{"id":179344,"date":"2025-08-27T09:19:11","date_gmt":"2025-08-27T09:19:11","guid":{"rendered":"https:\/\/www.europesays.com\/us\/179344\/"},"modified":"2025-08-27T09:19:11","modified_gmt":"2025-08-27T09:19:11","slug":"morning-report-that-damn-dam-is-bringing-the-city-more-dam-trouble","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/179344\/","title":{"rendered":"Morning Report: That Damn Dam Is Bringing the City More Dam Trouble"},"content":{"rendered":"<p>A sand mining company recently hit the city of San Diego with a lawsuit alleging the release of six billion gallons of water from the El Capitan Dam and Reservoir in 2023 \u201cwithout notice\u201d stymied plans for its Lakeside property.<\/p>\n<p>Our Tigist Layne reveals that the El Monte Nature Preserve \u2013 represented by an attorney who once led a notorious legal fight against the city that spanned two decades \u2013 is demanding $300 million from the city, citing damages and negligence.<\/p>\n<p><strong>The original plan:<\/strong> The company hoped to extract sand and, after it was done, turn the area into a nature preserve. In its lawsuit, the company argues it can no longer extract sand from the property because there\u2019s now too much water below it. And the city bars sand mining below the water table.<\/p>\n<p>The city is denying those claims and is set to face the company in court later this year.<\/p>\n<p><a href=\"https:\/\/voiceofsandiego.org\/2025\/08\/27\/san-diego-is-getting-sued-because-of-one-of-its-troubled-dams\/\" rel=\"nofollow noopener\" target=\"_blank\"><strong>Read the full story here.<\/strong><\/a><\/p>\n<p><strong>Flashback<\/strong>: Lawyer Vincent Bartolotta is leading this lawsuit. It has been almost exactly 10 years since the city of San Diego <a href=\"https:\/\/www.kpbs.org\/news\/politics\/2015\/11\/17\/san-diego-settles-lawsuit-otay-mesa-developer\" rel=\"nofollow noopener\" target=\"_blank\">settled<\/a> the infamous Border Business Park lawsuit Bartolotta led on behalf of landowner, and later presidential candidate, Roque de la Fuente. <\/p>\n<p><strong>The Plan to Save Sunset Cliffs<\/strong><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/08\/1756286351_325_DSC04838-1-1024x683.jpg\" alt=\"Sunset Cliffs on Dec. 28, 2023.\" class=\"wp-image-727047\"  \/>Sunset Cliffs on Dec. 28, 2023. \/ Photo by Ariana Drehsler <\/p>\n<p>The city of San Diego is on a mission to preserve Sunset Cliffs as one of the region\u2019s most beloved destinations.<\/p>\n<p>Our MacKenzie Elmer reveals the city has a plan to save the already erosion-plagued cliffs from sea level rise. The plan calls for the removal of parking now on the cliff\u2019s edge, a switch to one-way traffic for Sunset Cliffs Boulevard at Monaco Street and a protected walkway.<\/p>\n<p>Elmer also notes that the city could potentially add parking meters along Sunset Cliffs Boulevard.<\/p>\n<p><strong>What\u2019s next: <\/strong>Elmer reports that the City Council\u2019s Environment Committee forwarded the plan to the full City Council at its June meeting. The Council is set to vote on the plan soon.<\/p>\n<p><a href=\"https:\/\/voiceofsandiego.org\/2025\/08\/26\/how-the-city-will-save-sunset-cliffs-from-sea-level-rise\/\" rel=\"nofollow noopener\" target=\"_blank\"><strong>Read more about the city\u2019s plans here.<\/strong><\/a><\/p>\n<p><strong>County Supes Vote to Tap Reserves \u2013 But Can\u2019t Yet<\/strong><\/p>\n<p>Democrats on the county Board of Supervisors took an initial vote Tuesday to <a href=\"https:\/\/voiceofsandiego.org\/2025\/08\/22\/county-dems-will-need-a-republican-vote-to-respond-to-federal-cuts\/\" rel=\"nofollow noopener\" target=\"_blank\">unleash the county\u2019s massive reserve fund<\/a> to combat federal cuts.<\/p>\n<p><strong>Crucial context: <\/strong>The board\u2019s 3-2 vote, opposed by both Republicans on the board, won\u2019t allow the county to dip into its reserve account immediately.<\/p>\n<p>First, the board will need to take a second vote on Sept. 9. The policy change will take effect 30 days later.<\/p>\n<p>Soon after the early October effective date, county officials expect to ask supervisors to sign off on using newly unlocked reserve funds to cover millions of dollars in bonuses for county employees. (ICYMI, our Lisa Halverstadt previously revealed that county labor deals <a href=\"https:\/\/voiceofsandiego.org\/2025\/08\/25\/if-county-dips-into-reserves-millions-would-go-to-employee-bonuses\/\" rel=\"nofollow noopener\" target=\"_blank\">called for bonuses backed by reserve funds<\/a> if supervisors voted to update the county\u2019s reserve policy.)<\/p>\n<p><strong>About those other reserve plans: <\/strong>County Board Chair Terra Lawson-Remer estimates that the updated reserve policy could unlock up to $95 million annually in the next few years to help the county address federal policy hits and economic calamities. But to unlock that cash, Lawson-Remer and other Democrats on the board will <a href=\"https:\/\/voiceofsandiego.org\/2025\/08\/22\/county-dems-will-need-a-republican-vote-to-respond-to-federal-cuts\/\" rel=\"nofollow noopener\" target=\"_blank\">need a Republican ally<\/a>. State law requires a four-fifths vote to redirect funds outside the county\u2019s budget process. It\u2019s unclear whether they\u2019ll have an ally.<\/p>\n<p><a href=\"https:\/\/voiceofsandiego.org\/2025\/08\/26\/county-supes-vote-to-tap-reserves-but-cant-yet\/\" rel=\"nofollow noopener\" target=\"_blank\"><strong>Read more here.<\/strong><\/a><\/p>\n<p><strong>Lawsuit: City\u2019s Safe Camping Sites Are Uninhabitable<\/strong><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/08\/O-Lot_0017-1024x683.jpg\" alt=\"\" class=\"wp-image-730185\"  \/>The O Lot Safe Sleeping site at Balboa Park on April 9, 2024. \/ Ariana Drehsler for Voice of San Diego<\/p>\n<p>Eight homeless people staying at the city of San Diego\u2019s safe campsites are accusing the city of allowing uninhabitable conditions at its sites. They filed a lawsuit on Monday.\u00a0<\/p>\n<p>According to the lawsuit, the city\u2019s two safe camping sites are infested with rats and lack appropriate shade and shelter. They also claim that the food provided is inadequate and undercooked.\u00a0<\/p>\n<p>The two providers who operate the lots, Dreams for Change and the Downtown San Diego Partnership, are also named in the suit.\u00a0<\/p>\n<p>\u201cThe conditions are deplorable,\u201d said Laura Zaleta, a 59-year-old staying at the 20th and B lot. \u201cAt times I felt safer sleeping on the streets than here.\u201d\u00a0<\/p>\n<p>The City Attorney\u2019s Office declined to comment.<\/p>\n<p>\u201cThe safety and wellbeing of individuals served through the Safe Sleeping Program has, and always will be, the top priority,\u201d wrote Matt Hoffman, a city spokesperson in a statement. The Union-Tribune <a href=\"https:\/\/www.sandiegouniontribune.com\/2025\/08\/20\/supervisor-monica-montgomery-steppe-wants-to-end-use-of-pepper-spray-in-juvenile-halls\/\" rel=\"nofollow noopener\" target=\"_blank\">recently wrote<\/a> about Montgomery Steppe\u2019s proposals.\u00a0<\/li>\n<li><strong>In other county criminal justice news: <\/strong>Earlier this week, the Union-Tribune <a href=\"https:\/\/www.sandiegouniontribune.com\/2025\/08\/24\/facing-heightened-scrutiny-sheriff-proposes-third-party-review-of-jail-healthcare-but-its-model-has-a-problem\/\" rel=\"nofollow noopener\" target=\"_blank\">spotlighted Sheriff Kelly Martinez\u2019s recent memo <\/a>urging supervisors to consider a new jail oversight model pointing to a model Los Angeles program that the U-T found doesn\u2019t exist. Martinez argued against expanding the purview of the Citizens\u2019 Law Enforcement Review Board.
