{"id":181208,"date":"2025-08-28T01:40:11","date_gmt":"2025-08-28T01:40:11","guid":{"rendered":"https:\/\/www.europesays.com\/us\/181208\/"},"modified":"2025-08-28T01:40:11","modified_gmt":"2025-08-28T01:40:11","slug":"american-dream-mall-faces-lawsuit-over-sunday-shopping-in-new-jersey","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/181208\/","title":{"rendered":"American Dream mall faces lawsuit over Sunday shopping in New Jersey"},"content":{"rendered":"<p>On any given Sunday, <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/df93ca8371994f7eb6344dde322b2de2\" target=\"_blank\" rel=\"noopener\">the massive American Dream mall<\/a> in New Jersey allows visitors to hit an indoor ski slope, surf an artificial wave, ride roller coasters \u2014 or shop for a new outfit at dozens of big-name retail stores.<\/p>\n<p>One of those things is a problem, argues a new lawsuit against the massive entertainment and retail complex in East Rutherford \u2013 and it isn\u2019t the thrillseekers. <\/p>\n<p>American Dream, the suit from officials in nearby Paramus contends, is running afoul of a county law that has long prohibited the sale of nonessential items such as clothing, appliances and furniture on Sundays.<\/p>\n<p>Such \u201cblue laws\u201d date back centuries in New Jersey and were originally rooted in religion. But modern proponents say they offer a welcome break for locals from traffic and noise in a region near New York City that\u2019s teeming with shoppers throughout the week.<\/p>\n<p>Officials in Paramus, a major shopping hub that boasts three large malls and miles of strip malls, say nearly every other retail store in the county is closed to shoppers on Sundays.<\/p>\n<p>That was originally the plan for American Dream when it opened in 2019, adjacent to MetLife Stadium, where the NFL\u2019s Jets and Giants play. Retail stores would close on Sunday, while the theme parks in the mall would remain open \u2014 but a report by <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.northjersey.com\/story\/news\/business\/2025\/01\/17\/american-dream-mall-open-sunday-bergen-blue-laws\/77770838007\/\" target=\"_blank\" rel=\"noopener\">NorthJersey.com in January<\/a> says retailers there had also been opening their doors the extra day for nearly a year.<\/p>\n<p>\u201cThese businesses, with the encouragement and support of the mall\u2019s ownership and the acquiescence of the other defendants here, have violated the law hundreds if not thousands of times since January,\u201d argues the lawsuit filed in state Superior Court.<\/p>\n<p>A statement from American Dream argued that Bergen County\u2019s blue laws don\u2019t apply to the complex, because it sits on state-owned property.<\/p>\n<p>\u201cThe lawsuit is a meritless political stunt driven by private competitors\u2019 interests,\u201d the statement says.<\/p>\n<p>But Paramus Mayor Christopher DiPiazza said that American Dream had \u201cpromised on record\u201d that it would follow the county\u2019s blue laws once it opened.<\/p>\n<p>A <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.nj.gov\/dep\/docs\/american-dream-final-hearing-officers-report201206.pdf\" target=\"_blank\" rel=\"noopener\">transcript<\/a> from a 2011 public hearing shows Tony Armlin, then the vice president of development and construction for mall owner Triple Five, saying the laws \u201cprohibit our ability to have retail activities on Sundays,\u201d which he said would restrict the impact of traffic.<\/p>\n<p>Jim Tedesco, the executive of Bergen County \u2014 which is also named in the suit \u2014 said in a statement American Dream\u2019s operators had \u201cpersonally assured\u201d him that they would keep retailers shut on Sunday before the mall opened.<\/p>\n<p>\u201cThey broke that promise,\u201d he said. \u201cTheir decision to operate retail on Sundays not only violates state statute, it gives them an unfair advantage over every other business in Bergen County that is following the law.\u201d<\/p>\n<p>The suit also names East Rutherford, whose mayor did not return a request for comment, and the New Jersey Sports and Exposition Authority. The NJSEA and the state attorney general\u2019s office declined comment because they don\u2019t discuss pending litigation.<\/p>\n<p>New Jersey\u2019s blue laws initially were far stricter and enforced statewide.
