{"id":17777,"date":"2025-06-27T01:26:15","date_gmt":"2025-06-27T01:26:15","guid":{"rendered":"https:\/\/www.europesays.com\/us\/17777\/"},"modified":"2025-06-27T01:26:15","modified_gmt":"2025-06-27T01:26:15","slug":"senate-parliamentarian-elizabeth-macdonough-faces-gop-ire-over-tax-bill","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/17777\/","title":{"rendered":"Senate parliamentarian Elizabeth MacDonough faces GOP ire over tax bill"},"content":{"rendered":"<p>WASHINGTON (AP) \u2014 A few Republicans reacted with indignation Thursday after the Senate parliamentarian <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-big-bill-hospital-provider-tax-f6f4343bbc9c9a279bd7861c2e5c1b7b\" target=\"_blank\" rel=\"noopener\">advised<\/a> that some of the measures in their tax and immigration bill could not be included in the legislation.<\/p>\n<p>Sen. Tommy Tuberville, R-Ala., tweeted on X that Senate Parliamentarian Elizabeth MacDonough should be fired, \u201cASAP.\u201d Rep. Greg Steube, R-Fla., intimated that she was partisan, asking why an \u201cunelected swamp bureaucrat, who was appointed by Harry Reid over a decade ago\u201d gets to decide what\u2019s in the bill?\u201d<\/p>\n<p>It\u2019s hardly the first time the parliamentarian\u2019s normally low-key and lawyerly role has drawn a blast of public criticism. <\/p>\n<p>MacDonough also <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/gop-rally-against-democrat-virus-relief-225cea9a0247f6a0f01ca5f1d2216350\" target=\"_blank\" rel=\"noopener\">dashed<\/a> Democratic plans over the years, advising in 2021 that they couldn\u2019t include a minimum wage increase in their COVID-19 relief bill. Later that same year, she <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/immigration-joe-biden-environment-congress-602f28de740c46839864da55b3af100b\" target=\"_blank\" rel=\"noopener\">advised<\/a> that Democrats needed to drop an effort to let millions of immigrants remain temporarily in the U.S. as part of their big climate bill. <\/p>\n<p>But the attention falling on MacDonough\u2019s rulings in recent years also reflects a broader change in Congress, with lawmakers increasingly trying to wedge their top policy priorities into bills that can\u2019t be filibustered in the Senate. The process comes with special rules designed to deter provisions unrelated to spending or taxes \u2014 and that\u2019s where the parliamentarian comes in, offering analysis of what does and doesn\u2019t qualify. <\/p>\n<p>Her latest round of decisions Thursday was a blow to the GOP\u2019s efforts to wring hundreds of billions of dollars from Medicaid over the next decade. Senate Republicans could opt to try to override her recommendations, but they are unlikely to do so. <\/p>\n<p>Here\u2019s a closer look at what the Senate parliamentarian does and why lawmakers are so focused on her recommendations right now.<\/p>\n<p>The crucial role of the parliamentarian<\/p>\n<p>Both the House and Senate have a parliamentarian to provide assistance on that chamber\u2019s rules and precedents. They are often seen advising whoever is presiding over the chamber on the proper procedures to be followed and the appropriate responses to a parliamentary inquiry.<\/p>\n<p>They are also charged with providing information to lawmakers and their respective staff on a strictly nonpartisan and confidential basis. <\/p>\n<p>The parliamentarians and their staff only offer advice. Their recommendations are not binding. In the case of the massive tax and spending bill now before both chambers, the parliamentarian plays a critical role in advising whether the reconciliation bill\u2019s provisions remain focused on fiscal issues. <\/p>\n<p>How MacDonough became the first woman in the job<\/p>\n<p>MacDonough, an English literature major, is the Senate\u2019s <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/bills-impeachments-bernie-sanders-electoral-college-minimum-wage-8893a3f95038cac51ba66066554bcd20\" target=\"_blank\" rel=\"noopener\">first woman<\/a> to be parliamentarian and just the sixth person to hold the position since its creation in 1935. <\/p>\n<p>She began her Senate career in its library before leaving to get a law degree at Vermont Law School. She worked briefly as a Justice Department trial attorney before returning to the Senate in 1999, this time as an assistant in the parliamentarian\u2019s office. She was initially appointed parliamentarian in 2012 by Democrat Harry Reid of Nevada, Senate majority leader at the time. She was retained by Sen. Mitch McConnell, R-Ky., when he became majority leader in 2015.<\/p>\n<p>She helped Chief Justice John Roberts preside over Trump\u2019s 2020 Senate impeachment trial and was beside then-Sen. Patrick Leahy, D-Vt., for Trump\u2019s second trial the following year. Trump was acquitted both times.<\/p>\n<p>When Trump supporters fought past police and into the Capitol in hopes of disrupting Congress\u2019 certification of Joe Biden\u2019s Electoral College victory, MacDonough and other staffers rescued those ballots and hustled mahogany boxes containing them to safety. MacDonough\u2019s office, on the Capitol\u2019s first floor, was ransacked and declared a crime scene.<\/p>\n<p>Can the Senate ignore the parliamentarian\u2019s advice?<\/p>\n<p>Yes. The parliamentarian makes the recommendation, but it\u2019s the presiding officer overseeing Senate proceedings who rules on provisions in the bill. If there is a dispute, it would be put to a vote.<\/p>\n<p>Michael Thorning, director of structural democracy at the Bipartisan Policy Center, a think tank, said he doubts Republicans will want to go that route. And indeed, some Republican senators said as much Thursday.<\/p>\n<p>\u201cIt\u2019s the institutional integrity, even if I\u2019m convinced 100% she\u2019s wrong,\u201d said Sen. Kevin Cramer, R-N.D.<\/p>\n<p>Thorning said lawmakers from both parties view MacDonough as \u201cvery much an honest broker.\u201d<\/p>\n<p>\u201cAnd the Senate relies on her,\u201d Thorning said. \u201cSometimes, those decisions cut your way, and sometimes, they don\u2019t. I also think members recognize that once you start treating the parliamentarian\u2019s advice as just something that could be easily dismissed, then the rules start to matter less.\u201d<\/p>\n<p>Have parliamentarians been fired?<\/p>\n<p>Majority leaders from both parties have replaced the parliamentarian. For more than three decades, the position alternated between Robert Dove and Alan Frumin depending upon which party was in the majority.<\/p>\n<p>Thorning said the two parliamentarians weren\u2019t far apart though, in how they interpreted the Senate\u2019s rules and precedents.<\/p>\n<p>MacDonough succeeded Frumin as parliamentarian.
