{"id":182385,"date":"2025-08-28T12:18:31","date_gmt":"2025-08-28T12:18:31","guid":{"rendered":"https:\/\/www.europesays.com\/us\/182385\/"},"modified":"2025-08-28T12:18:31","modified_gmt":"2025-08-28T12:18:31","slug":"judge-extends-restraining-order-limiting-capacity-in-ices-manhattan-lockup","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/182385\/","title":{"rendered":"Judge Extends Restraining Order Limiting Capacity in ICE\u2019s Manhattan Lockup"},"content":{"rendered":"<p>A federal judge <a href=\"https:\/\/www.courtlistener.com\/docket\/71065570\/88\/barco-mercado-v-noem\/\" rel=\"nofollow noopener\" target=\"_blank\">has extended<\/a> a temporary restraining order that was set to expire this week that dramatically limits the number of people immigration enforcement can hold inside its detention area on the 10th floor of 26 Federal Plaza.\u00a0<\/p>\n<p>The order \u2014 which mandates basic sanitary conditions inside the Immigration and Customs Enforcement\u00a0 lockup and dramatically limits the capacity there \u2014 is now in place through Sept. 9.\u00a0<\/p>\n<p>Spokespeople for the Department of Homeland Security and ICE didn\u2019t immediately return a request for comment on the order.\u00a0<\/p>\n<p>Since Judge Lewis A. Kaplan issued his original order on <a href=\"https:\/\/www.thecity.nyc\/2025\/08\/12\/judge-trump-federal-immigration-restraining-order-ice\/\" rel=\"nofollow noopener\" target=\"_blank\">Aug. 12<\/a>, attorneys and advocates have observed a dip in ICE arrests inside immigration courthouses. That may be partially related to the restraining order, and also separately due to <a href=\"https:\/\/www.thecity.nyc\/2025\/08\/15\/arrests-down-immigration-court-no-shows\/\" rel=\"nofollow noopener\" target=\"_blank\">fewer people showing up to court<\/a> out of fear they\u2019ll be detained, THE CITY\u2019s reporting has found.\u00a0<\/p>\n<p>Kaplan\u2019s order came after months of <a href=\"https:\/\/www.thecity.nyc\/2025\/07\/22\/video-26-federal-plaza-immigration-ice-dhs-cells\/\" rel=\"nofollow noopener\" target=\"_blank\">mounting concerns<\/a> about overcrowding, limited food and unsanitary conditions at the Manhattan facility. Those issues coincided with ICE arrests shooting through the roof in <a href=\"https:\/\/www.thecity.nyc\/2025\/07\/14\/ice-migrant-arrests-trump-administration-deportations-data\/\" rel=\"nofollow noopener\" target=\"_blank\">late May,<\/a> and a surge in the number of people and the length of time they were spending inside 10th floor holding cells. The immigrant advocacy group Make the Road New York, the ACLU and the NYCLU sued on Aug. 8 imploring a federal judge to step in.\u00a0<\/p>\n<p>In an <a href=\"https:\/\/www.courtlistener.com\/docket\/71065570\/74\/barco-mercado-v-noem\/\" rel=\"nofollow noopener\" target=\"_blank\">Aug. 18 memo<\/a> opposing the judge\u2019s order, Nancy Zanello, the New York assistant field office director of ICE\u2019s Enforcement and Removal Operations wrote that at that time just eight people were being held on the 10th floor.\u00a0<\/p>\n<p>She also said that if Kaplan\u2019s order remains requiring 50 square feet of personal space per person, at least eight feet away from a toilet, ICE could keep just 22 people at once across the 10th floor\u2019s four holding areas.\u00a0<\/p>\n<p>As <a href=\"https:\/\/www.thecity.nyc\/2025\/08\/12\/judge-trump-federal-immigration-restraining-order-ice\/\" rel=\"nofollow noopener\" target=\"_blank\">THE CITY previously reported<\/a>, far more people than that were held on any given night during the months of June and July. There were regularly more than a 100 people staying there, ICE\u2019s own internal detention data show, and on the evening of June 5 that peaked at 180 people.
