{"id":183097,"date":"2025-08-28T20:56:27","date_gmt":"2025-08-28T20:56:27","guid":{"rendered":"https:\/\/www.europesays.com\/us\/183097\/"},"modified":"2025-08-28T20:56:27","modified_gmt":"2025-08-28T20:56:27","slug":"l-a-teen-is-moved-out-of-state-by-ice-without-parents-knowledge","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/183097\/","title":{"rendered":"L.A. teen is moved out of state by ICE without parents&#8217; knowledge"},"content":{"rendered":"\n<p>Benjamin Guerrero-Cruz\u2019s family was stunned and heartbroken when the 18-year-old was <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2025-08-14\/an-l-a-area-high-school-senior-was-walking-his-dog-then-ice-agents-grabbed-him\" target=\"_blank\" rel=\"noopener\">grabbed by immigration agents<\/a> while walking his dog in Van Nuys just days before he was set to start his senior year at Reseda Charter High School.<\/p>\n<p>This week, his family was caught off guard once again when it learned that Immigration and Customs Enforcement had transferred him to Arizona without notifying any relatives, according to the office of U.S. Rep. Luz Rivas (D-North Hollywood), which spoke to his family and reviewed ICE detention records. <\/p>\n<p>Guerrero-Cruz was moved out of the Adelanto Detention Facility in San Bernardino County late Monday night and taken to a holding facility in Arizona in the middle of the desert, according to the congresswoman\u2019s office. <\/p>\n<p>On Tuesday night, he was scheduled to be transferred to Louisiana, a <a class=\"link\" href=\"https:\/\/www.nytimes.com\/interactive\/2025\/07\/31\/us\/ice-deportation-hub-alexandria-louisiana.html\" target=\"_blank\" rel=\"noopener\">major hub for deportation flights<\/a>, but at the last minute he was taken off the plane and sent back to Adelanto, where he is currently being held. <\/p>\n<p>\u201cBenjamin and his family deserve answers behind ICE\u2019s inconsistent and chaotic decision-making process, including why Benjamin was initially transferred to Arizona, why he was slated to be transferred to Louisiana afterward, and why his family wasn\u2019t notified of his whereabouts by ICE throughout this process,\u201d Rivas said in a statement. <\/p>\n<p>A Department of Homeland Security official said in a statement that Guerrero-Cruz was being staged for removal this week but was then transferred back to Adelanto for immigration proceedings. The unnamed official noted that Guerrero-Cruz, a Chilean national, was arrested on Aug. 8 for overstaying his visa, which required him to leave the United States on March 15, 2023.<\/p>\n<p>On Tuesday, Rivas <a class=\"link\" href=\"https:\/\/rivas.house.gov\/media\/press-releases\/congresswoman-luz-rivas-introduces-immigration-bill-after-constituent\" target=\"_blank\" rel=\"noopener\">introduced a bill<\/a> that would require ICE to notify an immediate family member of a detainee within 24 hours of a detainee\u2019s transfer. Currently, ICE is required to notify a family member only in the case of a detainee\u2019s death. <\/p>\n<p>\u201cBenjamin\u2019s story of being detained and sent across state lines without warning or notification is like many other detainees in Los Angeles and across the country,\u201d Rivas said. \u201cMany immigrant families in my district do not know the whereabouts of their loved ones after they are detained by ICE.\u201d<\/p>\n<p>In a statement, the Homeland Security official condemned the \u201cmessaging bill\u201d as a \u201cclear attempt to demonize our brave ICE law enforcement \u2014 who are already facing a 1000% increase in assaults against them \u2014 for clicks and fundraising emails.\u201d <\/p>\n<p>\u201cClaims that transfers of detainees are being \u2018weaponized\u2019 or \u2018hidden\u2019 are also categorically false,\u201d the official added. The official said detainees and attorneys are notified about a transfer and can contact their family at any time. Families can also use <a class=\"link\" href=\"https:\/\/locator.ice.gov\/odls\/#\/search\" target=\"_blank\" rel=\"noopener\">ICE\u2019s Online Detainee Locator<\/a>, the official said. <\/p>\n<p>Susham M. Modi, an immigration attorney based in Houston, said that in practice it is not so simple for family members to learn about a transfer.<\/p>\n<p>In his experience, there is a significant lag in Homeland Security uploading forms to immigration court to notify attorneys of a detainee transfer. In one instance, he didn\u2019t receive the form until after his client had prevailed in an immigration case and been released from detention, he said. <\/p>\n<p>Although families can use ICE\u2019s online locator to search for loved ones, it isn\u2019t always up to date, and some families do not know how to use it, Modi said. When detainees are transferred, they often can\u2019t make outgoing calls from the detention facility until someone has deposited money into their account \u2014 which family members can\u2019t do if they aren\u2019t aware of the transfer, he added. <\/p>\n<p>            <img class=\"image\" alt=\"Benjamin Guerrero-Cruz, shown at school, is an avid soccer player and loving older brother, according to his family.\"   width=\"1200\" height=\"1697\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/08\/1756414587_764_\" decoding=\"async\" loading=\"lazy\"\/>         <\/p>\n<p>Benjamin Guerrero-Cruz, shown at school, is an avid soccer player and loving older brother, according to his family.<\/p>\n<p>(Rita Silva)<\/p>\n<p>Guerrero-Cruz was  held in downtown L.A. for a week after his arrest, during which he was briefly taken on an unexplained trip to a detention center in Santa Ana before being transferred to Adelanto on Aug. 15, according to a former teacher who visited him in custody. <\/p>\n<p>His experience of being pingponged around different facilities is <a class=\"link\" href=\"https:\/\/www.wsj.com\/us-news\/law\/ice-detention-migrants-vanish-38fd798f?\" target=\"_blank\" rel=\"noopener\">common<\/a> among those being detained in what the Trump administration is billing as the largest deportation effort in American history. <\/p>\n<p>This trend is also reflected in ICE\u2019s flight data.
