_blank\" rel=\"nofollow noopener\">Nebraska<\/a>. But here in Upstate New York, immigration detention is also rapidly growing and worsening. With a team of law students and attorney colleagues, I visited the Buffalo Federal Detention Facility (BFDF) in July 2025 and spoke directly to many detained persons.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"AQSLNCNIUVHGDCBGGE6FT4WW6M\">\u201cThere are so many people, I am afraid that while sleeping on the top bunk I could roll off and fall on someone,\u201d a detained immigrant in BFDF told us. He and others described mattresses on the floor between bunks in BFDF dorms. This is unsurprising given that record numbers of individuals are in detention \u2014 <a href=\"https:\/\/tracreports.org\/immigration\/quickfacts\/\" target=\"_blank\" rel=\"nofollow noopener\">over 59,000<\/a> \u2014 and there are <a href=\"https:\/\/austinkocher.substack.com\/p\/new-detention-numbers-are-out-ice?utm_source=substack&amp;utm_medium=email\" target=\"_blank\" rel=\"nofollow noopener\">even more<\/a> that the government isn\u2019t reporting. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6RTR7NQRRNGIDF5HK75MSQWMJM\">The Trump administration\u2019s ramped-up deportation machine is only possible because it ignores both immigration and civil rights law and immigrants\u2019 humanity. The current mandate of <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/may\/29\/trump-ice-arrest-quota\" target=\"_blank\" rel=\"nofollow noopener\">3,000 immigrant arrests per day<\/a> essentially requires ICE agents to arrest anyone they can find, including those with lawful status, pending cases, and long-time residency. These haphazard arrests are often conducted by <a href=\"https:\/\/www.npr.org\/2025\/07\/09\/nx-s1-5440311\/ice-raids-masked-agents\" target=\"_blank\" rel=\"nofollow noopener\">masked officers<\/a> who are using<a href=\"https:\/\/www.axios.com\/2025\/07\/09\/ice-us-citizens-detention-racial-profiling\" target=\"_blank\" rel=\"nofollow noopener\"> racial profiling<\/a> to sweep up any potential immigrants. One Latino man we visited at BFDF was apprehended by ICE while he was pumping gas \u2014 there was no reason officers should have approached him. ICE is indiscriminately arresting anyone and everyone \u2014 <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/aug\/05\/us-citizens-jailed-ice-los-angeles\" target=\"_blank\" rel=\"nofollow noopener\">even U.S. citizens<\/a>.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"Z7WIMHEKAJCWHESDVTVKRUMPNI\">Many of those detained in BFDF have temporary lawful status and were diligently attending their court hearings. Some had lawful work authorization but were simply plucked off the street after work or, in one case, at a Buffalo Walmart. They were astonished to be detained after showing their valid work cards to ICE. \u201cI am working 70 hours a week for my family, I have no convictions, and I came by the rules. Why am I here?\u201d one Cuban man with humanitarian parole asked. Indeed, like him, over <a href=\"https:\/\/fortune.com\/2025\/07\/12\/ice-raids-trump-immigration-crackdown-deportation-no-criminal-convictions\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/fortune.com\/2025\/07\/12\/ice-raids-trump-immigration-crackdown-deportation-no-criminal-convictions\/\">70% of detained immigrants nationwide have no criminal convictions<\/a>. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"A3ZRP6G7MNELPARNWZN5MXS5AY\">A 20-year-old man in BFDF recounted going four days sleeping on the floor and without access to a shower. He had already filed for Special Immigrant Juvenile Status (SIJS), a type of green card for immigrant youth. Like those with pending asylum cases who attend their immigration court hearings from outside detention, pursuing status \u201cthe right way,\u201d normally a SIJS applicant is not detained.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"2RKATNZHZVDWNJLMKXV2RYKH6I\">Some people we met in BFDF were subjected to workplace exploitation in the United States that qualifies them for a <a href=\"https:\/\/www.uscis.gov\/humanitarian\/victims-of-human-trafficking-t-nonimmigrant-status\" target=\"_blank\" rel=\"nofollow noopener\">T-visa<\/a> for victims of human trafficking, or they qualify for a <a href=\"https:\/\/www.uscis.gov\/humanitarian\/victims-of-criminal-activity-u-nonimmigrant-status\" target=\"_blank\" rel=\"nofollow noopener\">U-visa<\/a>, for victims of certain crimes. However, they can\u2019t effectively apply for such visas without a lawyer, and immigration judges cannot grant those visas \u2014 only U.S. Citizenship and Immigration Services can. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ILEK26QYJNHDLHIBVIKLXDVCF4\">One U-visa-eligible man in his mid-30s had lived in the United States since he was 10 years old. Although he had been violently assaulted and lost use of one of his arms, he had not yet applied. Now he sits in immigration detention, eligible for a visa that he can\u2019t realistically pursue from inside and many states away from his community of the last 25 years. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"DQ3RUWGNZRA4BJVRHTQL35KUCY\">Other detained people in BFDF had attempted to leave the United States for Canada because they fear U.S. enforcement. But Canada turns them back because of the \u201c<a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/corporate\/mandate\/policies-operational-instructions-agreements\/agreements\/safe-third-country-agreement.html\" target=\"_blank\" rel=\"nofollow noopener\">safe third country\u201d agreement<\/a>, which generally requires foreign nationals to seek refuge in whichever country they arrive first.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ANC2L47325EUZGVAMAKTZE63YY\">This is all quickly getting much, much worse. The <a href=\"https:\/\/immigrationforum.org\/article\/one-big-beautiful-bill-act-immigration-provisions\/\" target=\"_blank\" rel=\"nofollow noopener\">Big Beautiful Bill <\/a>that Congress passed in early July allocates more than $70 billion in supplemental funding over four years to increase border security operations. Forty-five billion dollars are allocated toward <a href=\"https:\/\/www.nilc.org\/resources\/the-anti-immigrant-policies-in-trumps-final-big-beautiful-bill-explained\/#unprecedented-detention-and-enforcement-funding-with-guardrails-stripped-away\" target=\"_blank\" rel=\"nofollow noopener\">opening additional detention facilities<\/a>, quadrupling the current funding even as the U.S. currently holds <a href=\"https:\/\/www.cbsnews.com\/news\/ice-record-59000-immigrant-detainees-half-no-criminal-record\/\" target=\"_blank\" rel=\"nofollow noopener\">record-breaking numbers of detained immigrants<\/a>. ICE has told some individuals that they may be deported to a third country, like El Salvador, where the infamous <a href=\"https:\/\/www.hrw.org\/news\/2025\/03\/20\/human-rights-watch-declaration-prison-conditions-el-salvador-jgg-v-trump-case\" target=\"_blank\" rel=\"nofollow noopener\">CECOT<\/a> prison is located.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"SYQLJAPVPVDIHGHAWRANBFKKY4\">Already, <a href=\"https:\/\/www.nytimes.com\/2025\/06\/28\/us\/immigrant-detention-conditions.html\" target=\"_blank\" rel=\"nofollow noopener\">conditions are more horrendous than ever<\/a>. Hastily built centers and spiking arrest rates, combined with the <a href=\"https:\/\/www.npr.org\/2025\/03\/21\/nx-s1-5336738\/homeland-security-rif-cuts-dhs\" target=\"_blank\" rel=\"nofollow noopener\">dismantling<\/a> of oversight, mean people are crammed into overcrowded facilities. Yet conditions in detention nationwide have long been abhorrent, with <a href=\"https:\/\/rfkhumanrights.org\/press\/new-report-exposes-rampant-abuse-in-louisiana-ice-detention-facilities\/\" target=\"_blank\" rel=\"nofollow noopener\">lack of sufficient food, poor medical care<\/a>, no <a href=\"https:\/\/forum.lawschool.cornell.edu\/clinc-files-federal-complaint\/\" target=\"_blank\" rel=\"nofollow noopener\">language access<\/a>, and <a href=\"https:\/\/rfkhumanrights.org\/our-voices\/complaint-exposes-torture-and-cruel-and-degrading-treatment-at-louisiana-immigration-detention-center\/\" target=\"_blank\" rel=\"nofollow noopener\">even torture<\/a>.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6SZHEXQHUBD7RDMLMBXENAFNNY\">Everyone, regardless of political affiliation or even views on immigration, should be deeply concerned by this administration\u2019s handling of immigrants. Current policies threaten the very bedrock of democracy, <a href=\"https:\/\/www.cato.org\/blog\/1\/5-ice-arrests-are-latinos-streets-no-criminal-past-or-removal-order\" target=\"_blank\" rel=\"nofollow noopener\">risking the civil rights<\/a> of all in the name of exclusion and expulsion. <a href=\"https:\/\/www.nbcnews.com\/news\/latino\/trump-immigration-raids-citizens-profiling-accusations-native-american-rcna189203\" target=\"_blank\" rel=\"nofollow noopener\">Racialized enforcement<\/a> and rampant disregard for human rights should not be a hallmark of the orderly, fair immigration system we should strive for \u2014 and it is tearing Upstate New York communities apart. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"NMS4KHNYZNGTZDLUGR5IV3IK3E\">In recent days, <a href=\"https:\/\/www.cato.org\/blog\/poll-72-americans-say-immigrants-come-us-jobs-improve-their-lives-53-say-ability-immigrate?gad_source=1&amp;gad_campaignid=85808169&amp;gbraid=0AAAAADusmueinR_FlFT7Yx0NjxQgGmXR4&amp;gclid=CjwKCAjwwNbEBhBpEiwAFYLtGH52yjeQbBIjwMqaxJg18T8K1zsjXbB_P-5x436y6EeuxFZyNsCHlhoC3nQQAvD_BwE\" target=\"_blank\" rel=\"nofollow noopener\">polling shows that 72% of Americans <\/a>say immigrants come to the United States to better their lives. The nativist, anti-immigrant tide of the current administration is <a href=\"https:\/\/news.gallup.com\/poll\/692522\/surge-concern-immigration-abated.aspx\" target=\"_blank\" rel=\"nofollow noopener\">increasingly unpopular<\/a>.
