{"id":175413,"date":"2025-08-25T22:15:20","date_gmt":"2025-08-25T22:15:20","guid":{"rendered":"https:\/\/www.europesays.com\/us\/175413\/"},"modified":"2025-08-25T22:15:20","modified_gmt":"2025-08-25T22:15:20","slug":"floridas-repeated-failures-in-mental-health-care-for-inmates-could-open-state-to-lawsuits","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/175413\/","title":{"rendered":"Florida&#8217;s repeated failures in mental health care for inmates could open state to lawsuits"},"content":{"rendered":"<p style=\"text-align: justify;\">Nearly 20 years after Florida\u2019s family welfare chief was fined and resigned after her agency failed to move mentally ill inmates into treatment centers, the state is once again in court over the same problem, which has worsened since.<\/p>\n<p style=\"text-align: justify;\">In an ongoing <a href=\"https:\/\/cvweb.leonclerk.com\/public\/online_services\/search_courts\/process.asp?report=full_view&amp;caseid=3115087&amp;jiscaseid=1487564&amp;defseq=A&amp;chargeseq=1\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\"><strong>case in Leon County<\/strong><\/a>, the Department of Children and Families (<a href=\"https:\/\/www.myflfamilies.com\/contact-us\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\"><strong>DCF<\/strong><\/a>) was ordered this month to explain why it shouldn\u2019t be held in contempt for failing to transfer <strong>Tara Carty<\/strong>, a 46-year-old defendant declared incompetent to stand trial, to a forensic hospital within the 15 days <a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0900-0999\/0916\/Sections\/0916.107.html\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\"><strong>required by state law<\/strong><\/a>.<\/p>\n<p style=\"text-align: justify;\">DCF General Counsel <strong>Andrew McGinley<\/strong> offered a jaw-dropper of an explanation. The agency isn\u2019t in \u201cwillful non-compliance,\u201d he said, as it would transfer Carty on time if it could. But the agency is physically unable to meet that deadline because none of its beds at <strong><a href=\"https:\/\/img1.wsimg.com\/blobby\/go\/04dad2ad-e4b1-42e4-b8b4-42d4f2bb4407\/Behavioral%20Health%20Gap%20Analysis%20-%20SB%20330%20Analys.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">six mental health treatment facilities<\/a><\/strong> statewide are available.<\/p>\n<p style=\"text-align: justify;\">Carty\u2019s case is far from unique. DCF said 772 defendants committed to mental health treatment facilities were waiting beyond the 15-day limit as of July.<\/p>\n<p style=\"text-align: justify;\">The average wait time is 117 days for men and 125 days for women.<\/p>\n<p><a href=\"https:\/\/go.slalom.com\/SlalomFL_Government\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-725417\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/08\/Efficient_Government_728x90.png\" alt=\"\" width=\"728\" height=\"90\"\/><\/a><\/p>\n<p style=\"text-align: justify;\">Carty, DCF noted, was 29th in line on the female wait list.<\/p>\n<p style=\"text-align: justify;\"><a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0900-0999\/0916\/Sections\/0916.107.html\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\"><strong>Florida law<\/strong><\/a> has mandated for decades that criminal defendants can be jailed for a maximum of 15 days if found not guilty by reason of insanity or deemed incompetent to stand trial. After that, they must be transferred to a mental hospital.<\/p>\n<p style=\"text-align: justify;\">Forensic commitments of mentally ill inmates have surged by 74% since 2020, DCF said in its court filing, but the state still has just over 3,000 beds.<\/p>\n<p style=\"text-align: justify;\">McGinley argued that contempt orders won\u2019t fix what is fundamentally a legislative issue, that courts can\u2019t compel DCF to spend money or create beds beyond what lawmakers have funded.<\/p>\n<p style=\"text-align: justify;\">Under Florida statutes, the DCF Secretary and the heads of nearly every other state agency must <a href=\"https:\/\/d.docs.live.net\/a428b9bf465d828f\/Documents\/DCF%20Secretary,\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\"><strong>submit yearly budget requests<\/strong><\/a> to the Legislature and Governor \u201cbased on the agency\u2019s independent judgment of its needs.\u201d<\/p>\n<p><a href=\"http:\/\/ncf.edu\/\" target=\"_blank\" rel=\"noopener external noreferrer nofollow\" data-wpel-link=\"external\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-722105 size-full\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/08\/Sunburn_FloridaPoliticsWebsite_728x905186-scaled-e1740018793631.jpg\" alt=\"\" width=\"728\" height=\"90\"\/><\/a><\/p>\n<p style=\"text-align: justify;\">DCF funding specific to bed capacity has varied over the past half-decade. Between 2020 and 2022, lawmakers apportioned between $10 million and $14.6 million to bolster and boost its forensic bed count. Ahead of fiscal year 2023-24 \u2014 when the agency <strong><a href=\"http:\/\/floridafiscalportal.state.fl.us\/Document.aspx?ID=24455&amp;DocType=PDF\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">later said delays peaked<\/a><\/strong> at 525 detainees waiting in jail beyond the 15-day deadline \u2014 DCF <strong><a href=\"http:\/\/floridafiscalportal.state.fl.us\/Document.aspx?ID=24455&amp;DocType=PDF\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">requested $47.3 million<\/a><\/strong>. Lawmakers <strong><a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2023\/2500\/BillText\/er\/PDF\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">approved $35 million<\/a><\/strong>.<\/p>\n<p style=\"text-align: justify;\">It denoted a historic and continuing trend. Over the years, DCF has routinely requested more money to reduce the wait for mental health treatment facility beds than the Legislature ultimately provides. Sometimes the difference is vast, as was the case in last year\u2019s budget, when DCF requested <strong><a href=\"http:\/\/floridafiscalportal.state.fl.us\/Document.aspx?ID=26122&amp;DocType=PDF\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">$77.8 million in nonrecurring funds<\/a><\/strong> and got just <strong><a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2024\/5001&#039;\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">$9 million<\/a><\/strong>.<\/p>\n<p style=\"text-align: justify;\">For <strong><a href=\"http:\/\/floridafiscalportal.state.fl.us\/Document.aspx?ID=28363&amp;DocType=PDF\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">fiscal year 2026<\/a><\/strong>, DCF asked for even more: $95.4 million in recurring general revenue funds to \u201csustain and support\u201d bed capacity. The <strong><a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2025\/2500\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">budget<\/a><\/strong> that Gov. <strong>Ron DeSantis <\/strong>signed in June included $78.6 million for that purpose. But there\u2019s a catch: Just $19.6 million is cleared for immediate release, with the rest held in reserve.<\/p>\n<p><a href=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/08\/dcf.jpg\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-633132 size-full\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/08\/dcf.jpg\" alt=\"\" width=\"640\" height=\"360\"  \/><\/a>The Florida Department of Children and Families employs about 12,000 people across the state, according to its website. In June, lawmakers <a href=\"https:\/\/floridapolitics.com\/archives\/743309-budget-conference-lawmakers-agree-to-cut-455-positions-at-dcf-most-in-mental-health\/\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">cut 445 positions<\/a> at the agency, most of them in mental health. Image via Florida Department of Children and Families.<\/p>\n<p style=\"text-align: justify;\"><strong>Paul Wright<\/strong>, Executive Director of the nonprofit <strong><a href=\"https:\/\/www.humanrightsdefensecenter.org\/about\/staff\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">Human Rights Defense Center<\/a><\/strong> and founding editor of Prison Legal News, told Florida Politics he\u2019s surprised no one has filed a class-action federal lawsuit yet.<\/p>\n<p style=\"text-align: justify;\">\u201cThere\u2019s been successful litigation in a bunch of states, where they came under federal court supervision with injunctions and the court told them, \u2018Hey, you\u2019ve got to do this.\u2019 Because they\u2019re not going to wait 25 years for the Legislature to maybe get around to doing something,\u201d he said. \u201cThat would be the obvious next step here, a class-action lawsuit on behalf of the people being denied.\u201d<\/p>\n<p style=\"text-align: justify;\"><strong>More has been done over less<\/strong><\/p>\n<p style=\"text-align: justify;\">The current problem echoes a <strong><a href=\"https:\/\/www.tampabay.com\/archive\/2006\/12\/01\/head-of-dcf-is-fined-80000\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">case in 2006<\/a><\/strong>, when Pinellas County Judge <strong>Crockett Farnell <\/strong>fined then-DCF Secretary <strong>Lucy Hadi <\/strong>$80,000 for similar delays. Under Hadi\u2019s watch and with insufficient state funding, some detainees deemed too mentally ill to be convicted or stand trial had languished in jail without treatment for nearly three months.<\/p>\n<p style=\"text-align: justify;\">During the case, Farnell accused Hadi of disobeying court orders, missing appeal dates and even charged her with indirect criminal contempt, which carried the possibility of jail time.<\/p>\n<p style=\"text-align: justify;\">At the time, 237 inmates statewide \u2014 less than a third of the current count \u2014 were held illegally past the statutory cutoff. DCF then had 1,416 beds at its mental health treatment facilities. Today, the count is \u201capproximately 3,046,\u201d McGinley said in his court filing.<\/p>\n<p style=\"text-align: justify;\">Back in 2006, public defenders and county officials warned that the delays under Hadi imperiled vulnerable inmates prone to self-harm. Lawsuits against DCF multiplied. At least one judge in North Florida threatened to deliver a mentally sick inmate directly to Hadi\u2019s office if DCF didn\u2019t pick them up from a local jail.<\/p>\n<p style=\"text-align: justify;\">Then-Gov. <strong>Jeb Bush<\/strong> immediately criticized Parnell\u2019s fine as activistic and counterproductive. The next day, however, <strong><a href=\"https:\/\/www.orlandosentinel.com\/2006\/12\/02\/dcf-leader-retires-amid-controversy-2\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">Hadi announced her resignation<\/a><\/strong>. She insisted her departure was unrelated to the controversy.<\/p>\n<p style=\"text-align: justify;\">Fast forward two decades, and the situation has grown grimmer at the agency now helmed by Secretary <strong>Taylor Hatch<\/strong>, who <strong><a href=\"https:\/\/floridapolitics.com\/archives\/723020-gov-desantis-appoints-shevaun-harris-and-taylor-hatch-to-new-roles\/\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">came to the job in February<\/a><\/strong> after leading Florida\u2019s Agency for Persons with Disabilities. Her predecessor, <strong>Shevaun Harris<\/strong>, led DCF for four years and now runs the Agency for Health Care Administration. She replaced <strong>Chad Poppell<\/strong>, who <strong><a href=\"https:\/\/mynews13.com\/fl\/orlando\/news\/2021\/02\/05\/florida-s-dcf-secretary-poppell-resigns--desantis-moves-agency-heads#:~:text=Shevaun%20Harris%2C%20the%20acting%20secretary%20of%20the,Care%20Administration%2C%20will%20now%20take%20over%20DCF.\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">stepped down in February 2021<\/a><\/strong>.<\/p>\n<p style=\"text-align: justify;\">In March 2024, DeSantis\u00a0<a href=\"https:\/\/floridapolitics.com\/archives\/664883-legislature-sends-live-healthy-bills-to-gov-desantis\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-wpel-link=\"internal\"><strong>signed<\/strong><\/a>\u00a0the\u00a0<a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2024\/330\" target=\"_blank\" rel=\"noopener external noreferrer nofollow\" data-wpel-link=\"external\"><strong>Behavioral Health Teaching Hospitals Act<\/strong><\/a><strong>\u00a0<\/strong>by Republican Sen.\u00a0<strong>Jim Boyd\u00a0<\/strong>and Republican Rep.\u00a0<strong>Sam Garrison<\/strong>, which, among other things, required that DCF study the capacity of its behavioral health facilities.\u00a0The resulting <strong><a href=\"https:\/\/img1.wsimg.com\/blobby\/go\/04dad2ad-e4b1-42e4-b8b4-42d4f2bb4407\/Behavioral%20Health%20Gap%20Analysis%20-%20SB%20330%20Analys.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">67-page report<\/a><\/strong>, delivered in January, projected that the supply and demand gap for beds at Florida\u2019s mental treatment facilities will widen at a rate notably faster than the state\u2019s population growth.<\/p>\n<p style=\"text-align: justify;\">Analysts at Miami accounting firm <strong><a href=\"https:\/\/www.ey.com\/en_us\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">Ernst &amp; Young<\/a><\/strong>, which prepared the report, said Florida\u2019s mental health treatment facilities \u201care continuously seeing elevated levels of waitlists for civic and forensic beds.\u201d<\/p>\n<p style=\"text-align: justify;\">\u201cTo maintain the current occupancy rate of 98%, state mental health treatment facilities would need to add at least 1,602 additional forensic beds within the next five years to meet demand,\u201d the report said. \u201cIf the state mental health treatment facilities maintain the industry standard occupancy rate of 85%, the forensic beds gap is projected to be even higher (2,034) by 2029.\u201d<\/p>\n<p><a href=\"https:\/\/floridapolitics.com\/wp-content\/uploads\/2025\/08\/Forensic-bed-gap-Ernst-Young-Florida-.png\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-752879\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/08\/Forensic-bed-gap-Ernst-Young-Florida--640x453.png\" alt=\"\" width=\"640\" height=\"453\"  \/><\/a>Image via State of Florida Behavioral Health Gap Analysis, Ernst &amp; Young, Jan. 31, 2025.<\/p>\n<p style=\"text-align: justify;\">Denying unstable inmates proper and prompt treatment can be the difference between life and death. Such was the case with <strong>Tristin Murphy<\/strong>, a 37-year-old Charlotte County man with schizophrenia who <strong><a href=\"https:\/\/www.cbsnews.com\/miami\/news\/new-documentary-warehoused-the-life-and-death-of-tristin-murphy-premieres-today\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">killed himself with a chainsaw<\/a><\/strong> in 2021 after 63 days in prison on a felony littering charge.<\/p>\n<p style=\"text-align: justify;\">Some incidents were non-lethal but left permanent damage. Inmates suffering from psychotic breaks in Colorado and Texas <strong><a href=\"https:\/\/www.wfla.com\/top-videos\/man-sues-sheriff-after-gouging-out-own-eyes-during-psychotic-episode-behind-bars\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">gouged out<\/a><\/strong> <strong><a href=\"https:\/\/www.newsweek.com\/texas-prisoner-uses-plastic-spoon-gouge-out-his-eye-sues-prison-understaffing-1449889?utm_source=chatgpt.com\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">their eyes<\/a><\/strong>. In 2019, a man <strong><a href=\"https:\/\/wsvn.com\/news\/investigations\/isolated-and-mentally-ill-inmate-cuts-off-his-own-penis-flushes-it-down-toilet-inside-broward-jail\/?utm_source=chatgpt.com\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">cut off his penis<\/a><\/strong> and flushed it down a Broward County jail toilet while in solitary confinement. A Tennessee man <strong><a href=\"https:\/\/apnews.com\/article\/tennessee-nashville-treatment-of-prisoners-ae59370b285f94377246304c5f5618c7\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">did similarly<\/a><\/strong> in 2022.<\/p>\n<p style=\"text-align: justify;\">Murphy\u2019s tragedy led to legislative action. An <strong><a href=\"https:\/\/floridapolitics.com\/archives\/744935-gov-desantis-signs-tristin-murphy-act-to-ensure-mental-health-treatment-for-detainees\/\" data-wpel-link=\"internal\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">eponymous law<\/a><\/strong> this year by Republican Sen. <strong>Jennifer Bradley<\/strong>, Republican Rep. <strong>Nan Cobb <\/strong>and Democratic Rep. <strong>Dan Daley<\/strong>\u00a0expanded probation and diversion options for mentally ill defendants while tightening mental health safeguards around inmate work assignments.<\/p>\n<p style=\"text-align: justify;\">\u201cThe intersection between mental health and our criminal justice system is a very dangerous place for people to be,\u201d Bradley said on the Senate floor in April. \u201cJails and prisons in Florida struggle with how to manage our mentally ill population, which is where most of our mentally ill are now, in our jails and prisons.\u201d<\/p>\n<p style=\"text-align: justify;\"><strong>Gayle Giese<\/strong>, President of the <strong><a href=\"https:\/\/flmhac.org\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">Florida Mental Health Advocacy Coalition<\/a><\/strong>, praised lawmakers for passing the Tristan Murphy Act. But she said more must be done, recalling the anguish a member of her group endured trying to get her mentally ill daughter moved from a county jail to a treatment center after being judged incompetent to stand trial.<\/p>\n<p style=\"text-align: justify;\">\u201cIt took seven months of waiting for a bed,\u201d she said. \u201cWhile people with a mental illness sit in jail, they become more traumatized and their whole health declines.\u201d<\/p>\n<p style=\"text-align: justify;\"><strong>\u2018This is a systemic, national issue\u2019<\/strong><\/p>\n<p style=\"text-align: justify;\">Wright, a South Florida native who served a 17-year prison sentence in Washington and began publishing <strong><a href=\"https:\/\/www.prisonlegalnews.org\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">Prison Legal News<\/a> <\/strong>in 1990, said states failing to move psychologically unwell inmates to treatment facilities within the legally required timeframe is unfortunately common, and it\u2019s led to numerous successful class-action lawsuits.<\/p>\n<p style=\"text-align: justify;\">\u201cThis is a systemic, national issue,\u201d he said. \u201cPeople are sitting in jail for weeks, months, even years, where they\u2019re incompetent to stand trial but haven\u2019t been moved. They\u2019re in this kind of limbo.\u201d<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-752966\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/08\/Screenshot-2025-08-24-143912-640x523.png\" alt=\"\" width=\"640\" height=\"523\"  \/>(L-R) Sen. Image via Florida Senate.<\/p>\n<p style=\"text-align: justify;\">In 2023, a federal court <strong><a href=\"https:\/\/www.prisonlegalnews.org\/news\/2025\/jun\/1\/washingtons-continuing-competency-crisis-strains-jails\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">fined the state of Washington $100 million<\/a><\/strong> for violating inmates\u2019 due process rights by delaying competency services and failing to add enough mental health treatment facility beds.<\/p>\n<p style=\"text-align: justify;\">Three years earlier, a federal court approved a <strong><a href=\"https:\/\/clearinghouse-umich-production.s3.amazonaws.com\/media\/doc\/111835.pdf?utm_source=chatgpt.com\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">$650,000 class-action settlement<\/a><\/strong> for plaintiffs in a comparable California case. In California\u2019s Contra Costa County, a Judge fined the Department of State Hospitals <strong><a href=\"https:\/\/www.prisonlegalnews.org\/news\/2018\/jun\/5\/mentally-incompetent-detainees-stuck-california-jails-spark-class-action-lawsuit-fines\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">$17,400 for similar violations<\/a><\/strong>.<\/p>\n<p style=\"text-align: justify;\">Other litigation over the same issue led to a judge holding state officials <strong><a href=\"https:\/\/www.prisonlegalnews.org\/news\/2018\/jun\/5\/crisis-maryland-mentally-incompetent-defendants-languish-county-jails\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">in contempt<\/a><\/strong> in Maryland, a non-monetary settlement with plaintiffs that <strong><a href=\"https:\/\/www.prisonlegalnews.org\/news\/2018\/jan\/8\/utah-settles-federal-suit-alleging-delays-competency-treatment-pre-trial-detainees\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">required reforms in Utah<\/a><\/strong> and a <strong><a href=\"https:\/\/www.prisonlegalnews.org\/news\/2013\/nov\/15\/minnesota-judge-condemns-system-that-jails-mentally-ill\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">judicial censure<\/a><\/strong> in Minnesota.<\/p>\n<p style=\"text-align: justify;\">Wright noted there\u2019s a \u201cfairly high bar\u201d to be determined mentally unfit to proceed in a criminal case. In Florida, under <strong><a href=\"http:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0900-0999\/0916\/0916ContentsIndex.html\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">Statute 916<\/a> <\/strong>and <strong><a href=\"https:\/\/codes.findlaw.com\/fl\/florida-rules-of-criminal-procedure\/fl-st-rcrp-rule-3-212\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer nofollow\">Rule 3.212 of Criminal Procedure<\/a><\/strong>, defendants must undergo evaluations by at least two mental health experts if the judge or lawyers from either side raise concerns.<\/p>\n<p style=\"text-align: justify;\">The experts, trained to test for feigned incompetence \u2014 malingering, in legal terms \u2014 evaluate the defendant\u2019s mental state. They review records and submit reports addressing statutory factors, including the defendant\u2019s ability to testify, grasp key aspects of the legal process, communicate with their attorneys and make rational decisions about their defense.<\/p>\n<p style=\"text-align: justify;\">Only after that does the judge decide whether the defendant is competent.<\/p>\n<p style=\"text-align: justify;\">\u201cTo be found incapable of assisting in your own defense or unable to understand the case, you\u2019re either very disabled or mentally ill,\u201d Wright said. \u201cThese aren\u2019t borderline cases.\u201d<\/p>\n<p style=\"text-align: justify;\">Which leaves Florida, through DCF, conspicuously exposed to legal action, he said.<\/p>\n<p style=\"text-align: justify;\">\u201cI\u2019m not aware of anyone losing these kinds of cases, because the facts are generally pretty clear, pretty obvious. These aren\u2019t marginal cases, and the states are pretty egregious with them,\u201d he said. \u201cI\u2019d say it\u2019s probably just a matter of time before a case like this gets filed.\u201d<\/p>\n<p style=\"text-align: justify;\">Florida Politics contacted DCF for comment and information with a two-day deadline to respond.
